General Election to the Legislative Assembly of 154-Rajarajeswari, Karnataka, 2018 Deferred : Election Commission of India

The Election Commission of India exercising powers under Article 324 of the Constitution and sections 30 and 153 of the Representation of the People Act, 1951 read with section 21 of the General Clauses Act, 1897 and all other powers enabling it in its behalf, has directed that the poll scheduled to be taken on 12th May, 2018 in 154-Rajarajeswari Nagar Assembly Constituency in Karnataka shall be deferred, for the time being.

In this light, the Commission further directed that the poll in the constituency shall now be taken on 28th May, 2018 (Monday) and counting of the votes of this Constituency will take place on 31st May, 2018 (Thursday).

The Election Commission has brushed aside arguments that the model code of conduct brings governance to a halt during polls, saying it only bars governments from announcing fresh projects and schemes during the period. The poll watchdog also told the Law Commission that as and when government departments approach it with ‘references’ to clear proposals and schemes during poll time, it takes a fast decision understanding the urgency involved.

The issue of model code of conduct came up for elaborate discussion at a meeting between the top brass of EC and law panel here on May 16 when they met to discuss the possibility of holding simultaneous elections to Lok Sabha and State assemblies.

When members of the law panel asked the EC about the “argument” that the model code brings governance to a halt, the poll panel rejected the suggestion outrightly, sources aware of the deliberations said.

The EC was of the view that the code does not bring governance to a halt. It said the code only bars announcement and launch of new schemes and projects so that voters are not influenced by the party in power.

It also told the law panel that “it works with alacrity” when government departments seek its permission to go ahead with certain decisions during model code period.

It said several ‘references’ are received by it and it tries to dispose most on them in a time-bound manner.

The law panel has now asked EC to give it a list of references received from governments during recent elections, including those held in Goa, Gujarat, Himachal Pradesh and Karnataka.

The Model Code of Conduct is a set of norms which has been evolved with the consensus of political parties who have consented to abide by it and also binds them to respect and observe it in its letter and spirit.

The Election Commission ensures that it is followed by parties and candidates. It is also ensured that official machinery is not misused to help the ruling party.

The model code is enforced from the date of announcement of election schedule by the Election Commission and is operational till the process of elections are completed, which is usually a couple of days after the verdict is announced.

ECI holds round table conference with former CECs/ECs

Election Commission of India today held a round table conference with former CECs/ECs. The consultation meeting was attended by former CECs S/Shri M.S.Gill, J.M.Lyngdoh, T.S.Krishna Murthy, B.B.Tandon, Dr. S.Y.Quraishi, V.S. Sampath, H.R. Bramha, Dr. Nasim Zaidi and former EC GVG Krishnamurty.

Chief Election Commissioner Shri O.P.Rawat, Election Commissioners Shri Sunil Arora and Shri Ashok Lavasa, welcomed all former CECs/ECs present. The invitees lauded the Commission for this initiative and expressed the hope that such consultations would become a regular feature.

The deliberations focused on following aspects of electoral management:

  • It was noted that universal use of EVM/VVPAT is a commendable initiative. It was opined that Awareness programmes should be extended to educate all the voters about its benefits. This will help in avoiding any controversy about its use.
  • It was noticed that hate speeches are being used during campaigns which vitiate the political atmosphere. There is an urgent need to control such speeches in larger public interest.
  • It was deliberated to analyse the duration of polls so that the number of phases is reduced. The lesser number of phases will reduce the period of MCC it was noted, which has its implications in multiple phases of elections.
  • The ERO-net was well appreciated. However, the process of voter registration can further be eased after taking cues for the models of voter registration in other successful democracies.
During the meeting, Sr DEC Shri Umesh Sinha also gave a glimpse of current initiatives undertaken by the Commission like Electoral Literacy Clubs, ERO-Net, RO-Net, Grievance Redressal System etc.

Meeting with Political Parties on various electoral reforms

The Election Commission of India has scheduled a meeting with all recognized National State and Political Parties on 27th August, 2018 in New Delhi. Considering that the Political parties are important stakeholders in the Indian electoral system, ECI has been periodically holding consultation meetings with all recognized political parties to elicit their views on various important issues. Election Commission of India has always been keen to strengthen the democratic system of the country by improving its existing electoral system and practices.

All 7 registered National political parties and 51 State political parties have been invited to participate in the meeting.

The agenda for the meeting includes discussion on- fidelity of electoral rollsECI invites the views of all parties on measures to improve the accuracy, transparency and inclusivity of electoral rolls in view of the upcoming elections to Lok Sabha and the State Assemblies.

As regards gender representation in Political Parties and comparative International experience, ECI would invite views on measures that political parties can undertake to encourage enhanced representation of women within the organizational structure of the political party, as well as in the candidate selection for contesting elections to legislative bodies.

On the subject of election expenditure regulation, issues related to Expenditure Ceiling for Legislative Council Elections and Limiting Political Party Expenditure would be discussed. Discussion on enforcement measures to ensure timely submission of annual audited reports, election expenditure reports are also on the agenda.

Election campaign silence period - Inclusion of print media within the ambit of section 126(1)(b) of the Representation of People Act 1951 and Issue of online canvassing to promote or prejudice the electoral prospects of a party/candidate on social media during the last 48 hours before conclusion of polling will also be discussed.

Important issues related to conduct of election ie (a) Alternative Modes of Voting for Domestic Migrants and Absentee Voters; (b) Views and feedback of political parties regarding the operation of the ETPBS scheme; (c) The views and feedback of political parties regarding efforts to encourage electoral participation of Voters With Disabilities, will also be discussed.

Views and feedback of political parties regarding the Commission’s efforts to expand outreach and encourage broad-based, inclusive electoral participation will also be invited.
