PM appreciates ICJ’s decision to not acquit, release Jadhav; says Pakistan will proceed as per law

Prime Minister Imran Khan on Thursday appreciated the International Court of Justice's (ICJ) decision "not to acquit, release and return" Kulbhushan Jadhav — a serving commander of the Indian Navy associated with Indian spy agency Research and Analysis Wing — a day after the court announced its verdict in the case.

In its verdict, the ICJ ruled that Jadhav be allowed consular access immediately and asked Pakistan to ensure “effective review and reconsideration of his conviction and sentences”.

In a post shared on Twitter, Prime Minister Imran said: "Appreciate ICJ’s decision not to acquit, release & return Commander Kulbhushan Jadhav to India."

Earlier, Indian Prime Minister Narendra Modi also welcomed the ICJ's verdict.

In a post shared on Twitter, Modi congratulated the ICJ for the verdict, adding: "Truth and justice have prevailed."

"I am sure Kulbhushan Jadhav will get justice," he said.

'Big victory for Pakistan'
Following the verdict, Director General of Inter-Services Public Relations (ISPR) Major General Asif Ghafoor, while speaking to ARY News on Wednesday night, congratulated the nation on "the success achieved" and lauded the efforts made by the legal team and the Foreign Office which represented Pakistan.

"For the verdict to be upheld by an international court where there is no concept of capital punishment is a big victory for Pakistan.

"And for them to say that the review and reconsideration can be done by means of our own choosing is great validation for our judicial system," he said.

"Pakistan will follow the law," he said, reiterating Foreign Minister Shah Mehmood Qureshi's statement on the way forward in the case.

"It's another Feb 27 for India; they have been surprised again. They thought that the kind of political capital they have, they can manipulate justice too but that did not happen," said Maj Gen Ghafoor.

He went on to say that India's "false narratives continue" and that "after this verdict they are practically certified to have undertaken state-sponsored terrorism and the world has seen what their role in Pakistan has been."

As the International Court of Justice (ICJ) verdict in the case of Indian spy Kulbushan Jadhav was announced on Wednesday, members of the legal fraternity as well as journalists took to Twitter to weigh in on the matter, with most viewing it as a favourable outcome for Pakistan.

Minister for Foreign Affairs Shah Mahmood Qureshi termed it a victory for Pakistan and to clear up any confusion regarding the convicted spy's custody said that he shall "remain in Pakistan" and be "treated in accordance with the laws" of the country.

"Commander Jadhav shall remain in Pakistan. He shall be treated in accordance with the laws of Pakistan. This is a victory for Pakistan," he said.

In a later comment to Dawn.com, Malik explained: "The ICJ has left the decision regarding the method and forum for the effective review and reconsideration of Jadhav’s case to Pakistan and the Pakistani legal system.

"No comments have been made which suggest that a further review or retrial through the military court system wouldn’t be acceptable as long as consular access and legal representation is provided to Jadhav.

"Therefore, Pakistan now needs to carefully consider whether the same military courts should adjudicate the matter or whether somehow an appeal should lie before the civilian courts in this case. In either case, the important aspect is to provide consular access, legal representation of the defendant’s choice and a further opportunity to Jadhav to present his defence.

"Nothing more than this can be expected by ICJ or India and whatever the outcome is of this process, it would then be Pakistan’s call to decide about its implementation."

Reema Omar, the International Legal Advisor for South Asia at the ICJ, noted that India's appeal for Jadhav's release and return was not granted by the Court.

"The Court has, however, rejected most of the remedies sought by India, including annulment of military court decision convicting Jadhav, his release and safe passage to India," she wrote.

The Court has also said that Jadhav’s death sentence should remain suspended until Pakistan effectively reviews and reconsiders the conviction/sentence in light of Pakistan’s breach of Art 36(1) i.e. denial of consular access and notification
