Death penalty should only be given when the conviction is based on evidence beyond doubt i.e. eye witnesses etc, medical reports and other evidence that establish the gang rape happened. In cases where there is doubt that whether it was a rape or a consensual act, a lesser punishment should be given.
This is why I said that there needs to be a mechanism to check the effectiveness of forensic part of the investigation.
While it is still not advanced enough to reconstruct a rape scenario, it still is about 80-90% accurate.
Hence Forensics investigating rape should be anonymous and inaccessible individually to police officers, lawyers and judges.
