The Chief Justice can - but this change is quite surprising and very rare. Normally a change of bench composition is only done when a judge retires, is transferred or recuses himself. But then again Khehar's behaviour has been bizarre since the revelation of the AP CM's suicide note. Something fishy for sure.

The trend in the last few years has been a weakening of these two premiere democratic institutions. And that other bastion of democracy , the Press, has been totally hijacked by Hindutva and pro-govt bias. This has accelerated since Modi has taken over. He will fiddle with every institution India has until they become victims of serious confusion and inertia. That's what all fascists want. Weak govt institutions. Modi is no different. There have been 22 people executed in India since 1995 (i.e. 22 in 22 years). A little less than Pakistan which is almost the global #1 for executions - with 400 executed in 18 months, including convicts who were minors at the time of their crime.
