Ministry of Home Affairs

Strict compliance of 'Flag Code of India, 2002' and 'The Prevention of Insults to National Honour Act, 1971'

The Ministry of Home Affairs has issued an Advisory to the Chief Secretaries/Administrators of all State Governments/UT Administrations, Secretaries of all Ministries / Departments of Government of India, reiterating to ensure strict compliance of the provisions contained in the 'Flag Code of India. 2002' and 'The Prevention of Insults to National Honour Act, 1971'. The Advisory directs that mass awareness programmes be carried out in this regard and also give wide publicity through advertisements in the electronic and print media.

The Advisory states that the National Flag represents hopes and aspirations of the people of our country and hence should occupy a position of honour. There is universal affection and respect for, and loyalty to, the National Flag. Yet, a perceptible lack of awareness is often noticed amongst the people as well as organizations/agencies of the Government, in regard to laws, practices and conventions that apply to 'display of the National Flag’.

Further, it has been brought to notice of the MHA that on important events, the National Flags made of plastic are also being used in place of paper Flags. Since, the plastic flags are not biodegradable like paper flag, these do not get decomposed for a long time and ensuring appropriate disposal of National Flags made of plastic commensurate with dignity of the flag, is a practical problem. It may also be noted that as per Section 2 of ‘The Prevention of insults to National Honour Act. 1971’ - Whoever in any public place or in any other place within public view burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon or otherwise shows disrespect to or brings into contempt (whether by words, either spoken or written, or by acts) the Indian National Flag or any part thereof, shall be punished with imprisonment for a term which may extend to three years, or with fine, or with both.

The Advisory states that on important national, cultural and sports events, Flags made of paper only are used by public in terms of the provisions of the 'Flag Code of India, 2002' and such paper Flags are not discarded or thrown on the ground after the event. Such Flags are to be disposed of, in private, consistent with the dignity of the Flag. Wide publicity, for not using the National Flag made of plastic, should be made along with its advertisement in the electronic and print media.

A copy each of 'The Prevention of Insults to National Honour Act, 1971' and 'Flag Code of India, 2002' which governs display of National Flag, are available on the links below for strict compliance of the provisions contained in the Act and the Flag Code (copy also available on this Ministry's website www.mha.nic.in).

New Delhi: Chinese products are over-ruling Indian market but it seems that these companies do not have any respect for the flag of the country in which they are spreading their wings.

An incident has been observed in which a Chinese company has sent shoes packed in a box made of Indian flag. The incident is of Kangra district of Himachal Pradesh where the company send the shoes in boxes made of tricolor which surely indicates the public humiliation of national flag.

According to some sources, the merchandisers are trying to woo customers with tri colour but sending shoes in such boxes is surely disgraceful.

As quoted by Jagaran, Himanshu Mishra, co-media person of state, BJP, says that if any such thing has happened then this is national insult and issue will be taken forward to Centre.

According to law, whoever in any public place or in any other place within public view burns, mutilates, defaces, defiles, disfigures, destroys, tramples upon or otherwise shows disrespect to or brings into contempt (whether by words, either spoken or written, or by acts) the Indian National Flag or the Constitution of India or any part thereof, shall be punished with imprisonment for a term which may extend to three years, or with fine, or with both.

We are fast becoming a nation of Nautanki people who do not contribute anything apart from outrage, jingoism and empty rhetoric. Congrats!

Is the flag a sacred religious symbol or something? If flag is mentioned as sacred in authoritative hindu religious texts then Hindu Indians & Hindutvadis are justified to make a big deal out of it. China should apologize to Hindu Indians.

Disgraceful: Chinese company packs shoes in boxes made of Indian flag

What India is going to do about this, is a important subject matter.
But it seems India has no recourse.

Dharamshala: A Chinese company has allegedly disgraced the Indian national flag by packing shoes in boxes bearing the tri-colour.

Additional Superintendent Police, Kangra, Shiv Kumar, said that a ban has been imposed on the sale of such shoes.

"The investigation is underway. We took immediate action under Section 2 of the Prevention of Insults to National Honour Act. We have arrested a person involved in the matter. Some shoe boxes have also been confiscated," Kumar said.

"Prima facie it was found that 'Made in China' was written on shoes and investigation is on in every aspect," he added.

Indian Establishment seems to install full body truck scanners but this wont the situation on ground because of the final border talks which are being held between Republic of India and China.

************

Five full body truck scanners are being procured by the government for installations in cross border trading posts, including Wagah and Uri.

The locations are Attari in Amritsar, Petrapole (Indo-Bangladesh border), Raxaul (Indo-Nepal Border), Poonch-Chakkandabagh and Uri-Salamabad (both along Indo-Pak border).

Thanks. Evidential that India is still a primitive country filled with primitive people with a mindset and mentality.

All these things seems are linked to the border dispute talks between Republic of India and China. Clearly the mindset and mentality is visible .

Police have started investigation after local shopkeepers in Uttarakhand’s Almora said they had been delivered shoes in boxes bearing the Tricolour, allegedly from China.

The boxes have the Tricolour on top and the base carries some letters in Mandarin, police said, triggering speculation among locals that the move was aimed at humiliating Indians amid a tense standoff between the two countries at Doklam.

Almora Senior Superintendent of Police P Renuka Devi said putting the shoes in boxes with the national flag was an insult to the Tricolour and that they were investigating the matter.

Udham Singh Nagar Senior Superintendent of Police Sadanand Date said the police questioned the owner of Tammana Traders in Rudrapur, who said that he bought the shoes from a distributor in Delhi and did not know their place of origin. “We would be questioning the dealer in New Delhi to ascertain the origin of these shoes”, said the SSP.

But the discovery of the boxes has sent the local population into a tizzy.

The case has been filed by the shopkeepers Bishan Bora against the shoe supplier of Rudrapur. Bora claimed as soon as he opened the consignment he found only seven seven shoe pair in proper box and rest of the pairs came in the tricolur box.

“I received the goods on Thursday and when I opened the bags, I was shocked. I called the police, sensing something wrong,” said shopkeeper Bishan Bora, who filed the initial complaint.

Bharatiya Janata Party (BJP) district president of Almora Lalit Latwal asserted the administration swung into action after he intervened. “As soon I received information about the consignment I immediately requested administration to forfeit the boxes and act against those who are involved in insulting Indian flag. It looks like a bigger conspiracy. The party workers will keep an eye on the case until those culprits are not arrested” Latwal said.
