He is just on bail. Read the below quote from the Court.

No one stops him from being a political activist but he should be ready to face the political consequences for being one, one cannot hide behind charade of being a comedian.

How can he be arrested for something he hadn't said? If he was arrested on the basis of something he said in the past, well his audience is mostly Hindu, why would he risk his career to provoke them? That is why I suspect his jokes were not directed at Hindu gods, rather at the social and political situation around him.

How about the law going after Hindus who commonly give life threatening and rape speeches directed at Muslims. The leaders of lynch mobs never seem to be brought to justice. This has put India on Genocide Watch.
