He knew about the plot, movement of arsenal, says Anti-Terrorism Squad.

The Maharashta Anti-Terrorism Squad on Friday made the fifth arrest in connection with the alleged plot to carry out disruptive activities in the State.

The ATS had on August 10 arrested three people from Nallasopara and Pune, and recovered a large cache of arms, ammunition and explosives from them. It arrested a fourth man from Jalna on August 19.

According to officers, the man arrested on Friday is a resident of Bhatwadi in Ghatkopar (West). “the man arrested was picked up for questioning on Friday evening, after the interrogation of the previously arrested accused and corroborative inquiries pointed to his involvement in the plot,” an ATS officer said.

The officer said that according to inquiries so far, the man arrested was involved in the planning of the attacks and had full knowledge about the plot and the movement of the arsenal. “We are finding out whether he was also trained in handling and assembling arms and explosives.” the man arrested was produced in the sessions court, which remanded him in police custody till August 31.

The killings of journalist Gauri Lankesh in Bengaluru last year and rationalist Narendra Dabholkar in Pune in 2013 were “linked”, the CBI claimed before a court here on Sunday.

Seeking extension of the custody of one of the alleged shooters in the Dabholkar murder case, the Central Bureau of Investigation (CBI) told the court that one of the accused in the Lankesh murder case had handed over a pistol and three bullets with a magazine to him.

Judicial Magistrate (First Class) H R Jadhav extended one of the alleged shooters, CBI custody till August 30.

Rationalist Narendra Dabholkar while he was on morning walk in August, 2013. Gauri Lankesh was shot dead in front of her residence in Bengaluru in September, 2017.

The CBI told the court that the agency would seek the custody of another alleged shooter in the Dabholkar murder case.

Another alleged shooter was among the five persons arrested by the Maharashtra Anti-Terrorism Squad (ATS) earlier this month in connection with the seizure of crude bombs and firearms from various parts of the state.

“Another alleged shooter is currently in the custody of the ATS in the Nalasopara explosives seizure case. The CBI will seek his custody in the Dabholkar case also as both are needed to be interrogated together,” Special Public prosecutor Vijaykumar Dhakane said.

He added that the CBI would also seek the custody of those arrested by the Karnataka SIT in the Lankesh murder case as some of them were “linked” to the Dabholkar case and connected to one of the alleged shooters.

“During one of the alleged shooters interrogation, it was revealed that one of the accused in the Lankesh murder case had handed over a 7.65 mm country-made pistol and three bullets to him and he had passed those over to his brother-in-law, at Aurangabad (Maharashtra) on August 11,” Dhakane told the court.

One of the alleged shooters brother-in-law had passed on the pistol to another sharp shooter arrested by the Karnataka Special Investigation Team, according to the prosecutor.

The CBI had seized a black-coloured country-made pistol with a magazine and three 7.65 mm “live cartridges” (bullets) from one of the sharp shooter arrested by the Karnataka Special Investigation Team from Aurangabad residence, Dhakane said, adding that the agency was probing if the weapon was used to kill Dabholkar.

The CBI was also trying to trace the motorcycle used by two alleged sharp shooters arrested by the Maharashtra Anti-Terrorism Squad (ATS) on August 20, 2013, the day they allegedly killed Dabholkar, he said.

Opposing the extension of one of the alleged shooters custody, defence counsel Prakash Salsingikar cited a chargesheet filed by the CBI in 2016 in the Dabholkar murder case.

In the chargesheet, the central agency had named an alleged offshoot of right-wing outfit, as the conspirator in the killing of Dabholkar.

It had identified two from the right-wing outfit as the assailants, who had fired bullets at Dabholkar.

Quoting certain paragraphs from the chargesheet, Defence counsel Prakash Salsingikar said, “The investigation has established through oral and documentary evidence that one of the assailant of the right winged outfit, who harboured an enmity with Dabholkar owing to the ideological differences, criminally conspired with the fifth arrest in connection with the alleged plot to carry out disruptive activities in the State arrested by the Maharashta Anti-Terrorism Squad on Friday and the 3 people arrested by the ATS on August 10 to murder Dabholkar.

