Business Line : News / International : Pak court reopens 84-yr-old blasphemy case

LAHORE, FEB 21: A Pakistani court has begun hearing a petition seeking the reopening of an 84-year-old case in which a court under the British administration had given the death sentence to Ghazi Ilamuddin for murdering a Hindu writer named Raj Pal.

Lahore High Court Chief Justice Umer Ata Bandial heard arguments by the petitioner’s counsel on the maintainability of the plea yesterday and adjourned the case till March 14.

Ilamuddin killed Raj Pal for allegedly committing blasphemy against the Prophet Muhammad and was sentenced to death by British judges of the Lahore High Court in 1929.

Imtiaz Rasheed Qureshi of the “Save the Judiciary Committee” has filed the petition for reopening the case and exonerating Ilamuddin.

Farooq Hasan, the counsel for Qureshi, argued Raj Pal had included blasphemous material in his book and had “invited his death“.

He said: “Ghazi Ilamudin had no personal grudge with Pal and acted only out of love for the Prophet like a true Muslim.”

Hasan requested the court to set aside the impugned order by exercising the principle of review.

Qureshi asked the court to direct authorities to honour Ilamuddin with state awards.

He also requested the court to direct the government to arrange a state funeral for Ilamuddin after declaring him “not guilty”.

Wow, this is the most important issue facing the pakistani judiciary now. Not terrorists who are going scot free :enjoy:

Pakistan is going the right way. It would be good for us if they impose Sharia and kill all the kafirs. After all its the love for the rasool that makes them do these vile acts.

That way any semblance of competition from our western borders is eliminated.

Jinnah had something to do with this case. I remember reading this before.

Pak courts have to listen to every petition, but it should technically be found non-maintainable.

I fear if this is reversed this would set the grounds for Qadri's release.

That (unfortunately) might be the only significance and relevance of this petition.

Some SOB definitely has planned all of this for that purpose. The court should play it safe and call it non-maintainable since the case does not involve a Pakistani citizen.

That is one ground for maintainability; I am sure. The other is the code under which the original case was heard. Is the legal provisions the same. And are those provisions still enforceable under the same code?

And who is going to protect Rassol from them ?

It would be the most absurd thing if the court proceeds with this petition and starts hearing it, a case which has its origins in a time when Pakistan didn't even exist! So technically, it doesn't involve anything Pakistani.

This would kind of be the same as Pakistani courts hearing the case of a German killing a Jew, would it not?

Let's hope the court declares it non-maintainable.

strange...

completely agree

technically, this should go to a british court.

84 Year old but Pakistan's age is 66. Then why Pakistani Courts are hearing any cases when Pakistan was not even in existence. Pakistani courts surely are on trolling spree these days. They are not hanging the Terrorists but can open the 84 year old case.

PC are surely made up of phucked up minds... and we are expecting something good from them.

CJ has a lot of time to release known terrorist on basis of lack of evidence but to keep himself busy he is opening cases from the era when Pakistan did not even existent. All this blind love for religion makes me think if we are headed in same direction as Afghanistan!
