A bench presided over by Justice G. S. Singhvi dismissed an appeal by the company challenging the interim order by the high court.
The company, which operates news channel Times Now, had approached the high court after a Pune civil court allowed a defamation suit filed by Justice Sawant.
Justice Sawant had filed the suit against the news channel for wrongly showing his photograph while telecasting a story on the provident fund scam involving judges in 2008. The Pune court had ordered Rs. 100 crore as damages.
The news channel maintained that it had already apologised to Justice Sawant and the apology was shown on the news scroll for five days after the news was telecast.
Senior counsel Harish Salve, appearing for the company, sought a stay on the high court order on the ground that it was wrong but the apex court bench was not convinced. The bench stressed that it was only an interim order and there was no reason to interfere with it.
Though the apex court refused any relief, it said that the high court would decide the matter without being influenced by the proceedings before it.
National Broadcasters Association (NBA) wanted to interfere in the matter but could not do so with the main petition being dismissed. NBA had decided to field senior counsel Gopal Subramanium in the matter.
