According to a recent report published on 02 October 2016 from Saad Rasool, in a “landmark” judgment the Honourable Supreme Court of Pakistan striking the judicial accountability declared that some of the appointments made in the Islamabad High Court in violation or in relaxation of the concerned rules and dictates of transparency are unlawful and invalid. The background, as per the report is that the Auditor General of Pakistan had pointed out these irregularities. The Petitioner took up the issue of such appointments, including that of a deputy registrar said to be the brother of the incumbent CJ without advertisement and relaxation of rules. Foreign tours of our rulers are always invariably very successful. If the memories of this senior citizen are not bent to let him down in this old age, he does not remember if any Judgment in our beloved motherland had ever not been landmark.
2. Our country has been destroyed mainly and largely due to one thing viz illegal or verbal orders from “up” and due to non protection of service the functionaries becoming “Yes Boss”. For example doubtful loans mostly are given on “verbal” orders from up.
3. I can’t recall how many times the superior judiciary had during the last 10 years advised the functionaries to uphold the law and without any fear refuse to obey illegal orders. I might have a front page press cutting the then Chief Justice Iftikhar Muhammad Choudhary giving same advice to government servants (and perhaps more than once).
4. What happened to ex DG Tariq Malik? 1300 hrs. termination notice at home is served to an upright law abiding officials!!! Did the law came to his rescue? What happened to Nekokar of Islamabad Police? Rather than the law should had at its own and as per its own “advice” (in fact a promise)“coming” to his aid, when he approached the Law, what did he get? A few months back SHO Rawalpindi on TV cried what “in line of his duty” happened to him through the hands of the “law” when, as per TV talks, the supporters of Hanif Abbasi MNA attacked the police station? Four cops of Bhara Kahu Police Station were last year suspended for intercepting a vehicle with liquor and its four drunk occupants including a serving Government official. And so on. Last but not the least according to a recent new item the senior official of IHC whistle blew about above illegal appointments made, endorsed by the Supreme Court in its landmark judgment, was suspended and later sent on forced retirement for the same reason.
5. I am a senior citizen. I started my career mid 60s from the most lucrative Department in Pakistan viz Income Tax Department. Within one and a half years, being a fool, I left this job on the ground that there was fear of “rishwat”. I swear in case if I get a re-chance of employment today in Pakistan, instead keeping the law or any advice about dignity of law, I would give preference to the “order” of my bosses knowing well no law, no Iftikhar Choudhary, no court would protect me but my corrupt Boss. In my suspension days when I would not be getting my monthly Rs. 20,000 salary, from where would I take Rs. 20 lac for a Lawyer fee if in my today’s mature age acted on any advice of a judge, court or a Mulla?
