Indian Government Proposes Death Penalty for Sexual Abuse of Children

The amended law, once approved by the Parliament, will also protect children from sexual offences in times of natural calamities and disasters.

The Indian government has proposed an amendment to the Protection of Children from Sexual Offences (POCSO) Act of 2012 to make the punishment for sexual crime against children more stringent.

The proposed amendment, approved by the Union Cabinet led by Prime Minister Narendra Modi on Friday, provides for severe punishment, including the death penalty for people committing aggravated penetrative sexual assault on a child under 18 years of age.

"Major changes are being made to POCSO Act. Punishment has been enhanced for sexual assault of children. The changes are being introduced to prevent children from becoming victims of sexual assault", Ravishankar Prasad, India's Law Minister said during a press briefing in New Delhi.


The law has also been amended to include provisions of punishment in cases where children are administered, in any way, any hormone or any chemical substance, to attain early sexual maturity for the purpose of penetrative sexual assault.

As per the National Crime Records Bureau, a total number of 34,449, 34,505 and 36,022 cases were registered under the Sexual Abuse/POSCO Act in 2014, 2015 and 2016 respectively with crimes against children accounting for an 0.2% increase in 2015 over 2014 and a 4.4% increase in 2016 over 2015.

Good that they are raising the age limit from 13 to 18. I think all proven gang rapes should be punishable with a death penalty.

Fully support the government on this. However, there has to be an overhaul in the way forensic reports and rape cases are handled.

There are two extremes:
  1. Where there is a genuine case of rape and where it is often too late to actually save a woman (Nirbhaya tregedy etc)
  2. Where the mere pointing of fingers of a selfish and crooked woman can land an innocent man in jail
In order to make the law equitable the death penalty should be two-sided.

  • Forensics need to be made anonymous and opaque to all police officers, judges and lawyers investigating rape cases - none of them should know which forensic officer is investigating which case.
  • All rape cases must be taken with precedence over other laws for the first five years of this bill being passed and judgements be passed on priority basis
  • Any innocent man found to have been falsely accused should be given full compensation from the accuser's side and the accusing person (man or woman) must be awarded the death penalty for using law to commit a murder.
Only through such a balanced system will there be true justice in the society for both the innocent rape victims and the general, good people whose lives depend on this.

Killing is extreme. But I agree with the concept of the punishment of false rape and sexual harassment cases. The woman filing such cases should be given 7 year jail term with no parole.

Death penalty should only be given when the conviction is based on evidence beyond doubt i.e. eye witnesses etc, medical reports and other evidence that establish the gang rape happened. In cases where there is doubt that whether it was a rape or a consensual act, a lesser punishment should be given.
