Nawaz Sharif files 3 review appeals against Panamagate verdict in SC

Ousted prime minister Nawaz Sharif on Tuesday filed three separate appeals in the Supreme Court to review the Panamagate verdict that resulted in his disqualification.

The three review appeals, in reply to the petitions filed by Imran Khan, Sheikh Rashid and Sirajul Haq, were submitted by Nawaz's lawyer Khawaja Harris. The five-member apex bench that took the unanimous July 28 decision last month will hear the review petition.

Harris has also submitted relevant documents concerning the iqama — a United Arab Emirates work visa — that led the judges to declare Nawaz "unfit to hold office".

Nawaz, through his appeal, has argued that the July 28 decision should have been given by a three-member bench since Justice Asif Saeed Khosa and Justice Gulzar Ahmed's jurisdiction had expired after their dissenting judgement on April 20.

ARTICLE CONTINUES AFTER AD
"By signing the the final order of the court" on July 28, Justice Ahmed and Justice Khosa "have actually passed two judgements in the same case, which is unprecedented in judicial history," reads the appeal petition, a copy of which is available with Dawn.

"On the face of the record, there are four final judgements passed in this case; the first of these final judgements being the minority judgement dated 20.04.2017 of the two members of the originally constituted 5-member bench, the second being the majority judgement dated 20.04.2017 passed by the 3-member bench, the third judgement [...] dated 29.07.2017 again passed by the 3-member bench of this court, and the fourth being the Final Order of the Court dated 28.07.2017 passed by the originally constituted 5-member bench," says the appeal.

Five more appeals are expected to be filed soon by Nawaz's sons — Hassan and Hussain Nawaz; his daughter Maryam Nawaz; Captain Safdar; and Ishaq Dar.

'Still my PM'
Earlier on Tuesday, National Assembly Speaker Ayaz Sadiq said that he still considers Nawaz Sharif his prime minister, and that the entire country was waiting to welcome the former premier.

"In my heart, he [Sharif] is still the prime minister," declared Sadiq while speaking to reporters after attending a meeting of top PML-N leadership in Raiwind.

The meeting, chaired by Sharif, was also attended by Hamza Shahbaz, Foreign Minister Khawaja Asif, Railways Minister Saad Rafique, and Punjab Law Minister Rana Sanaullah, among others.

"Nawaz Sharif talked about his future strategy. He does not plan to create any friction between the institutions but he will fight for his right by taking his case to the public and protect the sanctity of their vote," the speaker told the reporters.

"The meeting also discussed ways to strengthen the Parliament and democracy; we talked about what legislation needs to be passed, by taking all political parties on board, in order to protect the sanctity of the votes cast by the public."

Nawaz has a long list of disqualification reasons. He is actually spared by Supreme Court for submitting forged documents and at this time but if case would start on forge document submission, he would disqualify and go to jail in one go.

The original question of having no money trial is still there - and can lead to sentence in jail. If Nawaz is ever spared for one reason, there are more cases stacked behind it which will eventually lead to his disqualification + imprisonment.

Besides, a PM who's now trying to play "b!tch" doesn't deserve to hold any important chair. He has revealed his actual face to people of Pakistan and man, that was pretty ugly and disgusting.

There are two points to consider. One is the legal point. When and if any citizen feels hard done a court decision, he has every right to file an appeal/review petition.

Secondly, many ordinary Pakistanis including myself believe that despite the fact that Nawaz Sharif was guilty and the funds used to purchase Park Lane flats and the Jeddah Steel mill originated in Pakistan, the verdict itself was based on flimsy grounds. This view is reconfirmed by some of the lawyers for example:

First, the assumption of the role of the court of first instance by the Honourable Supreme Court in issuing a declaration to the effect that Mian Muhammad Nawaz Sharif is not qualified to remain a member of parliament (and hence disqualified to hold the office of the prime minister) in terms of Article 62 (f) of the constitution, is in itself repugnant to the cardinal principles of a fair trial.

However there is another very important point; that of morals, ethics and self-respect. Nawaz Sharif has been the PM three times; he need not be greedy and try to cling to power. IMO Nawaz Sharif should first & foremost declare:

“I don’t seek any public office, I would not even seek re-election as an MNA, however since my integrity and honour has been maligned by the verdict; I am filing the appeal to exonerate myself and restore my good name.”

Three or three hundred thousand reviews, all will end up in the waste bin, in sha Allah!

Don't he read the verdicts himself? Lol!
His blood sucking lawyers will keep minting money out of his stamped disqualified @$$ as long as possible.

Best thing about PMLN is that they keep chopping their own legs off.

First they go around ridiculing and cursing the same judges and then they now turn to the same judges for a review. Blessed are the folks these thugs lead, lol, they are their own worst enemy.

A liar is a liar is a liar stamped on the backside of the GodFather by none other than the Supreme Court of Pakistan.

Now, instead of sitting home with some iota of shame, he goes around rubbing his backside all over the country in a futile effort to scrub it off somehow.

Best thing about filing these reviews is that they have given a chance to the Judges to reply to the accusations made against them by Nawaz and Co.

The Judges will now have a second go at explaining their Judgment in more detail by commenting on the reviews and in sha Allah, rejecting the reviews all the same.
