Supreme Court issues contempt notice to Imran Khan

ISLAMABAD: Pakistan’s top court on Wednesday issued a contempt of court notice to cricket legend-turned-politician Imran Khan over his “critical and derogatory” remarks against the judiciary and summoned him to appear before the court on August 2, DawnNews reported.

The Supreme Court, in the notice issued to the Pakistan Tehrik-i-Insaf (PTI) chief, has said that Mr Khan apparently had tried to incite hatred against the apex court in one of his interactions with the media.

A three-judge bench of the Supreme Court, headed by Chief Justice Iftikhar Muhammad Chaudhry, will hear the case on Friday.

“Prima facie, it seems that he (Imran Khan) has started a deliberate campaign to scandalize the Court and bring judges into hatred, ridicule or contempt. Thus, his above acts call for action for contempt of court under Article 204 of the Constitution read with section 3 of the Contempt of Court Ordinance, 2003. Therefore, Notice be issued to him to appear on 2.8.2013 and explain as to why proceedings as envisaged by above provisions of the Constitution and law be not initiated against him. Notice be also issued to the learned Attorney General for Pakistan,” said the notice.

On July 26, while speaking with media representatives outside the Parliament House in Islamabad, Khan had said that his party had taken an active part in the movement to restore deposed judges of the higher judiciary during former military ruler Gen (retd) Pervez Musharraf’s regime.

However, he alleged that the May 11 polls were badly rigged despite being supervised by the judiciary and the Election Commission.

Pakistan’s Attorney General Munir A. Malik has also been summoned to appear before the bench with related records on Friday.


Meanwhile, PTI’s senior leader Shafqat Mehmood has said the party will not seek a pardon and defend their case lawfully.

The court has ordered Khan to make a personal appearance on August 2, 2013 which is within two days. The Supreme Court, in the notice issued to PTI chief has said that Mr Khan apparently tried to incite hatred against the apex court in one of his interactions with the media. The case will be heard by a three-member bench headed by Chief Justice Iftikhar Muhammad Chaudhary.
It may be pointed out that there is a growing perception that the court is working hands-in-glove with the ruling party. Even Barrister Aitzaz Ahsan, leader of the Lawyers’ Movement which paved way for restoration of the present chief judge through street power also accused the court of in cahoots with Sharif party. The major bone of contention was court’s unilateral decision to advance the date of presidential polls as per the wishes of the ruling party and without hearing other parties. Only yesterday, the Lahore High Court Bar Association demanded that the president send a case to Supreme Judicial Council to sack the chief judge and two other judges for violating the constitution by arbitrarily taking a decision to suit one political party.
Chief Justice Chaudhary was sacked by president Musharraf in March 2007 for judicial misconduct. The charges included favoring his son and landing him in cushy jobs in violation of all rules and regulations and principles of merit. His son again resurfaced again when a real estate tycoon leveled charges against his son for receiving graft amount to Rs 340 million ($3.4 million). That case was hushed up through brother judges but has dented the credibility of Justice Chaudhary.
The recent notice of contempt has angered the followers and admirers of Khan who dominate the Social Media. Khan himself has indicated that he would not tender an apology and would contest the notice.
