Bajwa data leak: Islamabad court approves two-day physical remand of Bol News journalist Shahid Aslam

A local court in Islamabad on Saturday approved a two-day physical remand of Bol News journalist Shahid Aslam, who was arrested by the Federal Investigation Agency (FIA) from Lahore earlier in the day for his alleged part in leaking personal tax data of former army chief General (retired) Qamar Javed Bajwa.

A report by investigative news website FactFocus — which describes itself as a “Pakistan-based digital media news organisation working on data-based investigative news stories — had in November published a report, accusing the army chief and his family of amassing assets worth Rs12.7 billion over the past six years.

The report cited tax records and wealth statements of the Bajwa family to corroborate its claims about the alleged accumulation of assets by the family inside and outside Pakistan.

Taking a notice of the report, the finance minister had said that the leak was “clearly violative of the complete confidentiality of tax information that the law provides”.

Aslam, who has been arrested in connection with the data leak, was presented before the court today. His counsel argued that the detention of his client was illegal, saying that there was no proof that Aslam “received any [leaked] information and had then passed it on to someone else”.

He urged the FIA to provide proof to support its claim to the court, adding that neither of the four sections in the FIR was valid and that his client could not be arrested just on the basis of suspicion.

It is pertinent to mention that Dawn.com was unable to acquire a copy of the FIR till the filing of this story.

Subsequently, the counsel prayed to the court for the dismissal of the case against his client.

To this, the prosecutor said the proof was in Aslam’s mobile phone and laptop, which he was not providing to investigators. He claimed the journalist played a “role of the facilitator” in the crime.

“Why was Shahid Aslam visiting the FBR? It was because he had to acquire information,” the prosecutor said, adding that if found guilty, Aslam could face a 10-year jail sentence.

After hearing the arguments, judicial magistrate Umar Shabbir approved a two-day physical remand of the journalist.

Sole reason After Islam, Military was the main force which kept Pakistan united, but after this miss adventure, Military has made majority of younger generations its own enemy, which start to see the affects very soon.

When Military wont find backing from population, they will have depend more on force.

The way I see it, Gen Bajwa's "personal" tax returns were released to the public. This is private information as per the law of the land. Gen Bajwa is not an "elected" politician whose tax returns are open to the public. Only under specific allowances by the courts (not even the government) can these records be released or if the subject himself allows these to be released. Any other release is illegal and would be subject to legal action.

The above is an entirely different issue from the one concerning sources of Gen Bajwa's income (which is what people are alluding to). That is an appropriate track to dive into and rightfully should be investigated to ascertain why the CoAS has all these assets and what the sources of these assets are given his position as a BPS-21 officer.

But the Islamic Republic of Pakistan is not investigating General's sources of income. They're investigating why the data was made public.

One wonders whether to laugh or cry.

Bajwa or random person on the street, whether you like someone or hate someone, obtaining, possessing and leaking someone's personal information is a crime. This law is not just in Pakistan but in each and every country in the world. If someone has evaded taxes or has been involved in corrupt practices, there are relevant authorities to take action. Of course a lot of you would argue that in a country like Pakistan those authorities are often blackmailed, true, but at the end of the day two wrongs don't make a right. The bottom line is judicial and governing system need to apolitical and impartial to take appropriate action. Rather than fighting and wasting time for Nawaz and Imran to return to power, it would help if you people actually protest in front of NAB, FBR, and courts to do their jobs. In democratic societies, governing authorities are afraid of people rather than military. Grow some balls if you haven't already.

This is shocking, instead of investigating Bajwa's alleged corruption they detain the guy who blew the whistle. The courts need changing this whole system is corrupt to the core.
Judges are just using this opportunity to save themselves, before it happens to them.

We also had private conversation of PM as well as PM office conversations leaked in public with no repercussions- but heaven forbid tax returns got leaked of these Holy Saints.
