Pakistan has asked the World Bank to "fulfil its obligations" regarding the Indus Water Treaty as it objected to the body pausing two concurrent processes related to Indo-Pak dispute over Kishenganga and Ratle project.

Pakistan Finance Minister Ishaq Dar in a letter to World Bank President Jim Yong Kim said the Treaty does not provide for a situation wherein a party can "pause" performance of its obligations under the accord.

Dar said the World Bank's decision to pause the process of empanelment of the Court of Arbitration will seriously prejudice Pakistan's interests and rights under the Indus Waters Treaty 1960.

"It (the letter) strongly conveys that the matter of appointment of a Chairman of the Court of Arbitration has been inordinately delayed. It urged the World Bank to execute its obligations under the Indus Waters Treaty," Radio Pakistan reported.

Dar said the "pause" will merely prevent Pakistan from approaching a competent forum and having its grievances addressed.

The letter is a response to Kim's letter of December 12 in which he announced this pause to "protect the Indus Waters Treaty and to help India and Pakistan consider alternative approaches to resolving conflicting interests under the Treaty and its application to two hydroelectric power plants".

India had taken strong exception last month to the World Bank's decision to set up a Court of Arbitration and appoint a Neutral Expert to go into Pakistan's complaint against it over Kishenganga and Ratle hydroelectric projects in Jammu and Kashmir.

World Bank President Jim Yong Kim has held a telephonic conversation with Pakistan’s Finance Minster Senator Ishaq Dar and discussed with him Indo—Pak water dispute, days after the country asked the global lender to “fulfil its obligations” on the issue.

Dawn newspaper quoted official sources as saying the call was made on Monday.

Mr. Dar on December 23 had written a letter to Mr. Kim over the dispute over two hydroelectric power plants —— Kishanganga and Ratle —— that India is building on the Indus rivers system.

Mr. Dar in his letter said that delaying arbitration would seriously prejudice Pakistan’s interests and rights under the Indus Waters Treaty.

The letter explained that Pakistan was not withdrawing its earlier request to the bank to appoint the chairman of the Court of Arbitration and since this process had already been “inordinately delayed”, Islamabad wanted the bank to appoint the chairman as soon as possible.

Pakistan believes that further delay would hurt its interests as India is working day and night to complete the two disputed projects. And once they are completed, it will be difficult to undo them.

The Indus Waters Treaty, signed in 1960, distributed the Indus basin rivers between the two countries, giving India control over the three eastern rivers — the Beas, the Ravi and the Sutlej — while Pakistan has the three western rivers — the Indus, the Chenab and the Jhelum. The treaty empowers the World Bank to arbitrate any water dispute between India and Pakistan.

Earlier, last week Mr. Kim sent a letter to the finance ministers of India and Pakistan, informing them that he had decided to ‘pause’ the bank’s arbitration and urged the two neighbours to decide by the end of January how they wanted to settle this dispute.

Tensions over the water dispute intensified in November when Indian Prime Minister Narendra Modi threatened to block the flow of water into Pakistan.

In the formal request sent to the bank, Pakistan argued that the Court of Arbitration could be formed at the request of either party, if the party concludes that the dispute is not likely to be resolved by negotiation or mediation.

The bank would also be obliged to establish the court if the aggrieved party concluded that the other government was unduly delaying the negotiations.

Pakistan informed the World Bank that it has already exhausted the option to engage India for resolving the dispute through bilateral talks and was now exercising the option to take its case to the Court of Arbitration.

The Supreme Court on Tuesday will hear a plea filed by apex court lawyer Manohar Lal Sharma in the Indus Water Treaty issue. Calling the treaty ‘unconstitutional’, the petition has called for a scrapping of the Indus Water Treaty between India and Pakistan. Sharma says the treaty is invalid as it was signed by Nehru and Khan, and that it should have been signed by the President of India. The treaty was signed on September 19, 1960 by India’s first Prime Minister Jawaharlal Nehru and Pakistan President Ayub Khan. It is one of the most liberal water-sharing pacts in the world.

