CHENNAI: A Sydney Sheldon-esque thriller case involving a rich, parentless hearing- and speech-impaired man, had a fairytale ending with the Madras high court becoming a 'parent' to him.
Justice P N Prakash invoked the doctrine of loco parentis, keeping in mind the threat to the life of Manoj Rajan, attempt to kidnap him and push him into a 'sham marriage', besides the safety of his vast estates.
The Latin term loco parentis stands for 'in the place of a parent'. It refers to the legal responsibility of a person or organisation to take on some of the functions and responsibilities of a parent.
The court has now stepped into the shoes of the disabled man's deceased parents, and issued a string of directives aimed at his welfare.
"In the facts and circumstances of the case, this court assumes the role of loco parentis for Manoj Rajan and his properties," the order read.
Born on Independence Day in 1979 with congenital speech and hearing impairment besides mental retardation, Manoj lost his mother when he was 14.
His father put him in a special school, and when he turned 29 a marriage was arranged with one Priya Darshini. She divorced him on the ground of mental retardation, but tried to take his custody after his father died in 2013.
When it did not succeed, she abducted him from the special home and 'married' him before a pastor in Chennai. The same day, a property in his name was 'sold' for Rs 1.6 crore.
An inquiry by Justice Prakash revealed failures and collusion at every level -- first, the Gudalur police did not register an abduction case, but merely gave an acknowledgement; a pastor violated all norms and 'solemnised' a 'wedding'; and a subregistrar allowed sale of property flouting rules.
Conceding it was an outof-the-box solution to the complex case, the judge entrusted the abduction case to the CBCID in Chennai.
The court also ensured safety of all properties belonging to Manoj, including the one that was illegally sold. He was later shifted to a home near Madurai and Madurai police was directed to provide adequate security to him.
