11 people from Pakistan detained at Nepal border

Maharajganj, July 3: Eleven people, including five former militants, who tried to enter India from Nepal through Sonouli border, seeking to avail the benefits of Jammu and Kashmir Rehabilitation policy were detained. Sashastra Seema Bal (SSB) commandant of Sonouli, B K Bankhoti said that the group comprising five men, four women and two children were sent to Jammu and Kashmir cell in Delhi, accompanied by jawans. "The group had reached Kathmandu from Pakistan and from there crossed into India Tuesday night and were detained by security personnel as they did not have valid documents," he said. They had left Jammu and Kashmir between 1989 and 2009 and were settled in Muzaffarabad in ****************** Kashmir (***), Bankhoti said, adding that some of them had also been involved in terrorist activities. They told security personnel that they wanted to take advantage of the Rehabilitation policy of 2010 under the J&K government and wanted to go there. According to the surrender policy, former militants who crossed over to *** between 1989 and 2009 would be considered for safe return. The SSB Jawans will accompany the group till Delhi and from there the central intelligence agencies would take over.

They must be coming for surrender using the amnesty scheme.

The problem is they enter illegally and not from the designated routes so are not eligible for the scheme.

"No ex-militant has returned through identified routes under aforesaid policy (return and rehabilitation) after fulfilment of conditions prescribed in the policy," Chief Minister Omar Abdullah said in a written reply to the question of Chaman Lal Gupta in Legislative Assembly today.

The CM, however, said during past three years till February 15 this year, 241 ex-militants have returned "illegally" via Nepal and other routes along with their family members.

He said that those who have not returned under the policy will not be eligible for any assistance for their rehabilitation.
 
Good decision by them. Indian Govt must help them so that they can live peacefully in Kashmir again and doesn't indulge themselves in terrorists activities again.
 
that is the tacit agreement, they will use nepal route. There wont be any 'official' route, as it will be dangerous.

"As per Rehabilitation Policy notified by the government of Jammu and Kashmir in 2010, Joint Check Post at Wagah (Attari), Salamabad, Chakan-da Bagh crossing on the LoC besides, Indira Gandhi International Airport, New Delhi have been designated as routes for ex-militants of J&K who had crossed over to ***/Pakistan but have given up militant activities due to change of heart and are willing to return to the state. However, no ex-militant has been able to access these routes for return so far.

"The ex-militants have been coming back via Nepal border because there is no visa regime between India and Nepal for Indian citizen. As per report of J and K police, in the past three years, from 2010 to 2012 and the current year up to April 10, 262 ex-militants have returned via Nepal," Minister of State for Home RPN Singh said in a written reply.

"All persons returning via Nepal are being screened in Joint Interrogation Centre (JIC) and are subjected to due legal procedures through appropriate Court of Law. During the period of arrest of such returnees, all relevant agencies have access to joint interrogation. Those bailed out by the Court of Law are kept under regular surveillance," he said.

Here's the catch - they are returning through un-designated routes via Nepal and do not fall under the scheme.
