A Berlin pupil does not have the right to perform 'namaz', Islamic prayer rituals, at school, an appeals court in the German capital ruled Thursday.

In a decision that overturned a lower court ruling, the appeals court said that a curtailing of the teenager's right to religious freedom was justified as it would protect the constitutional rights of other pupils and their parents.

Those rights include freedom of belief and entitlement to a calm educational environment, it said.

Yunus, a 16-year-old Berlin pupil, had initially been granted the right to pray once a day, during a break. However, the appeals court considered that ruling to endanger peaceful relations at the school.

A Berlin Senate official had earlier told the court that 'the Islamic prayer ritual has a demonstrative character and serves as social control'.

He also argued that there were practical difficulties, as the boy was entitled to a private room to pray in.

The court heard that the high school features pupils from 29 different countries, who often argue about religious mores such as the wearing of headscarves and fasting rituals.

The presiding judge said she detected a serious potential for conflict, adding that this justified assigning the pupil a separate room to pray in. But that would in turn lead to another issue, as such privacy could not be extended to all pupils.

'With the multitude of religious denominations, that would burst the capacities of the school,' the judge ruled.

The school's lawyer had also argued that the boy only used the room 'sporadically' - just 14 times in the past two years.

But Yunus said that teachers often would not open the room for him. His lawyer argued that the deeply religious teenager prayed five times a day.

While the court did not rule in Yunus' favour, it did recognise that he took his religious duties seriously.

'This is a good day for the Berlin school,' school director Brigitte Burchardt said after the verdict, adding that the decision reduced the potential for conflict.

The teenager has the option of further appealing the verdict in a federal court.

What a BS statement. IF the other students are driven to conflict just because a person offers his prayers, then the fault lies with them. Why punish the victim?

He also argued that there were practical difficulties, as the boy was entitled to a private room to pray in.
Actually the student can also pray on the street, a closet, any where.
 
Btw, there is no stopping a Muslim from prayers. He can just sit and face the correct direction and perform his Salah, without a mat, without anything. In fact it only makes his prayer that much more blessed if he manages to do it in the height of oppressive prejudice like this.
 
The Judge has taken a right decision and told clearly why this cannot be allowed in the school.

The boy needs to keep his religion at his home and concentrate on studies at the school,
Why? He is doing it in break time, he is not harming anybody else, his studies don't get affected in anyway. Get an education before being promoting prejudiced bigotry.
 
Yunus should just silently recite his intent for prayer, read out his Surahs. Let's see the judge ban him from performing the Salah in his mind.

One of the best things about Islam, the Salah is the most easiest to follow prayers and if Allah willing his prayers will be accepted given his situation.
 
This a pure discrimination and prejudice against Islam. The boy was praying at his break inside a room so how does that create any conflict with other student? An anti Islami judgment by an anti Islam judge. :tdown:

What's the prejudice - If every student in the school ( It has students from 26 Countries) wants special permission for different things, then it becomes difficult for the school authorities to run the school.

For this boy praying is important, Then for other boys there might be other things important, which they would like to do.
A school cannot be run on those lines.

Like you said - the student can offer silent prayers by himself in his mind, there is no one stopping it.

A very rational decision has been taken by the judge.

really? they are protecting freedom of belief by denying freedom to another person?

and how does someone praying hurt anyone?

this two faced behaviour can only be condemned. and when we ban facebook they cry about freedom of speech

Meanwhile, a question of Yunus's continued devotion has been raised. An unnamed official with the Education Department commented that the school's prayer room has been used five times within the last six months.

I think the boy is just trying to grab attention...after they accommodated him with a special prayer room, he didn't even bother to pray properly!

What special permission? He wants to stand up, prostrate in the direction of the Kabah, stand up and repeat a couple of times?

He can do it in any corner of the school during his free time.

Of course he can pray silently. Prayers are performed silently when done without a congregation. Muslim prayers don't need any special place or setting, after all we believe everything in life is an Allah given. However it just shows the backwardness of western societies and how the subjugate freedoms themselves.