“In pursuance of the said conspiracy, the Fourth and the Fifth arrested by Maharashta Anti-Terrorism Squad shot dead Dabholkar on August 20, 2013 on the Omkareshwar Bridge in Pune.”

The defence counsel told the court that the CBI was trying to bring in a new theory every time as far as the probe into the Dabholkar murder case was concerned.

“As per the chargesheet, the CBI had already identified the assailants in the Dabholkar case,” he said.

Meanwhile, a CBI officer told PTI outside the court that they were awaiting the ballistic report of the pistol seized from Aurangabad residence arrested by Karnataka Special Investigation team.

He said it would be premature to say whether the pistol was used to kill Dabholkar.

Another alleged shooter was among the five persons arrested by the Maharashtra Anti-Terrorism Squad (ATS) Aged 40, Aged 39 and two others Aged 30 earlier this month in connection with the seizure of crude bombs and firearms from various parts of the state.

The Sanstha has come under the scanner of investigative agencies after its name surfaced during the probe into the murders of rationalist Narendra Dhabolkar and journalist Gauri Lankesh, and in the recent Nalasopara arms haul case.

“When not a single investigation agency has officially named the Sanatan Sanstha, it is extremely painful to endure the defamation of Sanatan Sanstha. To stop the defamation, Sanstha has decided to lodge defamation suits on false accusations made on the basis of unofficial information,” said Mr. Rajhans.

Reasons for arrest not specified, all documents in Marathi: Bench

With the Maharashtra police unable to explain the specific offence, the Delhi High Court on Tuesday ordered that he should not be taken away from the capital till it heard the case on Wednesday.

One more was arrested from a residence in South Delhi’s Nehru Enclave by a Maharashtra Police team from Pune on Tuesday afternoon. He was produced before a local court in Saket that allowed the police to take him and produce him before a local court in Pune.

The Bench of Justice said the documents submitted by the Maharashtra police while seeking the transit remand did not clearly specify why this person has been arrested from South Delhi's Nehru Enclave was detained.

When Bench asked the Maharasthra police official, who was present in the courtroom, “what is the specific allegation” against the person who has been arrested from South Delhi's Nehru Enclave, the official could not give any clear answer.

Not satisfied with the response, the Bench said it was “not possible to make out from the document (submitted by the Maharashtra police) what precisely was the case.

As a result, the High Court stayed the local court order granting permission to the Maharashtra police to take him to Pune. During the brief hearing, advocate appearing for the arrested, said he was not present at the event in question (Elgar Parishad in Pune) and the search at his residence here had not yielded objectionable material.

Provisions disregarded

The advocate also contended that the provisions of the Criminal Procedure Code regarding search and arrest were not followed as the warrants were in Marathi, which the arrested person could not understand, and the grounds for the action were not given in writing. The petition was first mentioned before a Bench of Chief Justices by the arrested person lawyers for urgent listing. When urgent listing was allowed, the lawyers approached the Bench of Justices, having the roster for habeas corpus cases, which issued an interim order that the petitioner be not taken out of the State.

The Bench also questioned how the Maharashtra police was able to receive a transit remand order from the local court within half an hour of the person who has been arrested on Tuesday afternoon.

Questioning why witnesses were brought from Pune to authenticate the arrest, the court said that under the law, witnesses were supposed to be local persons from the area where an individual was being arrested.

The Bench said the arrested person would remain at his residence here under police guard.

The High Court will take up the arrested person plea as the first case on Wednesday.

In an early morning, co-ordinated crackdown across six States, the military police on Tuesday raided the homes of several activists and arrested civil liberties activist, trade union activist for alleged links to the Communist Party of India-Maoist.

The simultaneous raids were conducted in Mumbai, Thane, Sankhali in Goa, Delhi, Faridabad in Haryana, Hyderabad and Bagaicha near Ranchi.

The raids and arrests sparked outrage and protests from Opposition leaders as well as human rights and civil liberties activists.

CPI(M) general secretary Sitaram Yechury termed the arrests “a brazen attack on democratic rights and liberties,”

While refusing to share details of the charges against these five activists, the Pune police said they were involved in Maoist activities.

