What happens when the TPP kicks in?

Nothing will happen because TPP is already dead..

It was fun hearing Niceguy mumbling TPP for a while but other people need to get a clue why the US was so hastily to push TPP forward.

I’m guessing you couldn’t see the youtube clip that was embedded. Its a short clip of a PhD saying exactly what NiceGuy once said.

TPP has one big problem Vietnam will never accept, well according to my limited understanding.

The dispute between governments and companies will be judged by a body newly created outside national boundary.

You may ask any Thai who know history, and they will say how this resemble to 100 years ago English ambassedor John Bowling requirement. The justice of English subjects shall be under British Court system even when such English subjects are on Siam soil.

As far as I know, most countries, VN has already finished negotiating. The whole TPP negotiation is almost finish. The remaining disagreements between US-JP-Canada has nothing to do with what youve said (dispute resolution mechanism).

What you’ve said about Britain imposing its system onto its subject centuries ago is not the same as the TPP at all. Your example is a one sided affair...British law has jurisdiction over its subjects. While in the TPP, no single country has jurisdiction over any other country. It is the TPP agreement and regulation, that has jurisdiction over all the member countries on the same term. No country has any advantaged over other member countries. The difference is that MNCs (or any company operating in a member state) will have more power/rights because they are under the jurisdiction of the TPP regulation. But all TPP countries will be under this same jurisdiction and has to give the same rights to the MNCs. So this is not the same as your example at all, where one country (Britain) has supreme jurisdiction over its subject. The TPP regulation will have supreme jurisdiction, no single member state will have this supreme jurisdiction. It seems like you Thai don’t understand the TPP then. It is basically an extreme form of free maket where all member states will have less power, including the US and Japan, while MNCs will have more power and rights under TPP jurisdiction. It is then a debate on free market vs state interventionism, which is better or how do you balance it, that’s a different topic.

And finally, no one on this forum has realized this, but Viet Nam has one trick under our sleeve if things get out of hand (like if MNCs becomes too aggressive). Its only Viet Nam that can play this trick, other TPP will not be able to play this card. And if we do decide to play this card, we will have the support of the EU, and possibly even some entities inside the US might also support it. I’ll give you a hint: HC.

Posting a sound bite without any proper context hardly justifies your assumptions or her POV. But for the sake of argument, lets just accept her argument. She seems to be acutely unaware of Malaysian domestic race based politics, the current UMNO government is pushing hard to keep "Bumiputra" special privileges intact and have an open economic policy, and what is Malaysian Malay elite most scared of? Its a level playing field where no one is treated better just based on their race. Najib is under severe pressure because of massive corruption scandals and chronic economic mismanagement during his tenure, and he is turning to time and tested "Race cards". TPP in its current form might not be acceptable to the government here, as it needs to appear as defender of Malay rights.
Vietnam needs to be realistic, whole the nationalistic jingoism aside, it might take few decades for Vietnam to reach even close to where China is today.
Furthermore, the secretive nature of TPP is cementing all the doubts around the whole agreement. TPP will only be good for American multinationals and best for Big Pharmas, for a common man not much would change.



Yes open markets for Americans and few others, but as for the rest they will be turned into the sweat shop of those countries.

The context was the question of what her view is if TPP kicks in? what are the impact for other ASEAN countries?...and in other clips, what is her views on AEC if TPP kicks in? (she basically said AEC will not be useful much if TPP kicks in and it may disrupt the community because VN and Malaysia will have more advantage).

Its not about being messenger, its about what you posted and assumed based on her sound bite. One thing more being a Ph.D does not make one expert, unfortunately or unbiased. She seems to be unaware of South Asian realities.

And what did I assume? I just reposted her comments. The only thing I’ve claimed, as a joke, is that she is the mentor of NiceGuy and that his view was right on with this PhD.

And what you’ve said about bumiputra does not discredit her views. Her not commenting about it does not mean that she is not aware of what is going on in Malaysia. It is pretty absurd for you to think she would be ignorant about it when she is a PhD, working in an economic advisory role next door in Singapore.

Her saying that VN will have much more advantage than Malaysia should have given you a clue (e.g. it is not in terms of infrastructure, workforce, etc. that VN has over Malaysia).

So without any substantial arguments, you have made insinuation that she is biased and has no credential (when she has a PhD lol). This sounds like...

