As the Supreme Court's hearing of the Panamagate case resumed on Tuesday, the bench inquired into the investigative steps that were taken by the National Accountability Bureau (NAB) and the Federal Board of Revenue after the matter surfaced last year.

Presenting himself before a five-member larger bench of the apex court, FBR Chairman Muhammad Irshad told the court that notices were issued to 343 individuals following the Panama Papers leaks.

"The owners of 39 companies are not Pakistani residents and 59 people denied ownership of offshore companies," the chairman elaborated.

Irshad told the court that Prime Minister Nawaz Sharif's sons Hasan and Hussain Nawaz as well as his daughter Maryam had responded to the notices issued to them by the bureau in November 2016.

Elaborating on the responses of the premier's children, the chairman told the court that Maryam had denied having property abroad and being the owner of any off-shore company.

The court asked whether her response mentioned that she was the trustee of four flats located in London's upscale Park Lane neighbourhood. The chairman responded that she did not.

In the previous hearing of the case on Thursday, Advocate Salman Akram Raja, representing Hasan and Hussain Nawaz, told the apex court that the London flats had rested with Maryam for six months — between February and July 2006.

Raja told the court that a trust deed was executed between Maryam and Hussain in February 2006, following which she acted as a trustee for her brother.

Irshad also told the court that in a response submitted to the FBR, Hussain Nawaz had stated that he had resided in Saudi Arabia since 2000.

Responding to which, Justice Gulzar angrily asked the chairman if he had closed Hussain's file after the premier's son submitted his response.

"What steps did you take after receiving the responses?" Justice Khosa, who presides over the bench, asked the chairman.

The chairman's response invoked the bench's ire when he said the FBR was "verifying all the information provided by the respondents".

"It seems that you may need 30 years to verify those documents," Justice Gulzar remarked.

"You have wasted a year doing a task that should have taken hours," Justice Saeed commented.

The lawyer representing the FBR then admitted before the court that no immediate steps were taken. He argued that separate laws and institutions are available for money laundering cases.

"So in other words, what you are saying is that the FBR did not take any steps regarding money laundering," Justice Gulzar observed.

Court disappointed by NAB's position
Appearing before the apex court, NAB Chairman Qamar Zaman Chaudhry said the bureau "is aware of its responsibilities".

"NAB's position has remained that Panama [Papers case] does not come within its jurisdiction," Justice Khosa observed.

"Is this NAB's position that because no regulator approached them, investigations were not undertaken against off-shore companies?" Justice Saeed asked after Chaudhry explained that the bureau start investigative action when it is approached by a regulator.

"Laws concerning the NAB give it the authority to undertake investigations," Justice Khosa told the chairman.

"It is saddening to hear NAB's position" Justice Gulzar remarked.

"If NAB does not have the authority to investigate, who does?" Justice Ijazul Hassan asked rhetorically.

When Justice Khosa inquired about NAB's actions regarding bank accounts and monetary transactions, the chairman sought to assure the court that "investigations will be undertaken".

"NAB should act as the country's regulator," Justice Gulzar said.

The bench regretted that NAB had not registered an appeal in the Hudaibiya Paper Mills case.

Finance Minister Ishaq Dar had submitted a confessional statement regarding money laundering before a district magistrate in Lahore on April 25, 2000, confessing to involvement in laundering $14.86 million for the Sharif family.

The minister had filed a request for his acquittal from the case after which NAB had not registered any appeals.

"There are reservations regarding NAB's failure to register an appeal," the bench remarked.

"When a criminal gets bail in a case of petty theft, NAB registers an appeal. This is a case worth millions and no appeal was registered," Justice Khosa remarked.

"The decision to appeal is taken in accordance with the prosecutor general's advice. The prosecutor general of NAB had decided that there would be no point in registering an appeal. If an appeal was registered NAB would have been disgraced," the chairman explained.

"Without any pressure, what is your opinion ─ should this case have been appealed?" Justice Khosa asked the chairman. In response, the chairman declared he remains steadfast in the decision not to register an appeal.

"Then be prepared to face serious consequences," Justice Saeed warned.

