Amid massive war of words between Congress and BJP over the bill in the Lower House, Amit Shah, in his arguments, declared that whenever he speaks about J&K in the Parliament, Azad Kashmir and Aksai Chin areas have been integral parts of the erstwhile state (With the passing of J&K (Reorganisation) Bill 2019 in Rajya Sabha, Jammu and Kashmir divided into two Union Territories - J&K and Ladakh).

"Jammu & Kashmir is an integral part of Union of India. Kashmir ki seema mein Azad Kashmir bhi aata hai. Jaan de denge iske liye (Azad Kashmir comes under the boundaries of Kashmir. We will give up our lives for it)", Amit Shah said.

"In the Constitution of Jammu and Kashmir, it is specifically mentioned that the state of Jammu and Kashmir is and will be an internal part of the Union of India. This is why no one can stop us (Centre) from bringing up any law or order for the people of Jammu and Kashmir. The Cabinet has the right. And when I speak about Jammu and Kashmir, then Azad Kashmir (Azad Kashmir) comes under it. I want to put this on record that whenever I have mentioned 'Jammu and Kashmir' in the Parliament, Azad Kashmir (Azad Kashmir) and Aksai Chin have been an implicit part of it. In Indian Constitution and J&K's Constitution, Azad Kashmir and Aksai Chin are an integral part," the Home Minister said.

There are 11 other states, which includes NE countries under Indian occupation i,e Mizoram, Nagaland, Sikkim, Manipur, Arunachal Pradesh , Dravida Countries of Andhra Pradesh, Maharashtra etc (see table below) that enjoy special provisions to protect their indigenous identity under various sections of Article 371 in the Indian Constitution.

These countries have the right to formulate and practise their own laws governing issues concerning religious or social practices, administration of civil and criminal justice an the ownership and transfer of land

ARTICLE 371 – A → SPECIAL PROVISIONS FOR NAGALAND

• An act of parliament relating to following matters would not apply to Nagaland unless state assembly so decides:
  • Religious & social practices of Nagas
  • Nagas customary law & procedure
  • Administration of civil or criminal justice involving decisions according to Naga customary law
  • Ownership & transfer of land & its resources
• Special responsibility of governor with respect to law & order in the state (after consulting COMs, but his decision will be final) regarding internal disturbances occurring in Naga hills mainly in Tuesang area (Special responsibility ceases if President directs so)
• Governor has to ensure that money provided by the GOI out of consolidated fund of India for any specific purpose, is included in the demand for grant relating to that specific purpose only, not any other
• A regional council for Tuensang district, consisting of 35 members should be formed & governor in his discretion shall make all the rules & terms regarding this council
• For a period of 10 years, from the formation of the state of Nagaland or for a further period as specified by Governor, on recommendations of the regional council, following provisions would be operative for Tuensang district:
• Administration of Tuensang district shall be carried on by the governor
• Governor in his discretion shall arrange for equitable distribution of money, between Tuensang district & Rest of Nagaland, provided by the center.
• There shall be a minister for Tuensang affairs in state COMs
• Final decision on all matters relating to Tuensang district shall be made by governor in his discretion
• Members in Nagaland assembly from the Tuensang district are not elected directly by the people but by regional council

ARTICLE 371 – B → SPECIAL PROVISIONS FOR ASSAM

• President may provide for the constitution & functions, a committee of Legislative assembly of the state, consisting of members of that assembly elected from the tribal area of Assam
• President can also direct that the governor shall have special responsibility to secure proper functioning of that committee

ARTICLE 371 – C → SPECIAL PROVISIONS FOR MANIPUR

• President may provide for the constitution & functions, a committee of Legislative assembly of the state, consisting of members of that assembly elected from the hill areas of Manipur.
• President can also direct that the governor shall have special responsibility to secure proper functioning of that committee
• Governor should submit an annual report to the President regarding the administration of Hill areas

