LAHORE: The Sikh community of Punjab may receive good news as a bill to regularise the marriages of couples hailing from the community is likely to be passed by the Punjab Assembly during the ongoing 34th session today, Pakistan Today has learnt.

‘The Punjab Anand Karaj Bill’ was introduced in the house on October 24, 2017, during the 32nd session of the assembly by the only Sikh MPA from Punjab Ramesh Singh Arora and the bill will appear on the agenda item scheduled for today. The said bill after becoming an act would help Sikh couples to register their marriages and dissolutions at the Union Council (UC) level.

Speaking to Pakistan Today, Arora said that it would be a historic moment for the people of Punjab when the bill would be passed in the house as the country would get global recognition because it would be the first of its kind legislation in the whole world.

“Although it is a Private Member Bill, I have the support of my party, the Pakistan Muslim League-Nawaz (PML-N) and I am quite sure that no one from the opposition benches would oppose it keeping in view the importance of the bill,” Arora said while expressing confidence that the bill would be passed unanimously.

It is worth mentioning here that Arora was seen visiting the opposition benches in order to seek the support from the opposition parties the day when he introduced the bill some four months ago and therefore his bill got a smooth sailing in the house.

He further added that he had invited the people from civil society and the representatives of the Pakistan Sikh Gurdwara Prabandhak Committee to get their input on the much important bill for the Sikh community during the meetings of the Standing Committee on Human Rights and Minorities Affairs of the Punjab Assembly that is headed by Arora himself.

“The Sikh community living in London, Canada and the United States while acknowledging my efforts is continuously in contact with me since I introduced the bill that after becoming an act would also help them as they would easily get the registration certificates of their marriages from Pakistan and the document would be very beneficial for them,” said Arora, who after the elections of 2013, became the first Sikh MPA of Punjab since 1947.

“Earlier, our marriages were registered under an act that was introduced by the British in 1909, but it got redundant after the partition of 1947,” said Arora.

According to Arora, he has talked to the federal law secretary as well as his party desired that the bill should also be passed by the National Assembly to spread its spectrum in the whole country that has a population of some 25,000 people of Sikh community.

“The marriages of our community in India are registered under the Hindu Marriage Act despite the fact that India claims to be the largest secular state. This legislation of the Punjab Assembly would set a great precedent worldwide,” he added.

Excellent move by Pakistan recognize Sikh religious marriage law and giving them the rights they deserve.

Thats a very good news and congrats to Pakistan for such a good gesture. Really appreciate it. Unfortunately India is running really behind in this matter. The Bill, although has been approved by President Pratibha Patil in 2012, it has still not be implemented. Hope that's implemented fast, good news is atleast they recognised the importance of it.

A law, exclusively regulating the marriages of the ‘Sikh Community’, is about to make history in Pakistan as it is the first time that family matters of the community, such as marriage, will be separately regulated. The Punjab Sikhs Anand Karaj Marriages Act 2017 is likely to be tabled in the Punjab Assembly in the coming days.

Notwithstanding the fact that the act is confined to Punjab, this is the first time that the provincial government has provided the Sikh community to protect their own family laws and customs.

The Sikh community seemed overjoyed with the completion of the process of the bill and lauded the role of the Punjab government. They said it was a good omen which showed love and respect for their community members, adding it allowed them to protect family matters.

PML-N MPA Sardar Ramesh Singh Arora said it is unfortunate that Sikhs had not been given a separate identity in terms of their family laws, even in India. He said it was the first time the family laws of Sikhs would be regulated separately in Pakistan and gave credit to the Punjab government. He said it was necessary to define the law in order to regulate solemnisation and dissolution of Sikh marriages, provision of maintenance and the matters ancillary and incidental thereto.

Pakistan Sikh Gurdwara Parbandhak Committee (PSGPC) President Sardar Tara Singh said “there was no law for the Sikh community, but now their family matters will be dealt with through relevant legislation”. He said their community had to face several issues due to the lack of legislation.

Talking to The Express Tribune, PML-N’s Rana Muhammad Arshad, the chief whip in the Punjab Assembly, said the government’s job was to protect the right of every community living in Pakistan. He confirmed all efforts would be made to get the law passed in this session of the Punjab Assembly. He said the government accepted their separate religion and Chief Minister Mian Shehbaz Sharif also gave his nod of approval of the bill. He added provincial law minister Rana Sanaullah and other key members were on board.

Definition of Sikh and religion

Sikh means prescribed in the law as- Sikh means a person who follows Sikh religion as a monotheistic Sikh religion and believes in the scriptures of Guru Granth Sahib and does not subscribe to any other religion and Sikh religion means the belief in Akalpurakh (One Eternal Being) the ten Gurus from Guru Nanak to Guru Gobind Singh and the acceptance of Guru Granth Sahib as the Eternal-Living Guru.

Solemnisation of Marriage

No male or female of the Sikh community who will be below the age of eighteen years, could solemnise marriages under the law.

Saving of Marriages

Nothing in the Act will affect the validity of any marriage duly solemnized according to any other marriage ceremony customary among the Sikhs.

Registration of Marriages

Every marriage between Sikhs shall be registered under the Act. For the purpose of the registration of marriages under the Act, the government, in the prescribed manner, shall grant license to one or more persons professing Sikh religion to be called Anand Karaj Registrar, authorizing him to grant Anand Karaj Certificate.

The bridegroom and the bride or a Granthi shall fill the Anand Karaj form and present it, within thirty days of the marriage, to the Anand Karaj Registrar for registration of the marriage and a copy thereof shall be sent to the chairman. Chairman means the chairman of a union council or municipal committee or any officer authorized by the government to perform the functions of the chairman under the act.

A marriage, which is not solemnized by the Anand Karaj Registrar, shall, for the purpose of registration under the Act, be reported within thirty days of the solemnization of the marriage to him (chairman) by the Granthi or the person who solemnized the marriage.

Fine

The violators will be punished and fined which may extend to ten thousand.

Dissolution of Marriage

Any party that wishes to dissolve the marriage shall give to the chairman notice in writing of his or her intention to do so and shall supply a copy thereof to the other party. Within thirty days of the receipt of the notice under subsection (1), the chairman shall constitute an arbitration council in the prescribed manner for the purpose of bringing about reconciliation between them and the council shall take all steps necessary to that effect.

If reconciliation is not effected within 90 days from the date of the notice, the chairman shall, after the lapse of the ninety days, declare the marriage to have been dissolved and issue the certificate of the dissolution of marriage in prescribed manner.

Its about identity.
Sikhs were registered under Hindu marriage act all these years in India. While in documents we were required to show our religion as Sikh, the marriage documented contradicted, and problems were faced , especially abroad. But in the end it was about the identity.

Law allows the pakistani Sikh community to protect their own family laws and customs.

So general question and the machinations of my evil mind at work here but...
(Also pardon that I’m not well versed in marriage laws)

I’ve heard that the Islamic marriage law allows one to practice polygamy..
So would it be possible for say a man born in a Sikh community to register his marriage under the Islamic law to take advantage of the polygamy loophole? Or do they have checks and balances for such abuse of the law?

Now pass the inter religious marriage bill which jinnah supported once.Let the people decide they want to marry in their religion or not do not impose.
