Kerala HC sentences 24 accused in Suryanelli rape case | Business Standard

".....The Suryanelli rape case is that a 16-year-old girl who eloped with a bus conductor on January 16, 1996 from Suryanelli in Idukki district in Kerala was later abandoned by her lover and fell into the hands of rapists. The girl was taken to various places in Kerala by advocate Dharamarajan and Usha by threatening her that father will be killed if she try to escape from their custody. The duo made money by presenting her to various people at various places. The prosecution submitted that she was raped 67 times by 47 people during a period of 40 days and transported over 3000 kilometres. The case became sensational when the girl alleged that one of the rapists was Rajya Sabha speaker P.J. Kurien (Congress).

"......in 2005, the High Court acquitted all of them except one claiming that the girl had consensual sex with all of them. The High court had sentenced Dharmarajan for four years for kidnapping the girl and let the others free. The prosecution appealed the case, and it remained pending inthe Supreme Court for eight years. After the 2012 Delhi bus gangrape case came into the limelight, the case was broughtto attention of the Chief Justice of the Apex court. Subsequently, the Supreme Court reversed theHigh Court's decision in January 2013, describing it as "shocking".

The Supreme court bench, headed by A. K. Patnaik and Gyan Sudha Misra set aside the Kerala High Court's order and sent the case back to the HighCourt for taking a fresh look at it. The Supreme court ordered to complete thecases in six months time, but the Kerala High court sought more time toconsider the case. Five accused died during course of the trial. The victim in the case accused that Congress leader and Speaker of Rajya Sabha P. J. Kurien also misused her physically at Kumily guesthouse in Idukki district.

Kurien was exonerated by the police investigators and the courts. Later, Kerala High court rejected an appeal filed by the girl, stating that there is no fresh evidence against Kurien in the case. The victim and her family members plans to move to the Supreme court forjustice. The girl's statement said that Kurien had misused her twice at Kumily guest house and will go to any extend to get justice. The High court today said that there is no evidence for child prostitution involved in the case as cited in the earlier judgment. The court also observed that there is no point in discarding the statements given by the minor girl.

There was no way for the girl to escape fromthe custody of the criminal gang, lead by Dharmarajan. She was tortured, mentally and physically for 40 days. "There are materials to show that her evidence is true. She was mercilessly andbrutally raped," the bench said. The victim, who is from Suryanelli village of Idukki district, in Kerala went missing from the school hostel in Munnar,in January, 1996 while studying in 9th Standard....."
