Court order authorising PEMRA to censor TV content challenged

By Hasnaat MailkPublished: May 27, 20175SHARES SHARE TWEETThe PBA lawyer submitted that the IHC had no power or jurisdiction under the Constitution to become a regulator of TV programmes. PHOTO: ExpressISLAMABAD: The Pakistan Broadcasters Association (PBA) has challenged the Islamabad High Court (IHC) order that authorises the Pakistan Electronic Media Regulatory Authority (Pemra) to scrutinise TV content, including dramas and commercials, for obscenity.Barrister Syed Ali Zafar filed petitions in the Supreme Court on Saturday against the alleged violations of the Code of Conduct 2015 by Pemra. In the petitions, he submitted that under the law, Pemra could not act as “monitoring police” and impose, through its regulations, how each channel should run their programmes. On March 17, IHC’s Justice Shaukat Aziz Siddiqi had appointed a committee which was tasked with examining the contents of TV shows, dramas and advertisements. The petitioner objected that the court had no power or jurisdiction under the Constitution to become a regulator of TV programmes.IHC wants blasphemy, pornography sections added to cybercrime lawBarrister Zafar pointed out that the regulatory body was bound by the Code of Conduct 2015 under which media content was controlled by the broadcasters under a self-regulatory regime. He argued that Pemra had breached this code of conduct and contrary to the self-regulatory regime, had issued regulations to control and censor the media against the fundamental rights of the freedom of expression, the freedom of press and the freedom of information enshrined in Articles 19 and 19A of the Constitution.PEMRA tells channels to avoid obscene, controversial content in new directivesIn the petitions, the lawyer submitted that it was only during the dictatorial regime of General Zia-ul-Haq that such “arbitrary and whimsical censorship under the garb of indecency” was imposed on the media and the issuance of these regulations by Pemra was similar to that. The appeal read that Pakistan’s electronic media had fulfilled their role in ensuring that whatever was aired was in accordance with the culture of the country.

Whatever the reason you can not self regulate or else each sector should be allowed to self regulate and there is no need of government.

Sorry bro I do not understand what you mean in your first line.

Also bro What is wrong with stopping obscenity or badklami/badtameezee in Pakistan? I mean if being Muslim these should not be controversial? What do you think?

.
for moral policing

Moral policing happens in UK as well! And many Western secular nations have laws on morals and ethics.

Don't know why you keep on banging about it and want Pakistan to be an exception when rest of the world does already. Maybe you want censorship and laws to be what you personally want them to be!

Our society is not secular yet you want laws that are even more relaxed than the ones in secular societies. That's simply rediculous.

They banned even showing pepsi as alcohol to complete a scene thats just stupid and restrictions apply only on Pakistani channels not channels of foreign origin

Our experimentation with severe censorship started the destruction of our cinema which btw in 60,s was the 4th biggest producer of films in the world

I dont see any badkalami/badtamezi in Pakistani dramas but i do in channels of foreign origin why allow them but not Pakistanis ?Is it fair?

Do they punish over dancing and holding hands?

We are being an exception right now with govt making laws that help foreign channels instead of local one,s

Censorship all over the world is based on the norms within/of that society.

Until a majority wants to allow things that you are in favour of allowing, you'll have to put up with the censorship. That's how it is everywhere.

As for PEMRA, it is dis-functional anyways.

And what part of our norms prevent us from having a quiz show before 9?
Thats just stupid pemra is going full retard and has to be stopped

Majority?Hmm same majority that watches foreign content?
I still fail to see why dance on a show is an issue when half our ads have people dancing in them?
Their laws contradict themselves

This is the same shameless PEMRA that ordered the blackout of Mumtaz Qadri's funeral.
The traitor and terrorist qadri who killed an innocent man to quench his thirst for blood?
