ISLAMABAD: Prime Minister, Yousuf Raza Gilani, Wednesday said that no one should have any doubts about restoration of judges and assured of their reinstatement in a week.

It may be remembered that the ruling coalition had failed to reach any consensus over the issue of judges restoration.

Therefore, Pakistan People’s Party and Pakistan Muslim League-N tasked ANP and JUI to prepare recommendations in this regard and for this they were allowed 72 hours.

ISLAMABAD: Prime Minister, Yousuf Raza Gilani, Wednesday said that no one should have any doubts about restoration of judges and assured of their reinstatement in a week.

According to sources the Prime Minister said this while speaking to a PML-Q parliamentarians.

Gilani said that there is no conflict between the coalition partners on the judges issue. He also said that the 17th amendment will be abolished after the restoration of the judges.

Talking to a delegation of Senators at the Prime Minister House, Gilani called for striking a balance of power among the various pillars of the state in line with the Constitution of 1973.

He stressed on the importance of an independent Election Commission and said that Parliament committees should be strengthened for the purpose of accountability.

The Prime Minister also discussed the overall political situation in the country with the visiting Senators.

But what of the ex CJP Iftikhar Chaudry.....

Thats where this issue will get interesting as its still unclear as to what the PPP position is on his reinstatement.

Furthermore what is to be done with the current serving Judges?

ISLAMABAD: Three coalition partners will move a resolution in the National Assembly today to restore the deposed judges but all indications are that Justice Iftikhar Mohammed Chaudhry may still not be restored, something which could force the PML-N to part ways with the PPP.

Amid intense political activity on Thursday night, mediators Maulana Fazlur Rehman and Asfandyar Wali Khan kept negotiating with PPP chief Asif Ali Zardari and PML-N leader Mian Nawaz Sharif but a unanimous agreement on the restoration of all the judges could not be reached.

The resolution may be passed today, according to a senior PPP leader, but whether an executive order will be issued the same day and all the deposed judges will be reinstated on their positions is not clear.

According to some sources, however, a proposal was under consideration to restore all the deposed judges at the first stage and later through a constitutional amendment tenure of the chief justice may be fixed for five years as the PPP wanted to make it through the constitutional package.

But a source privy to the fast-paced negotations between the three coalition partners since Thursday evening, confided to our correspondent at 00:40 a.m Friday that a set of ruling MNAs including some from Fata have been briefed as what to say in the National Assembly. The strategy is to portray deposed Chief Justice Iftikhar Muhammad Chauhdry as a controversial man, who could not be offered the job of the chief justice of Pakistan. However, Justice Iftikhar may be offered some other important job.

The PPP, the JUI(F) and the ANP confirmed that Friday would be an important day for the restoration of the deposed judges. However, the PML-N is of the view that it has not been contacted or informed of any such development. While the PML-N has made up its mind to quit the coalition if the judges are not restored by Friday night, the Zardari House too is feeling “sick” of the N-League’s “stubbornness” on the judges issue.

The source said that the National Assembly would recommend that all the deposed judges except the deposed chief justice should be restored to the Nov 2 situation. In his recent interaction with his partymen and also even with Nawaz Sharif, the PPP co-chairperson has talked of a minus-one formula, which is not acceptable to the PML-N, the lawyers fraternity and a large number of the members of the civil society.

When contacted a senior leader of the PML-N said the party was not formally informed of these suggestions. “Asfandyar Wali Khan and Maulana Fazlur Rehman are scheduled to meet Mian Nawaz Sharif at 12 noon at the Punjab House today (Friday) and when these suggestion would be discussed with us then we will be in a position to give any response as still we believe that as one of the bigger coalition partners, we should be taken into confidence,” the PML-N leader said and expressed the hope that the party would be taken onboard before moving the issue to parliament.

“We believe in strengthening the coalition and hope that all the decisions would be taken with consultation,” he added. He said if the PPP brought a resolution then the PML-N would look into the modalities of the resolution as the modalities had already been finalised by the two parties in the Murree Declaration.

Meanwhile, the ruling coalition’s mediation committee, comprising Asfandyar Wali and Maulana Fazlur Rehman, completed its consultations regarding the restoration of the deposed judges and will present its recommendations to the PPP and PML-N leaders in the ruling coalition meeting today (Friday).

The coalition heads are gathering at the Zardari House this evening (Friday) in the backdrop of the warning given by the PML-N that it will quit the coalition if the deposed judges are not restored within the stipulated time of 72 hours.

PML-N Quaid Mian Nawaz Sharif earlier Thursday in an interview with Wall Street Journal had given a stern warning to the PPP-led government that the PML-N would sit in opposition if the deposed judges were not restored by Friday (today).

However, sources close to ANP and JUI-F were hopeful of positive outcome with regard to judges’ restoration. They said both the parties indicated that they would present a middle way for the restoration of the deposed judges acceptable to the PPP and the PML-N.

On Thursday, Asfandyar Wali and Maulana Fazlur Rehman held mutual discussion during the National Assembly session to finalise deliberations after completion of consultations with the leaders of the PML-N and PPP. PPP’s Syed Khursheed Shah and PML-N’s Ahsan Iqbal joined them briefly during the discussions.

Sources said during the discussion, PML-N representative told the members of the mediation committee in clear words that his party wanted the restoration of the deposed judges and for that purpose they were even ready to give NRO a legal shape. However, the sources told that PML-N would not consent to giving indemnity to Gen (R) Pervez Musharraf. Sources further said that PML-N had also indicated to sacrifice its right to the presidency in the PPP’s favour if the judges were restored.

However, sources said the PML-N had not yet replied in the affirmative to the proposal and the issue would be taken up in the meeting of the heads of the coalition.

Sources said once the heads of the coalition reached a decision to restore the deposed judges they would form a committee to draft the resolution and it would be presented in the National Assembly for approval to issue an executive order.

Meanwhile, talking to newsmen outside parliament, Information Minister Sherry Rehman said the judges issue would be resolved by the coalition partners with consensus. She said that coalition partners Maulana Fazlur Rehman and Asfandyar Wali had the right to make their decisions after consultations with their party leaders.

About the presidential candidate of the ruling coalition, she said the PPP Central Executive Committee (CEC) meeting would finalise the name of the candidate on Friday.The minister also noted that US President Bush, during a telephonic talk with Prime Minister Yousuf Raza Gilani, had expressed the desire to continue cooperation with the democratic government in Pakistan.

ISLAMABAD: Pakistan Muslim League-N leader Nawaz Sharif said that his party does not want breakage of ruling coalition and Musharraf had resigned because of the strength of ruling coalition.

There was a written deal with Asif Zardari that judges would be restored within 24 hours after Musharraf’s resignation but it could not happened.

In a meeting with Asfandyar Wali and Maulana Fazlur Rehman, it has been decided that a resolution would be drafted for restoration of judges and to declare November 3 measures void.

The resolution would be presented in National Assembly on Monday and it would be approved on Wednesday after debate on Tuesday.