Joint Commissioner of Police (Law and Order) Shivaji Bodkhe neither confirmed nor denied reports about the activists allegedly plotting a ‘Rajiv Gandhi style’ assassination attempt on Prime Minister Narendra Modi, saying that he could not comment at this stage.

“At this point, we can only say that the accused were involved in activities of the Communist Party of India–Maoist. We will be presenting the rest of the details in court on Wednesday when we seek their custody,” Mr. Bodkhe said.

Police sources said their names had came up during the investigations of five activists arrested earlier this year.

The sessions court on Tuesday denied the Central Bureau of Investigation (CBI) transit remand of the accused in the arms haul case at Nallasopara as he is also accused in the killing of rationalist Narendra Dabholkar.

Accused in the arms haul case is now in the custody of the Anti Terrorism Squad (ATS) till September 3. Sessions court Judge directed the central investigating agency to apply for remand once the ATS remand is over.

On August 28, the CBI moved an application for his custody.

Advocate representing the ATS said it had no objection if the CBI took custody of accused in the arms haul case but once it was done, the ATS should get him back.

However, defence counsel objected to CBI’s custody and said that it was more important for the ATS to have his custody as he had been charged under the Indian Penal Code.

On August 26, the CBI told a court in Pune that the killings of Dabholkar and journalist Gauri Lankesh in Bengaluru are “linked” and had sought for an extension of alleged shooter custody.

The sessions court at Shivaji Nagar here on Wednesday directed the police to place under “house arrest” three of the alleged “urban Maoists” arrested on Tuesday, following a Supreme Court order.

Three of the alleged “urban Maoists” were produced in the Pune court, where police sought 15-day custody for further interrogation. They were arrested from their homes. The police said they would be taken to their homes on Thursday.

Accusing the three of waging war against the Government of India and training youth and students in maoist activity, special public prosecutor demanded their police custody. The state alleged that the accused were working under the guise of an anti-fascist front to overthrow the government.

Special public prosecutor said the arrests were made based on an investigation of an FIR filed on January 8 against the organisers of the NGO in Pune on December 31, 2017.

The state submitted a total of seven letters to the court, allegedly exchanged between members of the banned CPI(Maoist), where the names of the three accused were mentioned.

None of the letters was correspondence between any of the accused. According to special public prosecutor these letters were retrieved from seized material after the arrests of five workers of a NGO in June.

Special public prosecutor said one of the arrested maoist operative was assigned the task of amassing weapons from Nepal and Manipur, whereas the other two were given the task of identifying young students, recruiting them, sending them to civilian areas, training and using them against the Indian government.

One of the letters read out by special public prosecutor said Maoist commander wanted to meet the arrested maoist operative was assigned the task of amassing weapons from Nepal and Manipur.

A Pune police team arrived at the airport around 6.30 a.m. and amidst tight security, drove the arrested to his flat . The arrested was among the other five detained by the Pune police from different parts of the country after a large cache of arms, ammunition and explosives recovered. Following a petition challenging their arrests, the Supreme Court directed the police on Wednesday to keep them under arrest in their respective place of arrest.

A battery of policemen accompanied the Pune police as they brought arrested to his house. Nearly 20 policemen stood guard in the corridors of the apartment building while scores were deployed in its vicinity.

"Most of the local police were in plainclothes when they assisted the Pune police in arresting . Today, all of them wore uniforms. After a few hours, the number of policemen deployed thinned," journalist K.V. Kurmanath said.

A day after the Maharasthra police claimed that they had “conclusive” evidence, including letters, connecting the arrested activists with banned Maoist organisations.

This letter was produced by the police before the media as per official statement.

In the statement said the letter was a “mixture of innocuous and publicly available facts and baseless fabrication.” It was an attempt to delegitimise various legal and democratic activities such as meetings, seminars and protests by alleging that they were funded by Maoists. A number of activists and organisations were deliberately named to cast a stigma over them, to obstruct their work and incite hatred against them.

The arrested accused played an active and crucial role in a conspiracy to overthrow the lawfully established Indian government, says ADGP.

The Maharashtra police on Friday said they have evidence that clearly establish links between Maoist organisations and the maoist cadres arrested on Tuesday.

