Commission's Terms of Reference
Following the prime minister's address on Friday night, the federal government has written a formal letter to the Chief Justice of Pakistan for setting up an inquiry commission.

The letter, written by the ministry of law, says the commission can probe the offshore accounts of Pakistani citizens, investigate current or former bureaucrats and would have the power to summon any individual.

The Commission of Inquiry shall have the following Terms of Reference:

• To examine information relating to involvement of Pakistani citizens, persons of Pakistan origin and legal entities in off-shore companies in Panama or in any other country.
  
  
• Involvement of former and present holders of public office in writing off their own bank loans or those of their immediate family members through political influence.
  
  
• Transfer from Pakistan of funds which have originated from corruption, commissions or kickbacks, and to determine whether, in any case referred to above, any law for the time being in force in Pakistan has been infringed.
  
  
• In case the answer to above is affirmative, to determine responsibility for such infringement, and to make such recommendations as may be deemed appropriate.
  
  
• The Commission shall have powers under the Code of Civil Procedure, 1908 for summoning and enforcing the attendance of any person, including a tax expert or accountant, and examining him on oath, requiring the discovery and production of any documents, receiving evidence on affidavits, issuing commissions for the examination of witnesses on documents and requisitioning any public record or copy thereof from any Court or office.
  
  
• The Commission shall have the powers to require any person, subject to any privilege which may be claimed by that person under any law for the time being in force, to furnish information on such point or matters as, in the opinion of the Commission, may be useful for, or relevant to, the subject matter of the inquiry.
  
  
• Any officer not below the rank of a gazetted officer, specially authorized in this behalf by the President of the Commission may enter any building or place where the Commission has reason to believe that any books of account or other documents relating to the subject matter of the inquiry may be found, and may seize any such books of account or documents or take extracts or copies therefrom subject to the provisions of section 102 and section 103 of the Code of Criminal Procedure, 1898, insofar as they may be applicable.
  
  
• Any proceeding before the Commission shall be deemed to be a judicial proceeding within the meaning of sections 193 and 228 of the Pakistan Penal Code, 1860.
  
  
• The Commission shall be assisted by all the concerned authorities of the Federal and Provincial Governments.
  
  
• The Commission shall start the inquiry at a place and on a date to be fixed by it and shall submit its report to the Federal Government in accordance with its Terms of Reference.
  
  
• The Cabinet Division shall provide secretarial assistance to the Commission.

An analysis where a bunch of lawyers ( including aitzaz ahsan) were debating how strong this judicial commission will be and they were saying that according to the act of 1956 the judicial commission holds no power to implicate the govt at all nor direct it nor can they ask abroad links for proofs. Infact they said that their power is equivalent of civil judges and they wont have the power to audit anybody. The lawyers were saying that the govt must allot power to the commission otherwise its of no use. The supreme court bar president was saying that if the judicial commission is not based upon the judges and our suggestions then we will take to the streets.

Simply add an international audit firm in it as well. Bring them in and start the audit of everybody including themselves. If they are clean then they can stand and say that they are not only clean but have audited others and have taken actions against those that were hiding or escaping with their wealth. A massive win win unless you are corrupt then there is no win. Aitzaz Ahsan also pointed out that nawaz Sharif has not paid tax since 1992 and Imran is also asking for his tax information as well.

Rather than wasting time on foolishness such as his campaign start which begins at may from kpk and will go to balochustan to sindh and then to Punjab, he should focus on this to make sure all those that are corrupt and hiding their wealth are audited independently. If he brings an independent audit firm then no one can question him.. Right now its not just Imran. Every other party is pointing fingers ( although PPP is a joke) ..

And plus this argument has been created out of malintention. One of Imran's main Money man holds a company in offshore and the other is a loan defaulter. Mind you NS has been accused regularly about being loan defaulter, so adding these in ToR is actually an action against one's self. So I don't understand that what's the big fuss if JC is able to probe all the Panama papers beneficiaries and those who have availed write offs.
If he starts from himself, Let me tell you in advance of two senarios
1-If he is found guilty, he will leave the office and the further inquiry into other people will be forced to dump.
2-If he is not found guilty, Khan and Co , repeating their history will make the JC controversial to save themselves from further inquiry.

If everything is legitimate than he shouldn't have any problem in declaring all the assets/companies and documents to prove that funds for setting up empire came from legal means. Is it very hard to provide financial statements of companies and support documents to show the means/source of initial investment? He should prove himself innocent like any accused.
But then this brings me to second part. Can you guarantee that Imran and his cornies would accept the result which comes contradictory to their beliefs? I am talking about history here. And lastly are you considering others as a lesser and acceptable evils so that their accountability can wait?
