Army Court Gives Life In Jail To Officer In Fake Encounter Case In Kashmir​

An army court has awarded life imprisonment to an officer involved in a staged encounter in Jammu and Kashmir's Shopian district.​

An army court has awarded life imprisonment to an officer involved in a staged encounter in Jammu and Kashmir's Shopian district. Captain Bhupinder Singh, accused in the fake encounter, was sentenced to life imprisonment after court martial proceedings were completed a few days ago, official sources said.

In July 2020, three labourers were killed at Amshipora in Shopian district. Army officers had claimed they were Pakistani terrorists and with their killing, terror threat was eliminated in the district.

But days later, locals alleged that the three young men killed were cousins from Rajouri district who were working as labourers. After protests by the families, the army ordered an investigation.

A court of inquiry instituted by the army had found that the troops had exceeded powers vested under Armed Forces Special Power Act or AFSPA and acted in contravention to the rules approved by the Supreme Court. The army had also claimed recovery of huge cache of arms from the "encounter" site and that disciplinary action would be taken.



The Jammu and Kashmir police have already filed a chargesheet on the killing, naming the army captain and two civilians. They have been accused of hatching a conspiracy, kidnapping and killing three cousins from Rajouri and passing them as hardcore Pakistani terrorists.

The inquiry ordered by the Army authorities into Op Amshipora has been concluded. The inquiry has brought out certain prima facie evidence indicating that during the operation, powers vested under the AFSPA 1990 were exceeded and the have been contravened," a defense spokesman had said.

What? There is no suspended sentence, the officer is found guilty and sentenced for life imprisonment. He can now appeal his case in the High court.

This is a normal occurrence.

Great job arresting some low level officer and chucking him away as a scapegoat. Will they have the guts to arrest the officers who gave the orders to fake an encounter?
 
In India there is rule of law. And we don't give blood money option to convicts.
Please don’t make me laugh, India is one of the few countries in the world where clear cut murder cases with fuckin video proof also end with aquittal. Rich being sent to jail is exception rather than the norm.



Indian justice system is banana system, same level as Pakistan. Difference is that Pakistanis seem to have realized it while you bhakts on cowcola will keep living in delusions until the day someone drives a car over your family and walks free.

Nope, usually terrorists in Kashmir has Rs. 5 to Rs.20 lakh reward per head. So if 3 terrorists are captured/killed, the officer can earn up to Rs. 30-60 Lakh in a day.

The two civilians who were arrested along with the officer is probably his local Kashmiri informer. The three of them conspired to tag unknown migrant laborers as "terrorists" and kill them to share the Reward between themselves.

Only the laborers turned out to be locals and their families raised a stink and the Army took cognizance of this and launched an investigation as is the norm.

The truth came out and the officer is in jail for life. The Kashmiri civilians are being tried in Civil court for Murder.

No one is here to make you happy. You assume what you have to.
There are bad apples and there's a rule of law in India. Those bad apples are dealt with & shunted out.
cannot imagine something like this happening in Pakistan. Maybe the judge will be never found. You want me to cite cases?