What you’ve said about Britain imposing its system onto its subject centuries ago is not the same as the TPP at all. Your example is a one sided affair...British law has jurisdiction over its subjects. While in the TPP, no single country has jurisdiction over any other country. It is the TPP agreement and regulation, that has jurisdiction over all the member countries on the same term. No country has any advantaged over other member countries. The difference is that MNCs (or any company operating in a member state) will have more power/rights because they are under the jurisdiction of the TPP regulation. But all TPP countries will be under this same jurisdiction and has to give the same rights to the MNCs. So this is not the same as your example at all, where one country (Britain) has supreme jurisdiction over its subject. The TPP regulation will have supreme jurisdiction, no single member state will have this supreme jurisdiction. It seems like you Thai don’t understand the TPP then. It is basically an extreme form of free maket where all member states will have less power, including the US and Japan, while MNCs will have more power and rights under TPP jurisdiction. It is then a debate on free market vs state interventionism, which is better or how do you balance it, that’s a different topic.

The context was the question of what her view is if TPP kicks in? what are the impact for other ASEAN countries?...and in other clips, what is her views on AEC if TPP kicks in? (she basically said AEC will not be useful much if TPP kicks in and it may disrupt the community because VN and Malaysia will have more advantage).


1. About Britain and current TPP. I agree and fully aware of what you said. Theoretically it is a fair. In reality, there are one side call MNC and the other side call the state. Because VN nearly does not have MNC, they are not fair. Do you see the game? Its like saying "Every Ocean Faring Ship company can sue any ASEAN government" to Lao, and then yeah. Its fair for every ocean going faring ship nations, but Lao has none. You understand my meaning? If the law provided is on favour of MNC to the government, then VN has no MNC company to take adventage of.
Another point is that the "international settlement body" Is it going to be real fair judge?

2. I don't know who HC is. Perhaps you can tell me somehow. Its to vast to find. If VN fate is to hang with one woman, then something weak is happening. What I read from Niceguy is that VN could pull back and void the TPP if things go out of hands. Do you know that such action would destroy TPP credibility and VN credibility than not joining?

PS. Thailand does not take a stance against TPP. It just concerns of these rules. Perhaps you would know that by being asked to negotiate on itself is an ongoing negotiation.

I afraid that TPP is more about geopolitic instead of trade.
Strong and rich countries benefits the most. While poor countries will always be (modern) slave. (of cource they wouldn't use this word because it is not nice).
What they need to do is support those politicians in poor countries indirectly (whether it is one party state or Democratic countries). Educate the people in control manner while controlling everything behind the scene.
On the other hand, also help those local to setup some NGOs to fight for human right, freedom of speech and enviro. This will keep those poor people busy with no direction.
Final point is it all depend on those poorer countries whether their politician and the people intelligence enough to play the game well.
I do believe the TPP structure will like this

What you’ve said about Britain imposing its system onto its subject centuries ago is not the same as the TPP at all. Your example is a one sided affair...British law has jurisdiction over its subjects. While in the TPP, no single country has jurisdiction over any other country. It is the TPP agreement and regulation, that has jurisdiction over all the member countries on the same term. No country has any advantaged over other member countries. The difference is that MNCs (or any company operating in a member state) will have more power/rights because they are under the jurisdiction of the TPP regulation. But all TPP countries will be under this same jurisdiction and has to give the same rights to the MNCs. So this is not the same as your example at all, where one country (Britain) has supreme jurisdiction over its subject. The TPP regulation will have supreme jurisdiction, no single member state will have this supreme jurisdiction. It seems like you Thai don’t understand the TPP then. It is basically an extreme form of free maket where all member states will have less power, including the US and Japan, while MNCs will have more power and rights under TPP jurisdiction. It is then a debate on free market vs state interventionism, which is better or how do you balance it, that’s a different topic.

You are free to believe it‘s all fair. But the rule was stated that the disputes will be brought up to a special court set up in the US,which means some government policies will be challenged,ruled and even dictated on foreign soil,can’t imagine any country with self respect can accept that.

I don't think Thailand's situation and perception is applicable since Thailand is not part of the TPP negotiation party. It was never included nor seriously considered.

Correct, everyone can feel the heat from incoming currency war when CNY fall. We should escape from that crazy war ASAP by joining TPP which excluded CN from the deal .
