Australia has found fault with Gallage for being in command of the 59 Division from May 7, 2009 to July 20, 2009. In response to inquiries made by Gallage, the Australian High Commission has stated that troops under his command certainly committed war crimes and crimes against humanity.

Currently this alleged war criminal Maj. Gen. Gallege is the Director General, Infantry.

Governments change in the Sinhala countery but war criminal hold reign.

So what is your view. Was this a correct decision by Australia or not? Were war crimes committed by this general or not?

So what? People can say what ever they like. BTW. Where are the evidence for war crimes. I guess SL Army used gas chambers like the Nazis.

Sri lanka basically genocided the tamils , attacked UN safe zones killing children, women.

There are decent documentries done during the civil war .

It was being written by the Sri Lankan forces tacitly supported by India and openly assisted by China and Pakistan.

you must be damn naïve to believe India aided Tamils - it just used Tamils to fight its proxy war in Lanka as Lanka was getting too big for its boots.

In the months preceding the Indo-Pakistan war of 1971, which facilitated the birth of Bangladesh, Indira Gandhi, in retaliation for the hijacking of an Indian Airlines plane to Lahore by two Pakistan-instigated terrorists from J&K, banned all Pakistani flights to the then East Pakistan over Indian territory. Sri Lanka went to the help of Pakistan by allowing Pakistan Air Force planes carrying troops and equipment to East Pakistan to refuel at the Katunayake airport. A furious Indira Gandhi warned the Sri Lankan Government that she considered this an unfriendly act and threatened to retaliate against Sri Lanka. It was only after this that Sri Lanka stopped the refueling of the PAF planes.

After the Indian nuclear test of 1974, India was concerned over a reported move of the US to set up a huge set-up of the Voice of America in Sri Lankan territory. Indian intelligence had told her that the US intelligence agency, which is responsible for technical intelligence, would have a presence in the VOA set-up to collect intelligence about India’s nuclear and space establishments in Tamil Nadu and Kerala.

When the Sri Lankan Government repeatedly ignored Indian concerns on this subject, Indira Gandhi decided to teach it a lesson by extending political, moral and diplomatic support to the Sri Lankan Tamils.

India never wanted the Tamil minority to gain independence or even get substantial devolution within a federal Sri Lanka. The 1987 India-Sri Lanka Peace Accord is a testament to it [see Section 4 of Reference 1 for a more detailed discussion].

Former Defence Secretary Gotabaya Rajapaksa said China, Pakistan, Ukraine, Russia and Israel were the countries that supplied military equipment in the fight against terrorism at that time whereas India helped immensely in the provision of training for the security forces. -

There was no proof to suggest that Sri Lanka genocides Tamils en mass. The only allegations stemming from the testimonies of the Tamil people who were in no position to apprehend the situation. The rest are of baseless propaganda material purported by the media organizations like Channel 4 to justify the human rights accusations against Sri Lanka.

SRI LANKA secured a timely victory in the European Parliament when a motion to deny the country of the benefit of the GSP Plus tariff concession was defeated by a large majority of 436 to 119. There were doubts about the outcome of the vote as a visiting EU delegation last month issued a critical report on the country situation. The delegation had focused on economic and labour issues and found there were many deficiencies in the law and in its implementation on the ground. They reported that they had found a number of workers who have been objects of labour rights violations, including harassment to trade unions, illegal dismissal of trade union leaders, sexual harassment and labour rights violations within the free trade zones. The report has also touched on shortcomings on the enforcement on other human rights issues, in particular the use of torture and the rights of ethnic, religious and sexual minorities.

Due to its victory in the international arena, the government was able to go into its May Day event with a greater confidence and ability to show its strength. It will be able to argue that the economic situation is improving even if the visible signs of development are yet to manifest themselves. The loss of the GSP Plus concession in 2011, due to the previous government’s inability and refusal to meet the EU’s human rights requirements struck a significant blow to the economy.

It is reported that the EU will impose conditions on the grant of GSP Plus even as it awards the tariff concession once again to Sri Lanka. The conditions imposed by the EU reportedly include reducing the number of deviations from the International Covenant on Civil and Political Rights (ICCPR); repealing those sections of the Prevention of Terrorism Act, the Public Security Ordinance which are incompatible with it or amending them so that they become compatible with the international covenant; and amending the Code of Criminal Procedure providing for the right of a suspect to see a lawyer immediately following arrest; publishing or making available to family members of a list of former LTTE combatants currently held in detention as well as all other persons detained under Emergency Regulations; and granting of access to all places of detention for monitoring purposes to an independent humanitarian organisation, such as the International Committee of the Red Cross.

As in the case of the resolution of the UN Human Rights Council for which the government got an additional two years of implementation time, the implementation of the government’s pledges to regain the GSP Plus concession has been slow. Even changing laws has become difficult for the government. One of the key requirements for regaining the EU tariff concession is to replace or amend the Prevention of Terrorism Act with an alternative national security law which gives improved protection for human rights.
The proposed Counter Terrorism Act which is the alternative to the PTA has been on the drawing board for about a year but is still far from being finalized for ratification by Parliament. An early version of the draft law was widely criticized by human rights organizations for being even more restrictive of civil liberties and human rights in some aspects than the PTA.
