Bank refuses to accept women witnesses

State Bank governor Shamshad Akhtar. 'Although a woman supervises Pakistan’s banking sector as the central bank governor, a premier commercial bank of the country cannot accept women as witnesses.'

ISLAMABAD: Although a woman supervises Pakistan’s banking sector as the central bank governor, a premier commercial bank of the country, according to one of its senior officials, cannot accept women as witnesses in what a prominent lawyer and senator described on Sunday as a 'gender-based discrimination' violating the Constitution and Islamic injunctions.

The Allied Bank’s regional head for credit administration department in Islamabad said this was being done under 'court instructions'and 'government of Pakistan rules.'

'Witnesses of ladies are not acceptable (sic),' said a memo from the official to a bank branch in Islamabad in connection with a credit facility against Defence Savings Certificates that was finalised on Saturday after the applicant was made to substitute a promissory note signed by two male witnesses for one that bore signatures of as many women, while several other papers needed for the arrangement were all signed by male witnesses.
This correspondent, who was shown the memo as an applicant for the facility, asked the bank official, Mr Saeed Akhtar, by telephone whether he was sure women could not stand as witnesses in such case. He replied: 'Yes surely. I am doing this for 20 years.'
The official did not specify any law or a prudential regulation banning women from being witnesses but said this was being done lawfully although women held senior positions in the banking sector, whose supervisory State Bank of Pakistan is currently headed by its first woman governor Shamshad Akhtar.
'This is clear-cut violation of the injunctions of the holy Quran laid down in the dictum of God which says that ladies can testify competently under all heads and in all courts and obligations,' PPP Senator Babar Awan told Dawn when asked about the legal position on the issue, which he said could be raised in parliament.
He said that even under the controversial Qanun-i-Shahadat of 1984 enforced by then-military ruler General Mohammad Zia-ul-Haq,
'men and women are equally competent to give evidence and stand as witnesses. In everyday judicial practice, women are appearing as competent witnesses and their testimony and depositions are being relied upon throughout the country as well as globally.'

Mr Awan also noted that under Article 25 of the Constitution, gender-based discrimination violated the fundamental rights guaranteed by Pakistan’s supreme law and said: 'Therefore, saying that women are not competent witnesses is not only a derogation of the injunctions of Islam but also contemptuous of the constitutional and judicial system of the country.'
 
How can bank issue such memo against Article 25 of the Constitution as mentioned in the article ?
 
As far as the witness in any court is concerned both men and women are equally accepted but when we talk about any other form of witness and verdict is concerned two women are require as opposed to one man. That's what Islam says.

Now banks simply refusing to accept women witnesses is something that needs pondering upon.
 
Such banks can be tried in courts, take away bank licenses of such banks.
 
Salvery and segregation was practiced in the US for centuries, though one could argue that the US constitution condemns such practices.

Just having a law on the books does not do much - social attitudes need to change and society needs to evolve. Hopefully with the media covering more and more of this, and rising social discourse, we shall start seeing changes, as we did with the Womens Protection Bill that struck down some of Zia's vile laws.
 
notice the argument Mr. Awan offers, even though he is a trained lawyer and not a mullah, the first argument he offers that it is violation of the Quran, not that the code is against the law - first islam then law - is this a republic of laws or an Islamic emirate?

How long will this curse last? By the time pakistanis decide what they are, little will be left of Islam that we once knew - we talk Islam and worship saudi money and what they say is Islam.
 
New currency notes: Legal notice for SBP

LAHORE, Sept 29: A senior lawyer has sent a legal notice to State Bank of Pakistan Governor Shamshad Akhtar seeking withdrawal of all new currency notes within 30 days.

Lawyer Tariq Aziz says the new notes of all denominations do not carry the Hadith underlining importance of earning money honestly.

He said earlier all the notes carried the Hadith of ‘rizq-i-helal ain ibadat hai’
(making an honest living is akin to praying)

I kinda like that quite secular hadith if there such a thing.

Of course it didn't work, the phrase "Quaid-e-Azam ki naiki" comes to mind.
 
The state as preacher? Currency not just a medium of exchange but religious instruction?

Can't we just stick Iman Ittehad and Nazm? If the state must be preachy why not preach the virtues of the state?

I personally didn't even know it was from a Hadith.

I think it's the states responsibility to make sure that everyone makes an honest living devoid from corruption. It just seemed like a public service message rather than religious proselytizing.

Of course, I do not know their intent. I'm just explaining what it meant to me.
