KARACHI: The ongoing local government set-up would cease to function from October 16 as per law, Provincial Local Government Commission (PLGC) member Public-I and member provincial assembly Haji Munawwar Ali Abbasi told Daily Times. In accordance with the provision of the constitution, the sixth schedule of the 17th Amendment, which was introduced by General (retd) Pervez Musharraf, has caused the provincial and federal governments to refrain from introducing any amendment, alteration, or improvement in local bodies set-up either for the present or the future need, he said. The sixth schedule is quite clear on the status of local bodies after Oct 16 because it simply empowers President Asif Ali Zardari alone to decide about the future of local bodies until Dec31, said Abbasi. The deadline for the present local bodies is Oct 16 and the government would announce the appointment of administrators as the caretakers of the local bodies in lieu of city or district nazims through issuance of a notification, he claimed.
It is not sure whether the notification would be issued on the same day or before Oct 16. However, it is likely that the notification would be issued earlier than the legal cessation of the functioning of the to keep the local, district and taluka governments working until announcement of schedule for new elections, the MPA said.
The present local bodies could be awarded with a grace period of two months to continue as it is but as far as the constitution is concerned, there is no such provision to allow such extension except that the administrators take charge of local bodies until next elections. However, it is not yet clear whether elections would be held or not, remarked Abbasi. According to an expert on the local government system, there is no provision for the administrator in the Sindh Local Government Ordinance (SLGO)-2001. The SLGO reads that the present nazim would continue to function until the next elections were held. The previous nazim would cease to function after the new elected nazim takes charge of the local government from him. Thus the removal of former city nazim Niamatullah Khan was legally flawed. The SLGO-2001 is packed with numerous flaws and in fact the present local governments could continue functioning until next 50 years if elections were avoided, claimed the expert.
