India is not Saudi Arabia, police chief's statement is shocking, insensitive

You couldn't come with anything smart and logical to say so you bring Pakistan in it which has nothing to do with it. Many of you Indians just dream, think, wonder and hate Pakistan all the time. You people have nothing but time and hateful thoughts in your mind and soul which is pathetic do something else with your lives seriously !!

No we do not hate pakistan or Pakistanis as much as you guys hate us. From creation of pakistan to your nuclear bomb is evolved from Hindu and India haterate. We have made many efforts to improve the relationship but every effort was sabotaged by either Kargil or Uri or Pathankot. Still we are hopeful of good relations and our effort of normal relation are on.

You Are Welcome And I Commend You On A Well Researched Post But Have You Noticed One Thing That The Dates Of The Court Judgments And NRC Reports Precede The Link I Gave You

And I Don't Think That India Is An Ideal Example to Give Less Than 6 Executions And The Results

Thank you. The reports I quoted and the cases I cited are all official publications (in some form or the other) so I consider them more authoritative.

I quoted SA and India to show that the thinking in developing countries (where one might expect a better case for capital punishment due to higher crime) is no different.

The report of the Law Commission of India that I suggested you examine is good because it brings together the latest literature on the subject and is a great starting point for research.

And I Don't Think That India Is An Ideal Example to Give Less Than 6 Executions And The Results

Why not? India is the closest to Pakistan in terms of way of life, attitude towards women and shared social practices (with north india obviously closer than south India). The types of crimes and the motivation for such crimes are also likely to be similar given the two countries have similar levels of poverty and lack of access to education. Nonetheless our judiciary and lawmakers have not found compelling reasons to advocate granting and implementation of the death penalty. And there are many good reasons for it (please see the law commission report if you can) not least being the greater burden on the prosecution, the chance of a wrong conviction being irreversible, the lack of deterrence - this debate was reignited after the gruesome nirbhaya gangrape some years ago and yet it was felt inadvisable to impose the death penalty for rape after painstaking legal and criminological study (and rightly so, in my view). That's why there have been so few executions in the last 20-30 years.

The TOI link you mentioned - which refers to a UN report - is not very helpful. Absolute number of rapes (or any crime) will be higher in a populous country. A more relevant statistic is how frequent the occurrence is and this is what the article says:

The UN data said in the US, 27.3 rape cases were reported per lakh population, followed by 21.09 in Brazil and in case of India, there were 1.8 cases of rape per lakh population. The United Kingdom has reported 15,892 cases of rape in 2010 (28.8 cases of rape in per lakh population) and in Mexico, there were 14,993 cases of rape (13.2 cases of rape in per lakh population).

So if these statistics are to be believed a person in the US is 15 times more likely to be raped than in India.

While agreeing with your argument about how a larger population would correlate with higher number of instances for rape and other violent crimes

Those numbers given does'nt really show the factual account of the problem because in developed countries there is a much bigger chance of rape being reported to the authorities than in underdeveloped nations, Both due to conservative societal trends, Lack of personal freedom especially in this case for females and the social stigma that comes with it

For instance in India..

Surveys show that an estimated 30.53% of women who experience sexual violence actually tell someone about the incident, but only 1% out of these end up reporting to the police, due to concerns of security, social stigma & discrimination.

Though the 2013 Criminal Law Amendments Act was a positive step for women’s rights in India, there are still many barriers for women to report crimes safely and with dignity. Our vision is to reduce barriers to safe and dignified reporting of sexual violence, without facing prejudice.

Amnesty International India’s Ready to Report campaign highlights the multiple challenges survivors of sexual violence face, in relation to reporting. By addressing these challenges, our campaign aims to change the perception people have about reporting.

And this number of reported cases would be even less in conservative Muslim nations, Where Womens rights are atrocious due to religious dogma.. As i have mentioned before 99% of rape in those countries goes unreported due to the social status of the victims, Given the vile record of the very few that were indeed prosecuted it's no wonder women would suffer in silence.. Cos most often than not it's the victim that gets prosecuted in religious based patriarchal courts

I agree completely. I was merely refuting the reliance placed on the absolute numbers.

Even if India was a developed country - with identical reporting access and law and order infra as the US (say) - the absolute number of offences reported would still be much higher because of a higher population.

Anyway i think no one can take a holier than thou attitude when it comes to this subject.. Yes India does seem to have a acute problem particularly with gang rape, But atleast there seems to be a public discourse about it, Which will inturn and hopefully open a lot of eye's.. Where elsewhere particularly in more conservative societies it's hidden away, Often in the cover of religion and victims suffering in silence
