NEW DELHI: In a landmark verdict, the Supreme Court on Tuesday ruled that caste should not be the sole basis to decide backwardness of a community and quashed the Centre's decision to grant OBC reservation to Jat community.
The SC said that caste, though a prominent factor, can't be the sole factor to decide backwardness.
"Possible wrong inclusion of a caste in the OBC list in the past cannot be the basis of further wrong inclusions," the SC bench observed.
"We hold that a politically organised class like Jat community cannot be given reservation," the SC said.
The SC asked why communities are being increasingly included in the OBC list but they are not being removed from the category with passage of time.
The apex court also asked the Centre to consider new and emerging form of backwardness to decide the OBC list and referred the case of transgender which must be given benefits of OBC reservation.
The Jat reservation was introduced by the UPA government in March 2014.

The Narendra Modi government had supported UPA regime's decision to include the Jat community in the central OBC list for providing reservation and refuted the allegation in the Supreme Court that it was done to gain political mileage in the general elections.
In an affidavit filed in the apex court, the NDA government contended that Centre had acted bonafide and in public interest after considering the ground realities.
"As regards averments that the central government with a motive to gain benefit for the ruling parties in the forthcoming general election issued the said notification, this fact is denied as unfounded. It is respectfully submitted that the central government has acted bonafide and in public interest," the 28-page affidavit said.
The Centre contended that the Cabinet took into account the findings of a report of expert committee constituted by Indian Council for Social Science and Research (ICSSR) before taking the decision.