AG presents arguments
Attorney General Ashtar Ausaf Ali during his arguments said he would provide legal assistance regarding the court's authority.

He said previous court rulings on disqualification could serve as examples to the bench as the petitioners seek the disqualification of the prime minister.

"This is a unique case," the attorney general said.

Justice Saeed told the attorney general that the bench had already reached a decision for the hearing of the requests submitted in the court.

"I will share my opinions regarding the law," the attorney general responded.

"Are you trying to say that the court has the authority but should not use it? Justice Afzal asked

"Authority should be used according to the facts of the case," the attorney general responded.

When Justice Saeed asked the official whether false statements were grounds for disqualification, Ali responded that the court "has to ensure a transparent trial".

"Did the court refuse to hear anyone in this case?" Justice Afzal said.

"It is not about hearing the case, it is about reaching a decision," the attorney general responded.

"It is a matter of tax evasion, the country wants to know who paid how much tax," the bench remarked.

The court asked the attorney general to complete his arguments tomorrow. Meanwhile, Justice Khosa declared that further documents in the Panamagate case will not be accepted.



Does it mean...Court will not accept any further documents from now? Or it includes documents submitted by PTI few days ago too?

Agar documents sirf aur sirf defendant ka moaqqaf ko jhoota sabit karnay ke liey hon tou shayad acceptance main koi masla nahi..

Jaisay Maryam ne kaha ke woh beneficiary nahi hai, lekin aik document aisa haath laga jo official bhi hai aur jis se sabit horaha hai ke Maryam hi beneficiary hai, tou uss main koi zaroorat nahi hai unn ko dobara chance dene ki, lekin agar koi new investment nikal aati hai, tou phir tou time dena banta hai..

Does it mean...Court will not accept any further documents from now? Or it includes documents submitted by PTI few days ago too?

ISLAMABAD: The five-member larger bench of the Supreme Court headed by Justice Asif Saeed Khosa adjourned the hearing the petitions seeking disqualification of Prime Minister Nawaz Sharif over the involvement of his children in what has come to know better as Panama Papers adjourned the hearing of the case till tomorrow with the direction to the Attorney general to wrap up his arguments by tomorrow.

At the close of hearing today Justice Khosa said that the court wants to complete the hearing of the case at the earliest and that the court would not accept any more documents though opportunity for rebuttal would be provided.


Justice Ijaz Afzal commented during the hearing that if the institutions have been working so much time has not been spent on this case.

As directed by the larger bench comprising Justice Ijaz Afzal Khan, Justice Gulzar Ahmad, Justice Azmat Saeed Shaikh, and Justice Ijaz-ul-Hassan on the last hearing Chairman NAB Qamar-uz-Zaman and Chairman FBR Muhammad Irshad appeared in the court today and recorded their statements.

Chairman NAB filed all the record at the court yesterday. this included Hudabiya Paper Mills reference and Raiwind Estate Reference.

Meanwhile, the prime minister and his children filed another application in the court today pleading not to make additional documents submitted by Imran Khan a part of the case record. The application also pleads that if the court decides to make the said documents a part of record eight weeks time shuld be granted.

At the start of the hearing today when Justice Khosa asking Chairman FBR just what is its role over offshore companies added that it is a settled matter that establishing offshoer an offshore company is not wrong he replied that FBR has tried to establish contacts through the Interior ministry. There is no treatty with the related country over Panama issue, he added.

Justice Azmat Saeed asked chairman FBR when FBR contacted the interior ministry adding that why it took the FBR to contact the Interior ministry whose office is just 200 yards away from its own office. He also asked chairman FBR when did it issue notices to the owners of offshore companies named in Panama Leaks to which he said that FBR issued the notices on September 2, 2016. The notices were issued to 343 people, chairman FBR added.

Chairman FBR said that having names of just the directors of offshore companies is not enough. Owners of 39 companies are not residents of Pakistan while 52 people denied having offshore companies. Justice Khosa asked what was Sharif’s family reply after the issuance of the notice to which chairman FBR replied that Hassan, Hussain, and Maryam Nawaz replied to it and Maryam Nawaz said that she does not have any assets overseas.

