MUSHARRAF'S "EXIT CONTROL LIST" MYSTERY SOLVED...

The Special Court in its decision yesterday stated that Ex President Musharraf has a right to sort medical treatment abroad however the court has no jurisdiction of removing Musharraf's name from the ECL. The court suggested that Ex- President Musharraf should submit a request to appropriate authorities. Later both application filed by new lawyer Furrakh Naseem were dismissed. A separate application was submitted to the Ministry of Interior based on compassion later during the day.

Sadly enough, Ex President Musharraf hired the most incompetent lawyers, all passed their expiration and retirement age. They were having distressed in keeping up with Musharraf's legal troubles which were adding up daily. While doing their circus outside the court house everyday, they fail to realize that Article 6 may not be the only matter stopping President Musharraf's exit from Pakistan

Filing two different application in the Special Court yesterday showed the incompetency of the new lawyer Furrakh Naseem but he can't be blamed, if he was retained at 4 in the morning. In Article 6 case, Musharraf is a free man, just indited(accused) not charged. High Treason is a a criminal matter, a heinous crime punishable with death or life imprisonment, but in this case no handcuff's not judicial remand for Musharraf? Free to go anywhere for medical reasons with permission of concerned authorities....

On the other hand Prime Minister Nawaz Sherif thinks, he is that authority therefore today April 1st, Prime Minister Nawaz Sharif spent a busy either fooling himself or fooling the nation with a high level meetings with PLMN top leadership discussing the option of the Government of Pakistan removing Ex President Musharraf's name from Exit Control List commonly known as ECL?

The anchors, political pundits, lawyers and analysts spent all evening talk shows, debates on the same issues.....Should Government allow Ex President Musharraf's name be removed from ECL? Everybody had his or her own opinion... some pleading compassion and some seeking vengeance.

The decision, should Musharraf be allowed to leave the country lies with the Prime Minister or with the Court can be answered easily if we just go back in time to see how Ex- President name was put on ECL and why? Once we have that part figured, it will be easy to see where to file for judicial relief.

On March 29, 2013, the Sindh High Court granted a 21-day extension to Musharraf in the Benazir Bhutto assassination and Nawab Akbar Bugti case. The court also ordered the authorities to retrain Musharraf from leaving the country.

On April 8th, 2013, The Supreme Court issued notice to former military ruler General (R) Pervez Musharraf to appear in court on Tuesday. The bench also directed Secretary Interior to ensure that Musharraf does not leave the country and ordered that his name be added to the exit control list (ECL).

The directorate general immigration and passport has said that the name of former dictator president Pervez Musharraf has been put on Exit Control List (ECL). The directorate has put the former military ruler’s name on the ECL over the orders of the Sindh High Court (SHC).

On December 23th, 2013 Musharraf's legal team did file an application in Sindh High Court for relief and it was dismissed. A two-member bench of the SHC stated the matter did not fall under the legal jurisdiction of the SHC. The court advised Musharraf's counsel Advocate A.Q. Halepota to refer the matter to the federal government or the trial court. Begum Saba Musharraf filed the application with Ministry of Interior which was denied based on outstanding court orders.

Chaudhri Nasir Ali Khan, the Minister of Interior reiterated many times in last one year that Musharraf's name will stay on ECL till an order from the court is received by him. Case closed. So let's me make it simple for my readers...

On March 29th, 2013 Sindh High Court and on April 8th, 2013 in different cases ordered the government of Pakistan to put Musharraf's name on the ECL. Nawaz government happily complied with the order.

Its evident, the ping pong between Government of Pakistan and The Courts on the matter of ECL shows there determination to humiliate Musharraf and Pakistan Army to settle the scores of military adventurism in 1999 and 2007. Sadly enough, Musharraf's own incompetent lawyers failed to file an immediate relief application in Pakistan Supreme Court against its ordered dated April 8th, 2013 and against Sindh High Court asking to setting aside SHC order of March 25th, 2013.

So if in the end Musharraf can't leave without a clean chit from Supreme Court of Pakistan than why Mian Nawaz Sherif is busy discussing the removal of Musharraf's name from ECL with top PLMN leadership? It doesn't make sense to me other than " Government and Judiciary" are a team in this dirty game of politics.

Offcourse I wondered yesterday why did Mr. farogh Nasim had submitted an application to interior ministry. he should just file an appeal to SCP.
