''Through its claims to sovereign rights jurisdiction and to “historic rights” with respect to the maritime areas of the South China Sea, China is failing on at least two counts: respecting the obligations arising from treaties, specifically the United Nations Convention on the Law of the Sea (UNCLOS) and interfering with the Philippines’ sovereign duty to promote the social progress of its people, and its efforts to achieve a better standard of life for all Filipinos.
This was specifically pointed out by Foreign Affairs Secretary Albert F. del Rosario in his Concluding Remarks delivered before the Permanent Court of Arbitration during the second round of oral arguments on the merits in the Philippines’ case challenging China’s claims over almost the entire South China Sea.
Furthermore, Del Rosario, in his impassioned speech, said China is not just interfering with the progress of the Filipino people, but is likewise trampling upon the rights and interests of the peoples of Southeast Asia and beyond through the unilateral actions, and the atmosphere of intimidation Beijing has created.
Addressing the President of the arbitral tribunal Judge Thomas A. Mensah, the foreign affairs chief also argued that China’s massive island building campaign shows its “utter disregard for the rights of other States, and for international law.”
“China started this a year after the Philippines initiated the arbitration,” said Del Rosario.
“It is intent on changing unilaterally the status quo in the region, imposing China’s illegal nine-dash line claim by fiat and presenting this Tribunal with a fait accompli.”
In addition, he pointed out that China’s island building not only undermines regional stability, but also the rule of law and is inflicting massive environmental damage on the most diverse marine environment in the world.
“China has intentionally created one of the biggest emerging environmental disasters in the world,” said Del Rosario.
The stakes are still greater since the Convention’s “Constitution for the Oceans” is itself at risk, he stressed.''