Did Maryam Nawaz mentioned being a trustee, asked Justice Khosa. Chairman FBR replied that she said nothing about it adding that replies of prime minister’s children were received on November 21, 2016. Hussain Nawaz said that he is living outside the country since December 2000 while Hassan Nawaz only defended residing ourside the country.

Justice Gulzar asked chairman FBR if the file was closed after Hussain Nawaz’s reply while Justice Ijaz asked him if he verifies Hussain Nawaz’s Nation Tax Number (NTN). When chairman FBR said that Hussain Nawaz’s NTN is correct Justice Ijaz saying that old NTN numbers were cancelled after 2002 asked him if Hussain Nawaz got new NTN made to which the chairman replied that he could verify it after checking the record.

Just what did you do after the replies to notices were received asked, Justice Khosa while Justice Gulzar asked chairman FBR to prove the actions that were taken through record. When the chairman said that all the information is being verified Justice Gulzar said that it appears as if you need 30 years for verification while Shaikh Azmat commented that a a whole year has been taken to perform a job that required only hours. What FBR is doing is before everyone, Justice Azmat said. It could ne known within an hour since one is staying overseas, to which department you arote for the travel history and when, Justice Azmat asked chairman FBR. To this counsel of FBR replied that there is no record to show to the court and that owners of 39 companies living outside the country have not been verified.

Here Justice Khosa said that banks were accused of being used for money laundering.

After chairman FBR chairman NAB recorded his statement. Justice Khosa asked chairman NAB that NAB says that Panama issue does not fall within its jurisdictio to which he replied that NAB takes action when a regulator contacts NAB. Justice Azmat Saeed asked chairman NAB if that is NAB’s stand that since no regulator contacted it so it has no authority to take action against offshore companies. Does NAB law talks about any regulator, does someone else regulates NAB, Justice Azmat askedchairman NAB.

Replying to this chairman NAB that NAB’s law regulates it. Saying that Law empowers its chairman to take action Justice Khosa added that chairman NAB talks about regulator but does not know who is its regulator.

Here Justice Gulzar commented that there are regulators for power and gas but today we have also come to know about NAB’s regulator. Terming NAB’s stand sorrowful Justice Azmat Saeed said that Qatari letter talked about issues that chairman NAB is talking about. Qatari letter too talked about regulator, he added. Here Prosecutor General NAB said that banks take action over suspicious transactions.

Attorney General Ashtar Ausaf Ali started arguments after the recording of statement by chairman FBR. The prtitions seek declaring prime minister disqualified, he said adding that there are court precedents over it. Calling Panama a distinct case he said that the petitions are similar to quo warranto and election petitions and hearing of such cases is not court routine. Hearing such cases is not the jurisdiction of the court, he added.

After the Attorney General counsel of the PTI Naeem Bukhari would sum up his arguments.

Talking to media prior to the hearing outside the Supreme Court Shaikh Rasheed said that the case is almost over. Justice is just three days away, the coffin of corruption would come out of Supreme Court, he added.

The real winner in this case will be the people and even if the decision comes against us it would still be our victory, he added.

Imran Khan was also present in the court.

The Attorney General will continue with his arguments tomorrow. The court directed him at the close of hearing today to complete his arguments by tomorrow.



Now i am not sure...but lagta tu yehi hai..ke Justice khosa is talking abt any more documents to be provided now? What do u think? Lekin courts ka kuch keh nahi saktay... Kia pata..ke woh waqayi..PTI ke docs ka zikr karrahy hon? Lekin PTI k docs tu last hearing main submit hogaye thay...yahan tak ke pakora judge ne yeh bhi kaha tha ke yeh kahin ek sazish tu nahi ke ye case kabhi khatam hi na hi? Lekin PM ke lawyer ne aaj jo plea ki hai..us se shak horaha hai ke yeh PTI ke docs ke baaray main baat nahi horahi ho?

Havent seen @Emmie since many days... He seems to have good knowledge of legal matters... If he can clear our confusion tht whether PTI's docs have been accepted or not?
