New Delhi: Government has initiated action against 26 NGOs in current fiscal after finding irregularities in receiving foreign contribution while 14 foreign donors have been placed under prior approval category.


Minister of State for Home Kiren Rijiju told Lok Sabha that on receipt of adverse inputs against a particular foreign donor, banks are advised through Reserve Bank of India to seek prior approval of the government for crediting of funds in to receipt account from such donor.

"So far 14 foreign donors have been placed under prior approval category," he said.

Rijiju said as and when information regarding receipt and utilisation of foreign contribution is received, inspection of records and accounts of the NGOs is carried out to ascertain violations of the provisions of the Foreign Contribution Regulation Act.

"During the current financial year, inspection of accounts and records of 26 such associations have been carried out and action initiated against them," he said.

Delhi: The Ministry of Home Affairs has put one of the biggest international funding organisations, Ford Foundation, on its watchlist and ordered that all funds coming from the international organisation have to be routed only with its nod.


The Ministry said it wanted to ensure that funds coming from Ford Foundation is utilised for "bonafide welfare activities without compromising on concerns of national interest and security".

Now, funds coming from Ford Foundation (US) will be required to get clearance under Section 46 of the Foreign Contribution Regulation Act, which says that all funds coming to the country will have to be approved by the MHA.

Reports also said that in the last few months, millions of dollars of grant from the foundation to NGOs had been blocked.

At the same time, the RBI has been asked by the government to rope in all banks to make sure that the due process is being followed.

"RBI is requested to instruct all the banks and their branches to ensure that any fund flow from the above mentioned agency to any person, NGO, organisation in India may be brought to the notice of the (Home) ministry so that funds are allowed to be credited into the accounts of the recipient only after clearance of of this ministry," the order said, as per PTI.

The move came after Gujarat government asked the Home Ministry to take action against Ford Foundation as it alleged that the US-based organisation was "interfering in the internal affairs" of the country and also "abetting communal disharmony" through an NGO run by social activist Teesta Setalvad.

There have been allegations that the recipient NGOs have not filed mandatory annual reports and balance sheets with the government.

The Home Ministry in its order also said that government organisations can avail of foreign funding from Ford Foundation only with the clearance of the Department of Economic Affairs.

"Any instance of government organisation receiving funds directly from this agency may be withheld and brought to the notice of this Ministry," the order said.

New Delhi: Ford Foundation has funded several NGOs, which were not registered under the FCRA, and another organisation with which activist Teesta Setalvad is associated.


"There are inputs from security agencies that some amounts have been credited from Ford Foundation to some NGOs which are not registered under the provisions of Foreign Contribution Regulation Act 2010.

"Hence, to keep a watch on such recipients, the credits from Ford Foundation has been put under prior permission category under FCRA 2010," Minister of State for Home Kiren Rijiju said in Lok Sabha replying a written question.

Rijiju said Teesta Setalvad is associated with two NGOs namely Citizen for Justice and Peace and Sabrang Trust which are registered under FCRA.

"As far as funding from Ford Foundation is concerned, only Sabrang Trust has been funded," he said.

Replying another question, the Minister said in 2014, penalty of Rs 51.99 lakh was imposed on 24 NGOs for receiving and utilising foreign contribution without registration or prior permission.

Till date, 30 cases of violation involving misappropriation or misutilisation of foreign contribution have been referred to CBI of which six cases resulted in conviction.

Ten cases of violation involving mis-appropriation of foreign contribution have been referred to the concerned state police and accounts of 34 associations have been frozen for violation of various provisions of FCRA.

A total of 69 NGOs have been prohibited from receiving foreign contribution, 16 foreign donor agencies have been placed under prior permission category.

"Registration of 10,117 associations has been cancelled for not filing the annual returns continuously for three years and even not responding to show cause notices issued," he said.

In 2014, government has conducted inspections in 69 off-site and 50 on-site locations for violation of various provisions of the FCRA.

Till date, in 2015, 12 off-site and 24 on-site inspections have been conducted and violations noticed in majority of the cases related in clubbing foreign contribution account with domestic accounts i.E. Failure to maintain exclusive accounts as required by FCRA, failure to submit annual accounts within the stipulated period.

Transfer of foreign contribution to unregistered NGOs, utilisation of foreign contribution amount for the purposes different from the grant of different from the objectives of the recipient NGO, registration of assets are some of the other reasons of taking action against NGOs.

Greenpeace India says it’s on the verge of shutting down its operations in India, unless the government lifts the freeze on the organisation’s bank accounts.

Speaking to Deccan Herald, Divya Raghunandan, program director of Greenpeace

India, said if the accounts were not released by end of May, India would become the first country to see the NGO shutting down its operations.

