IK already said decision is final. SC just making huge thing out of nothing on wording appointment or reappointment etc. Nothing more just a show to show who is more powerful out of nothing.

basic mistake which many people are making in their analysis about the current storm in the cup of tea is that Supreme court is challenging the appointment of Army Chief.

If people follow the case specially the remarks of Judges closely they are questioning the process which is adopted for this extension and most importantly actually hinted few way out of from this situation to the Government, for example

- Yesterday there was a remarks that there is no law for the extension of Army Chief services but the law related to termination of Retirement is available

- Secondly the first notification was issued by PM which is not as per rule of business and the issuance of Notification for appointment fall under the domain of President

- SC was seeking the clarification that its a reappointment or extension of Army Chief services as

• If it is a reappointment than this could not happen before the retirement of Army Chief

• If it is the extension of services than there is no law in Pakistan to extend the services of Army Chief, in fact If I am not wrong there is an old decision of SC which prohibit extension of services of Civil Bureaucrats

- Then today SC enquire about the tenure of appointment of Army Chief which as per Attorney General of Pakistan no fixed period of appointment is define in any law, its just customary to grant 3 years tenure, so in this case the letter of reappointment Signed by President is required but the same was issued by the Prime Minister which is wrong.

- Even the Age of Retirement is not clear for Army General even the Attorney General was explicitly quoted by Media about this point, on the other hand the age of retirement for Lt.Gen is 58 or completion of 3 year tenure whichever come earlier.

So in short Government made such "BLUNDERS" in a simple administrative procedure which has caused this situation, now in my humble opinion it is better for government to accept the unintentional mistakes and seek SC guidance to resolve the matter .....

This could have been rectified administratively, without all the brouhaha. After all, this is not the first time the COAS's tenure has been "extended". But it looks like the courts were trying to embarrass the government publicly.

I can only think of two reasons: First, it has effectively diverted everyone's attention from the court's controversial role in allowing the Sharifs to leave the country without consequence.

The second reason is more interesting. The courts did not want to decide on letting Sharif leave the country. They were content to let the government make that unpopular decision. But when the government put the indemnity as a condition to leave the country, they forced the court's hand and the CJ had to make an unpopular decision. To make matters worse, IK publicly chastised the courts for the decision. So I think this whole episode was a parting shot from Mr. Khosa, who it seems is a rather vindictive man.

But, Gen selected as COAS during the continuation of service

exactly when he was selected he was Lt. Gen so after appointment as Gen. there is no age of retirement as per Attorney General of Pakistan (which is a funny thing at least for me) but his term as COAS was three years as per previous customary practice so after completion of three years term his term could be increased by extension again as per previous customary practice in extension full term could not be granted and again PM could only send advisory summary for this to President of Pakistan it will the President who will extend the tenure of Chief of Army Staff

Either govt or SC lost translation of " reappointment or extension " .

Reappointment mean full 3 years service after the completion of this term
Extension mean less than 3 year like 1 year or 2 year of services after the completion of this tenure

Now the most embracing thing is that we have no law dealing with current situation, we even do not have any law which could clearly define the Age of Retirement and Tenure of Service of Army Chief .... and I am sure there must be same situation for the Chiefs of other two services

this is not the first time the COAS's tenure has been "extended"

but it is the first time extension of Army Chief was challenged by a petitioner in SC ..... that too the very next day Government announced the issuance of letter appointment/extension letter

Now this has put the Govt and specially army in the dock now. No matter what SC decides but Army will be under pressure to keep the distance from the govt as it will create the displeasure with in the Army as well as the spotlight will be on Army now. After all this crisis, General Bajwa’s own authority will be weaken now and he will not be the same General Bajwa. This crisis has put some serious tension between Govt and SC, SC between Army and Army between Govt now.

the incompetence of PTI government is very evident ... they are master in making issues out of nothing, about this issue already they were aware yet they did not took any actions, infect out of 25 signatories they took signature of just 11 and that is what Chief justice has pointed out... on top of it this summary of extension is moving in government offices since August ... it went to four Departmental Secretaries what is their role ? if they cannot even point this one single mistake timely ??? then what is their use???? who selected them ?? and what is their role ??? it shows how incompitant our civil service ....

before to put blame on PTI .... we should try to seek the answers of the questions that what the bureaucracy of Defence Ministry and Law Ministry was doing ..... ??? it must be a routine job for them, why they opt to advice PM differently ..... ???

To me its a clear sign of soft coup of civil bureaucracy particularly in these two ministries against IK lead government .....

And till to date why no law regarding the tenure and the retirement of Army Chief is made ....?? now should we blame PTI for this as well ???

Only SuoMoto taken by khosa sahab raised many question even if you watch 11th hour show aitzaz hassan raised this question that he has taken only one suomoto and that is when Bajwa sahab about to retired what was he doing in august,sept, oct?

Khosa Sahab just made the SC questionable in eye of common man.