The agreement covers six rivers – the three eastern rivers of Ravi, Beas, Sutlej and their tributaries and the three western rivers of Indus, Jhelum, Chenab and their tributaries. Water from the eastern rivers has been allocated to India, and New Delhi is obligated to let 80 percent water from the western rivers flow to Pakistan. The treaty gives the lower riparian Pakistan more ‘than four times’ the water available to India.

China has built a medium scale dam near Demchok,Ladakh.

The dam is very far from Kailash-Mansrovar and will largely cater to the needs of the expanding military city near Ladakh,
which raises concerns in India.

Pakistan today asked India and the World Bank to inform it about all the dams and hydropower projects proposed to be built by India under the Indus Waters Treaty on the western rivers, and not just the two projects under dispute currently.

The matter was discussed during an inter-ministerial meeting presided over by Finance Minister Ishaq Dar yesterday.

Ministers and other representatives of the ministries of water and power, foreign affairs and law and justice, the Attorney General's office and civil and military experts attended the meeting.

The meeting observed that the president of the World Bank had drawn up the lots for appointment of umpires for a court of arbitration before it had put on hold the process about two months ago. "This meant that the World Bank was convinced and had accepted Pakistan's position," Attorney General Ashtar Ausaf claimed.

Pakistan said its stance was that not only the two schemes under dispute at the moment — the Kishanganga and Ratle projects — but technical and other details of all the upcoming projects should be shared with the World Bank and Pakistan, along with their designs and locations, so that Islamabad could examine them in a manner that they did not create problems every now and then and the treaty could function smoothly, said Ausaf.

The meeting also asked a taskforce led by the attorney general to formulate a strategy for future handling of the disputed projects.

Ausaf said the chief executive officer of the bank, Kristalina I Georgieva, who is second only in hierarchy to its president, would arrive on January 26 for deliberations on the subject.

He said the senior official was inducted into the World Bank group on January 2 and her visit to Pakistan would be her first trip outside Washington, which meant that the bank was attaching great importance to Islamabad's case.

At the same time, Ausaf said, it was decided that the bank must be reminded that it had a critical role to play and that it should honour its responsibilities under the treaty.

The Finance Ministry said that Pakistan viewed the treaty as a useful and time-tested mechanism for sharing water with India and that Islamabad had always abided by it.

It said it was in the interest of both countries that they continue to implement the terms of the treaty. In this spirit, Pakistan would continue to fulfil its obligations under the IWT.

The contrasting stances of Pakistan and India were deliberated in detail at the meeting.

The treaty, signed in 1960, gives India control over the three eastern rivers of the Indus basin -- the Beas, Ravi and Sutlej -- while Pakistan has the three western rivers -- the Indus, Chenab and Jhelum.

The IWT also sets up a mechanism, the Permanent Indus Commission, which includes a commissioner from each country.

The current dispute revolves around the Kishenganga (330 megawatts) and Ratle (850 megawatts) hydroelectric plants. India is building the plants on the Kishanganga and Chenab rivers, which Pakistan claims violates the IWT.

I can think of one drawback of River Indus.

Compared to River Ganga, the banks of River Indus have not given birth to a population as dense as that on the banks of River Ganga. Ganga not only gave birth to the huge population but is also sustaining it.

Again parroting that line of single state of Uttar Pradesh having roughly the same population as Pakistan. But then it is doubtful because Indian official authorities as well as media tell lies. But another tidbit supports this theory. Before 1971 breakup, despite having a bigger area, it is said, the Western wing of Pakistan had a population less than that of Eastern wing.

There is something about River Ganga which is a bigger supporter of life.

You may argue that throughout its length, River Ganga runs closer to the mighty Himalayas. Whatever be the factors, the fact remains that the overall ‘package’ of the River, the vicinity and proximity to Himalayas is more magnificent in the case of Ganga than in the case of Indus.
