Barrister Saad Rasool`s Legal Opinion about Foreign Fund Case Against PTI

I would disagree with Saad Rasool and the others here as well...they are missing the main point.

The Elections Act 2017 says in section 204:

"Any contribution or donation made, directly or indirectly, by any foreign source including any foreign government, multi-national or public or private company, firm, trade or professional association or individual shall be prohibited"


Meanwhile, the Political Parties Order 2002 says in section 6:

"(3) Any contribution made, directly or indirectly, by any foreign government, multinational or domestically incorporated public or private company, firm, trade or professional association shall be prohibited and the parties may accept contributions and donations only from individuals."


Carefully look at the bold part. Under the PPO 2002 (this is the law which applies to the donations in question), getting donations from a single ownership private company incorporated abroad and functioning only in that country isn't prohibited. The word used is 'multi-national'.

This law changed in 2017 to include every company incorproated in or out of Pakistan.

I can see the logic in the 2002 law, that if a company is in the US, then even if it funds a political party in Pakistan, the govt cannot give it any favors...but then I see the logic of why this was changed in 2017 too...maybe the same company wants to expand to Pakistan.

In short, getting funds from a US or UK registered company is not illegal according to PPO 2002, it was made illegal in 2017.
