afghans have not recognised durand line. so these people might actually be living in their own territory which pakistan mistakenly believes as its own . things can only be settled after afghan and pak govt legally formalise the boundry line.

there is no entity as non state actors. any attack in india by a pakistani will be treated as an act of war by the state. pak should be prepared for repercussions and heavy retaliation should there be any attack on indian side ever in future.
