Malegoan accused are back under tough Anti Terror Legislation. While they've been ro**ing in jail for all these years, what this means is that procedurally, the HC has made terms on confinement even more stringent after the relief that was given by the district court. I can see col purohit & gang being cooked into a nice little stew by the courts for the role they played in the malegaon blasts. Gentlemen, this is how it should be done.

Bombay High Court on Monday restored the application of the stringent Maharashtra [ Images ] Control of Organised Crime Act in the 2008 Malegaon blast case against Sadhvi Pragya [ Images ] Singh and other accused.

The court ruling came following a state government appeal against the sessions court decision to set aside MCOCA against the Sadhvi and others.

The sessions court had dropped the charges in this case in August 2009 while hearing the bail plea of Lt Col S P Purohit, one of the accused, who had challenged invoking this stringent act. Designated Judge Y D Shinde, presiding over the special MCOCA court in Malegaon, had observed that none of the accused were part of the organised crime syndicate.

He also observed that none of the accused had more than one charge sheet filed against him or her -- a prerequisite for invoking provisions of MCOCA.

Arguing for the accused in the high court, Mahesh Jethmalani accused the state police of "arbitrarily" applying MCOCA.

Jethmalani said while the accused in the Malegaon blast case were subjected to MCOCA, Pakistani terrorist Ajmal Kasab [ Images ], convicted to death for 26/11 attack, was not booked under the act.

The blast in Malegoan on September 29, 2008, claimed lives of eight persons. Eleven accused are facing the trial for conspiring to carry out the blast.