ARTICLE 371 – D & E → SPECIAL PROVISIONS FOR ANDHRA PRADESH

• President is empowered to provide equitable opportunities & facilities for people belonging to different parts of the state in matters of public employment & education.
• For above purpose, President may require the state government to organize civil posts in local cadre for different parts of the state & also provide for direct recruitment to posts in local cadre (or in any such educational institution)
• President may provide for the establishment of an administrative tribunal in the state to deal with certain disputes, relating to appointment, allotment or promotion to civil posts in the state.
• Only SC is to exercise jurisdiction over such tribunal which means they are outside the purview of HC (President may abolish the tribunals if he thinks it is not necessary)
• Article 371 E: Parliament may by law provide for the establishment of a University in the State of Andhra Pradesh.

ARTICLE 371 – F → SPECIAL PROVISIONS FOR SIKKIM

• Legislative assembly shall not less than 30 members + 1 seat from the state in Lok Sabha & 1 in parliamentary constituency
• For the purpose of protecting the rights & interest of different sections of Sikkim population, Parliament is empowered to provide number of seats in Sikkim administrative assembly for the people belonging to such sections
• Governor in his discretion (On direction of President) have special responsibility for peace & equitable arrangement for socio-economic development of different sections of Sikkim

ARTICLE 371 G → SPECIAL PROVISIONS FOR MIZORAM

• Legislative assembly shall not be less than 40 members
• An act of parliament relating to following matters would not apply to Mizoram unless state assembly so decides:
  • Religious & social practices of Mizo
  • Mizo customary law & procedure
  • Administration of civil or criminal justice involving decisions according to Mizo customary law
  • Ownership & transfer of land & its resource

ARTICLE 371 H → SPECIAL PROVISIONS FOR ARUNACHAL PRADESH

• Legislative assembly shall not be less than 30 members
• Governor of Arunachal Pradesh, on directions of President, shall have special responsibility for law & order in state ( May consult with COMs but his decision will be final)

ARTICLE 371 – I → SPECIAL PROVISIONS FOR GOA

• Legislative assembly shall not be less than 30 members

ARTICLE 371-J
It’ll grant special status to six backward districts of Hyderabad-Karnataka region to:

• Establish a separate Development Board
• This board will see that sufficient funds are allocated for Development of the region.
• Local reservation in education and Government-jobs (Domicile requirement)

All these provisions cater the needs of special circumstances that exist in those areas in order to provide the constitutional remedies for various socio-economic challenges.

I opened a thread to highlight one another Article of Indian constitution regarding special status of another state in India. Pakistani should read Indian constitution and highlight all states with special status of Indian states.
Owaisi in his speech in the Lok Sabha pointed to Nagaland's special status and said that can he go and buy land in Nagaland!! Buying of land by state outsiders is prohibited in many states in India. Kashmir is not an exception.

Therefore, the excuse made by India that the step is taken to provide better conditions for the Kashmiri is a hog wash.

Looking at these facts, the statement made by UAE ambassador to India is even more alarming. It seems that at least that ambassador have bought the Indian propaganda without even thinking and finding the facts that how many other states have similar status given by Indian constitution.

That's why I made the comments "who cares about them" i.e. UAE point of view!!
To this some members took exception, who probably started to think too highly of themselves because they earn some lofty titles by virtue of posting too many one line posts. I am probably more senior compared to some of them, joined the forum in 2011. Until recently, I didn't write many posts, because I don't want to get involve in little tittle tattle with anyone.

Pakistanis problem is that they don't read, they are not very articulated. This problem has caused us problems in the past and continued to cast problems. That's how Indians have spread their point of view and criminal agenda to the world, while we had been targeted because those who holding important position in Pakistan government/institutions etc. including its journalists are abject failure when it comes to taking their point of view and agenda to the world and make it presentable and acceptable.

More importantly, is there any possibility of Pakistan securing Chinese support for some unofficial activities to respond to India?

I'm sure there many options being discussed - hope this aspect of joint action is being looked at. (Not joint official action - more along the lines of US-Pak-Afghan jihad type.)