The Indian Government has blocked Greenpeace’s domestic and international bank accounts, accusing it of “negatively impacting economic development” in the country.

Greenpeace draws its funds from both Indian and foreign sources. The group claims that around 70 percent of its total funding in the country comes from Indians, while the foreign donations make up for the rest.

As the government has blocked accounts that receive money from both the sources Raghunandan said the government was strangling Greenpeace to death.

Raghunandan said that the NGO had faith in the judiciary and would fight the case in the court. Greenpeace employees had decided to wait till the judgement and are holding discussions on how to carry on with their work without salary, she added.

Raghunandan said that the government’s action on Greenpeace had a larger message to all civil society bodies and NGOs: Either follow what we say or wind up.

Court allows Greenpeace India to operate two of its domestic accounts - The Hindu

The Delhi High Court on Wednesday allowed Greenpeace India to operate two of its domestic accounts and access its fixed deposits.

The Central Government, however, reiterated what it has told the High Court on Tuesday — that Greenpeace India violated the Foreign Contribution Regulation Act by merging its foreign donations with domestic ones.

Greenpeace India had filed a plea in court against the cancellation of its registration, saying that it was facing an imminent shut-down and it had barely a month to survive with the government recently freezing its accounts, over allegations of foreign funding that were specifically meant to target India’s economic and development interests.

The organisation has also faced a host of other penalties for which they have approached the court in the past.

The government had suspended Greenpeace India’s license for six months, which had barred it from receiving foreign funds. It had also issued a show cause notice to them asking why it should not be shut down permanently.

The list includes the names of Delhi University (DU), Jawaharlal Nehru University (JNU), Supreme Court Bar Association, Escorts Heart Institute, among others, and bars them from receiving foreign funds.

All associations were given proper notice by the Foreigners Division of the Home Ministry with adequate time to reply before their FCRA licences were cancelled, a senior official said.

Member of Greenpeace's international staff, Aaron Gray-Block, was reportedly denied entry into India on Saturday .

In April 2015, the government had earlier blocked foreign fundings to Greenpeace India with immediate effect by suspending its licence for six months and served a notice to the NGO asking why its registration should not be cancelled.

The decision was taken by the Home Ministry after it was found that the NGO has "prejudicially affected the public interests and economic interests of the country in violation" of the Foreign Contribution Regulation Act. The foreign fundings to Greenpeace India have been blocked by suspending the NGO's licence for 180 days, it said.

But in May 2015, in a relief to Greenpeace India, the Delhi High Court allowed it to use two of its accounts for the purpose of receiving and utilising fresh domestic donations for its day-to-day functioning, telling the government it cannot choke them of their funds.

Kolkata: The Indian Institute of Technology-Kharagpur, which was listed among the 4,470 NGOs barred by the central government from receiving foreign funds for not adhering to guidelines, on Friday claimed its inclusion was an error.

The Institute said the matter has been taken up with the concerned ministry.

Of the 4,470 NGOs and institutes barred, as many as 679 are from West Bengal.

Prominent among them are the Academy of Fine Arts, Indian Institute of Technology-Kharagpur, the Meghan David Synagogue, International Society for Krishna Consciousness (ISKCON) and St Xavier`s College.

"The matter has been taken up with the concerned ministry. There has been an error on the part of the ministry since IIT-Kgp is not subject to filing of FCRA returns as per the Gazette.

"The ministry in control of FCRA will be making necessary changes to the erroneous listing in the site against the entry of Indian Institute of Technology under the list for West Bengal," an IIT-Kgp official told IANS.

The matter will be further reported to the ministry of human resource development since the Institute is directly under that ministry, the official added.

After scrutinising the records of 9,000 NGOs, the home ministry has cancelled the licences of 4,470 NGOs for non-compliance with the Foreign Contributions (Regulation) Act (FCRA).

According to the FCRA of 2010, which sets the guidelines for foreign contributions received by NGOs, any such transfer has to be reflected in the prescribed returns by the transferer and the recipient.

As per the FCRA website, as many as 679 NGOs, art, culture, religious establishments and educational institutes, in Bengal figure on the "registration cancelled" list.

As many as 190 NGOs from the State are among the 4,470 in the country whose registration has been recently cancelled by the Centre, barring them from receiving foreign funds.
The decision was taken by the Home Ministry after it found that these NGOs had violated the Foreign Contribution Regulation Act (FCRA), including non-filing of annual returns, according to official sources.

All these NGOs, according to the sources, were given proper notice by the Foreigners Division of the Home Ministry before their FCRA licences were cancelled.