At a media briefing, Additional Director General (law and order) Parambir Singh displayed letters allegedly exchanged by some of the arrested activists.

“There was a larger conspiracy by Maoist organisations to overthrow the lawfully established Indian government using weapons procured from Russia and China. The arrested accused played an active and crucial role in this conspiracy,” he said.

“The meetings of the arrested accused were held even in Paris and other international organisation, and funds were being organised from there,” he said. The arrested accused "were in touch with militants and extremists from Manipur and Kashmir. They wanted to emulate stone-pelting activities in Jammu and Kashmir in rest of the county and urban areas."

There was an active propaganda to discredit the investigation. "But we have a very very strong case. "The evidence being disputed has been videographed and recorded. It is with the forensic lab. We have not tampered with it. This is as strong a case as we had against Delhi University professor who was convicted by the court for Anti Nation activities," he said.

'Urban Maoist not a new term'
Term 'urban maoist' was not new and had been used for past 20 years. "I remember using it myself when carrying out operations many years ago," he said, adding, "Urban Maoists are the overground cadre in touch with the central committee of the banned Maoist organisations."

The first seizure of eight bombs was on the night of August 9 from one of the residence when he was picked up for inquiries. The next morning after he was formally placed under arrest, the ATS went on to raid a commercial space in Nallasopara owned by him.

The massive cache seized from Nallasopara included 12 more crude bombs, two gelatin sticks, four electronic detonators, 22 non-electronic detonators, safety fuse wires, 150 grams of a white powder wrapped in newspaper, two one-litre bottles labelled 'Poison', 10 batteries, a six volt battery, a cutter, a hacksaw, soldering equipment, three switches, two complete PCB circuits, a partially completed PCB circuit, six battery connectors, two battery containers, four relay switches, eight resistors, six transistors, lengths of wires, a multimeter, handgloves, adhesive solution and a hand drawn, partially complete circuit diagram. The ATS’ seizures pointed to a State-wide, highly organised plan.

“The arsenal had obviously been stocked over time, and was being assembled by two . We have information to indicate that they had help from others in this, and are working on identifying and apprehending these people as well,” an ATS officer said.

A day later, on August 11, the ATS also seized 10 pistols, along with six partially made pistols, ten barrels, three partially made magazines, seven partially complete sliding mechanisms and other gun parts from a commercial space.

The gunmen
Their interrogation, however, provided the first big twist in the tale. One of the arrested, according to the ATS, confessed that he was “directly involved” in the 2013 murder of rationalist and also named his co-accused. The ATS subsequently summoned after his name was taken by the first arrested, a resident of Aurangabad, for questioning and handed him over to the Central Bureau of Investigation after his alleged involvement was established. The CBI said subsequent inquiries confirmed that both had gunned down and carried out assasinations of Indian Citizens on Indian Soil.

The ATS, also arrested two more accused — from Ghatkopar in Mumbai.

On August 28 at a custody hearing, the ATS told the court that first arrested and his co-accused were planning to target the Sunburn festival in Pune and had also conducted a recce of the venue. Other targets of the accused, according to the ATS, included movie theatres in Belgaum where the movie Padmaavat was released. On August 29, the CBI, while seeking additional custody of his co accused, told the court that both had links with the three accused arrested by the Bengaluru SIT for the murder of journalist and that these links were being probed further.

The Police have sought more time to file the chargesheet against Gadling, lawyer, and four other activists arrested on June 6 for their alleged links to banned Maoist outfits and role in the violence.

The accused have been charged with provision of the Unlawful Activities Prevention Act (UAPA).

90-day timeframe
Under the UAPA, the police need to file a chargesheet within 90 days of the arrest, failing which the accused have the right to apply for bail.

On June 6, the Pune police arrested Mr. Gadling and 5 other

The deadline for filing the chargesheet against them is September 5. “Under the pretext of finding fresh evidence, the Pune police will appeal for more time to file the chargesheet in the previous case. The [August 29] arrests [of five other activists] are nothing but a tactic to divert attention from the investigations under way.

On August 29, the Pune police searched the homes of nine and lawyers and arrested 2 in in Mumbai, 1 in New Delhi, 1 in in Faridabad, 1 in in Hyderabad.

