* This is a controversial uninhabited island in possession of Sri Lanka.
* This island was given to Sri Lanka by India in 1974 on a conditional basis that the Indian fishermen have the rights to the rich fishing grounds in the territorial waters of Sri Lanka around Katchatheevu.
* But of recently, the frequent arrests of fishermen in Sri Lankan waters have raised the issue. Now the Tamil Nadu government has raised this as a serious issue and wants control over Katchatheevu back, on the basis that how was Katchatheevu island a part of territory of India given to Sri Lanka without any amendment passed in the parliament?
* The Tamil Nadu government has said thus the act of parting with Katchatheevu to Sri Lanka by the then Prime Minister Indira Gandhi in 1976 by a treaty which was not ratified by the Parliament becomes unconstitutional.

BS.. Under the agreement 76'.. No rights were granted to Indian fishermen to fish in Lankan territorial waters, The only rights were granted for them to dry thier nets and visit the St.Anthony's church for worship..

(a) & (b) The Government of India considers its maritime boundary with Sri Lanka settled under the Agreements concluded with Sri Lanka in 1974 and 1976. Under the Agreements, the Island of Katchatheevu lies on the Sri Lankan side of the India-Sri Lanka International Maritime Boundary Line. Both these Agreements were subsequently laid before Parliament. Under the Agreement, Indian fishermen are allowed access to Kachatheevu Island for rest, for drying of nets and for the annual St. Anthony's festival. The right of access is not understood to cover fishing rights around the island to Indian fishermen. Keeping in mind the humanitarian and livelihood dimensions for fishermen, Government reached an understanding with the Sri Lankan Government on 26th October 2008 to put in place practical arrangements to deal with bonafide Indian and Sri Lankan fishermen crossing the International Maritime Boundary Line.

Well we cannot threaten our relation with SL for a small island. SL is a very imp neighbor of India we should give them some leeway unless it will hurt our interests. They are also doing good things for us in some aspects, we should respect their territorial claims untill this controversy is resolved IMHO.

If fishing around the island is permitted as per the agreement then both the govts. should sort it out. And the dispute about handing over the island to Sri Lanka is an internal issue for us. We may take our govt. to court if its feasible. Otherwise it will be a never ending issue and will be used by local politicians to incite passions for vote and nothing else.
 
Thats where the problem is. Most of the arrest happen in and around that Island, giving away fishing rights worth thousands of years to Indian fishermens.
TN govt wasnt consulted, and moreover, till recently like 2007, Indian fishermens were still fishing out there, when SL Navy started killing Indian fishermens regularly, till it stopped in 2011. Nearly 400 fishermens lost their lives.

We cant take back the Island, but we can get a agreement on allowing fishermens in that area. Win win for all.

Katchateevu is just an excuse.. TN poachers tresspass much deeper in to Sri Lankan territorial waters.. Even up to Mannar and Trincomalee.. It will not solve the issue.. TN respecting other peoples property and territory would

I cannot have sympathy with people fishing deep into SL maritime boundary other than the Katchateevu region.
SL is free to arrest them, but international conventions do not require navy to shoot, or kill fishermens unless attacked.

That means Indian fishermen can sail to Katchatheevu island and take rest and hence they can not be arrested if they are found in the island or the waters in the vicinity. So I can fish in Indian waters and with my catch go to katchatheevu for rest and drying up the net and return to India without any hassles. It will be difficult to prove whether i caught the fish in indian or lankan water. I hope the Lankans are not arresting the fishermen from around this island but elsewhere.

He's already instructed SL's navy not to lift a finger against the thousands of poaching Indian fishermen and suspended the China port city project.

1.Its just an agreement between two friendly countries and you expect to honour us ....after your leaders threatened to fire on our fishermen....do you even know ....if that happens.....india would retake this island and occupy your northern province to teach you a lesson.

I agree, Nobody should be shot at.. But the country also has the right to defend it's sovereign territory.. Also what you must remember is these TN poachers used universally banned fishing methods like bottom trawling with is devastating to the marine life.. So they are actually criminals breaking the law of Sri Lanka.. Also as recent incidents show they come armed ready for confrontation.. So the SLN have every right to protect the countries interests

As i said before,sri lanka simply cannot do this.
It would only prove counter productive in the long term for u guys and hence its just a rhetoric like majority of such statements/declarations are.

The quandry however is whether india and sri lanka can solve this issue amicably or not?
I would say the contrasting views of sinhala and tamil nationalism will make sure we will make no progress in this endeavour in future however sane it may seem to a layman watching from the fence.