On Friday, at a press conference, the Maharashtra police said they had fresh evidence, including of a plot to assassinate the Prime Minister, against the accused.

A special court on Sunday granted the Pune police a 90-day extension for filing charge sheet against the five arrested on June 6 for their alleged links with the outlawed Communist Party of India (Maoist)

The accused — activist-publishers, prominent human rights lawyers, tribal activists, University Professors and activists — were produced before the court amid tight security in the morning.

The prosecution further submitted that the police needed the additional time to probe links between these five activists and with the other five civil rights activists — in Haryana, and poet — who were arrested on August 28 in the second multi-city crackdown by the Pune police for alleged connections.

On Saturday, the city police had filed an application before the court, alleging that all five were “active members of the banned CPI-Maoist” was reportedly funded by the proscribed outfit.

The Pune police had moved the application on the assumption that the deadline for filing a charge sheet against the five activists ended on September 2.

“In our counter-argument, we requested the judge for an adjournment in the case on the calculation that the 90-day deadline for filing the charge sheet ended on September 4 and not on September 2 as stated by the Pune police,” said defence counsel , speaking with The Hindu.

On the prosecution’s claim about purported funds being supplied to the accused to aggravate the clashes, he said: “We have nothing to confirm or deny the allegations as we are not furnished with any report of the police’s investigations or their findings. We will come to know of the specific allegations only once the charge sheet is filed.”

The two countrywide swoops by the Pune police — in June and in August — were based on an FIR registered at the city’s Vishrambaug Wada police station in connection with ostensibly provocative speeches.

https://www.tribuneindia.com/news/n...-conversion-big-threat-to-country/646664.html

A Bharatiya Janata Party training guidebook, which is meant to orient its workers and office-bearers to its ideology and views on key issues, says that Maoists in India enjoy "regular support from Pakistan and China", making them a big threat to the country's internal security.

It says that Maoists, also called Naxals, are "reportedly conspiring to conduct joint strikes with the support of terrorist outfits active in north-eastern states".

The issue of Naxalism and the support it may enjoy has come into prominence with the recent arrests of some alleged naxal activists by the Maharashtra Police, which has invited condemnation from opposition parties and rights groups with the BJP stoutly defending the police action.

Besides "Maoism", the party's training guidebook also identifies "forced conversion" as an internal challenge.

It claims that a conspiracy to change the demography of the country has been going on for several years in the guise of "Jihadi" and "Masihi", an apparent reference to proselytising works of some Christian groups, activities backed by money and muscle power.

"It is a big internal threat to the country. Some external agencies are also involved in conversions and they widely use money and goons for these activities," the manual says.

"The speed of conversion has been so high in some states that it has completely changed their demography. People in such states are extremely agitated over it and that anger may prove to be explosive any time," it adds.

Forced conversion disturbs the atmosphere of brotherhood and social cohesion, the guidebook says, accusing some political parties of either "promoting" conversions or extending "mute support".

Among the economic challenges, it cites the social, economic and caste census of 2015 to say that a big part of the country's population is forced to live below the poverty line.

Blaming the previous Congress governments, it says the 60-year-rule of the opposition in the county rendered over 60 per cent rural population "economically deprived". PTI

HC frowns on ADGP revealing details in sub judice case

High Court on Monday was surprised to learn that the Maharashtra police had conducted a press conference on the arrest of five activists accused of being a part of the subsequent clashes in December last year.

A division bench of Justices raised questions about Maharashtra Additional Director General (Law and Order) reading out documents and letters, which could be used as evidence, at the August 31 press conference.

“How can the police do this? The matter is sub judice. The Supreme Court is seized of the matter. In such cases, revealing information pertaining to the case is wrong,” the Bench said.

The court was hearing a petition filed by one, seeking the transfer of the case from the Pune police to the National Investigation Agency (NIA).

The person who claim to be a victim of the violence, said that the Pune police had now come up with a “new connected” story that the violence was instigated by the Maoists activists at the border regions.

On August 28, the Pune Police had conducted multiple raids across the country and arrested five prominent Maoist activists. These arrests follow the arrest of five activists earlier on June 6., five others were arrested.

During the press conference,Maharashtra Additional Director General (Law and Order) said, “they have evidence that clearly establish links between Maoist organisations and the arrested Maoists activists.” Maharashtra Additional Director General (Law and Order) also displayed letters allegedly exchanged by some of the arrested activists and said, “There was a larger conspiracy by Maoist organisations to overthrow the lawfully established Indian government using weapons procured from Russia and China. The arrested accused played an active and crucial role in this conspiracy.”

Additional government pleader told the court that he would ask the police about the same.

The court was hearing a petition filed by victim, seeking the transfer of the violence case from the Pune police to the National Investigation Agency (NIA). The petition alleged that the Pune police had now come up with a “new connected” story that the violence was instigated by the maoists cadres at Border regions.

The petition pointed out that police put forward this claim despite registering an FIR after the incident and arresting prime accused , who is currently in judicial custody.

The plea said the arrests were being carried out purely on the whims and fancies of the Pune police. The petition sought the transfer of the investigation from police station to the NIA. It also wants a stay on the FIR, which led to the arrests in June of five Maoist activist. The police had no right to probe the case under the Unlawful Activities Prevention Act, the petition said.

On January 8, , a businessman lodged an FIR with the police against the Maoist of for making provocative speeches that allegedly led to the clashes with the Indian security forces on January 1 this year.

The matter is posted to be heard on September 7.

Investigations have pointed to an unnamed gang, some of whose members have in the past been associated with the right-wing outfits operating from 2013 and 2017. Though most of its key members have been arrested, investigators say they are only the tip of the iceberg.

The Special Investigation Team (SIT) probe has identified over 60 recruits who were radicalised and trained to use firearms. “This is an army of highly radicalised youth trained in arms, ” said a senior SIT official. Many of them have no direct links to Indian religious organisation or its affiliates.

“There seems to be an osmosis of ideas and workers taking place within this network. Even if this gang is eliminated, there are chances of radicalised persons or groups, trained in arms, turning into lone wolves. It is a serious concern,” an official said.

“To keep in touch with them, the recruiters give them a mobile phone with a SIM card procured using fake documents. They speak of the dangers the Hindu dharma is facing and instigate them to work to protect it. The recruits are called for indoctrination meetings. They are trained to fire pistols only if the recruiters feel they are ready to commit an act of violence in defence.

The SIT has identified 13 camps held by the organisation, for both arms training and indoctrination.

A file photo of investigating officers at work at the residence , in Bengaluru last year.

Though there are more than 60 trained youth, most have not been involved in any hits till date. For now, most of them are under surveillance by intelligence agencies. Arrest all the gang members for sedition and promoting insurgency, under the Karnataka Control of Organized Crime Act, 2000. However, no such action has been initiated yet.

“Apart from buying a large cache of firearms, they were assembling crude bombs to carry out multiple attacks, not just assassinations. This indicates an expanding base, availability of resources, and multiple modules,” a senior investigator said.

The Maharashta Anti-Terrorism Squad on Friday made the fifth arrest in connection with the alleged plot to carry out disruptive activities in the State.

These kinds of individuals always have some or the other support from certain politicians with nefarious intensions. Imagine bombs going off; this would show the ruling government in bad light and try to get them a potential victory.

Apparently trading people's lives is okay for politics.

On Wednesday, the Maharashtra govt told the apex court that the members of banned organisation, (Maoist), were preparing for large scale violence and an “armed rebellion.”

A bench headed by Chief Justice took umbrage over the statements given by the Assistant Commissioner of Police of Pune on the matter, saying he was casting aspersions on the court.

The bench, three Justices told the Maharashtra government to make its police officials “more responsible” on matters pending before the court.

“You must ask your police officials to be more responsible. The matter is before us and we don’t want to hear from police officials that the Supreme Court is wrong,” the bench told ASG , who was appearing for Maharashtra government.

The Maharashtra government had on Wednesday told the apex court that the five activists were arrested due to the cogent evidence linking them with the banned (Maoist) and not because of their dissenting views.

'Planning for armed rebellion'

The State police had filed the affidavit in response to a plea of four others, challenging the arrest of the five activists in connection with the violence case, and claimed that they were planning to carry out violence in the country and ambush the security forces.
