AL QADIR TRUST, NOT ALONE

There are, as is usual, extreme, two views on Imran Khan’s recent sentence in Al Qadir Trust case. Imran Khan’s stand is that it is a Trust in which he had no personal vested interest.
2. The truth is we all, including myself, are always either this side or that side, never honestly judicious to the conscious. Our this side and that side keeps jumping from left to right and right to left.
3. Al Qadir Trust is, in effect “was”, a Trust. There is no doubt in its academic and legal position. But what is the truth and naked fact behind? What is Shaukat Khanum Hospital? A similar Trust but is it not a fact that, like stock exchange companies, the controlling power exclusively, firmly and rigidly rests in the hands of Imran and family. Similarly, as unofficially and for all practical purposes PML(N) and PPP are in factual terms family Trusts of sort restricting to inheritance.
4. Trusts in this Region are generally, not all but in most cases, since sometimes established with some “amalgamated” undisclosed interest mainly to evade tax and keep the “asset” in one form or the other under a personal key or a remote control.
5. Al Qadir Trust, likewise, with major controlling power as its Chairman is with Imran Khan and his wife making it an unofficially a family private trust under a legal ambit. Senator Irfan Siddiqui the other day told so far untold story. He writes that there were four Trustees viz Imran, his wife, Zulfi Bukhari and Babar Awan to the Trust at registration. Later two “Resigned” or got resigned leaving the Trust fully in hands of Imran and wife. Trust was for a University in the name of Islam in Jhelum but was registered in Islamabad for certain obvious reasons. Trusts used to be registered under 1882 Trust Act. Imran got a new law introduced that all trusts in Islamabad would get themselves registered anew within six months under a newly made 2019 Trust Law. This Law was only and only for Islamabad leaving rest of Pakistan. “Deliberately” Al Qadir was not re-registered within six months and today legally Al-Qadir Trust is ineffective, non operative. In simple layman’s language it can be said that today Al Qadir Trust is non existing or dead for any of legal operations. This is the same pattern Nawaz Sharif adopted. New SROs got issued in the day, when his ships bringing Itefaq Foundry material got cleared from Customs under this new the newly born baby CROs, next day got cancelled.
6. This tendency is not restricted or limited to Imran Khan. Since quite sometime this strategy has been adopted for certain obvious gains and interest.

The senior intellectual, senior writer and senior Editor late Irshad Ahmed Haqqani wrote a marvelous long column in two series detailing the background and history of the Pakistani community schools abroad. He described how the very first such a school was established with straws early 1950s in Cairo (or perhaps in Damascus) by Pakistan Embassy staff privately for the education of their children. The wives started delivering lessons to the children in one or two house-living-rooms. Soon Indians and other nationalities including British found it an opportunity and sent their children in these two-room called the school. It was wholly a voluntarily free service without any personal interest of the participants and it was entirely a real term a social work. Haqqani writes how this phenomena got popularity and later these Pakistani community schools were opened in other countries. Indians and other nationalities also followed this suite.
8. Irshad further writes that soon with increase of students due to number of Pakistanis going abroad, these schools came in the hands of vested interests. A few years back the newly appointed Pakistani Ambassador replacing long serving teachers, appointed his wife, daughters, daughter-in-law, mother-in-law on higher salaries with questionable qualifications in the same very Damascus School. If old age was not failing, the terminated staff filed court case. Haqqani added that there was a time when educated preferred to get postings in the Customs Department but soon this preference changed towards postings in Pakistani Missions abroad where there were Pakistani community schools as these community schools turned into “gold mines” from where “حِصَّہ بَقَدرِ جُثَّہ ” reached upto “Islamabad”. These were the exact words used in the column. Haqqani disclosed that a few days ago one senior diplomat from Bahrain visited him with tears in his eyes explaining what was happening in one such Pakistani Community Urdu medium School in Bahrain run under the umbrella of Pakistan Government.
9. A similar school commonly known in Bahrain as English Esqool was established. It today is an excellent institution. Mid 1950s some kind elders feeling the problem of Pakistani families with the spirit of doing something for the countrymen started a donation campaign from the Pakistanis. Every one with open arms participated. This school served Pakistani children excellently but today it is unofficially in the hands of one single Pakistani businessmen family whose own business has long crossed the Bahrain’s territorial borders. There is no doubt the school is continuously enduring to enhance delivery, nevertheless it is sometime also enduring to increase its bank account figure which can’t be thought of in a Trust created with true community service spirit. High striding Account balance would flash to the God fearing that it lacks any community serving intent which motivated the elders in1950s. Though to cover there is a Board of Trustees or a Board of Governors nevertheless like Imran Khan a family, whose elder sincerely actively participated in establishing this school, is today the فیصل آباد کا گھنٹہ گھر in decision making. Ask any Pakistani in Bahrain who has or had in the past school going children “whose school” is this one, 75% answer would signaling to one name.

The balance sheet not of this school only but of all Pakistani community schools elsewhere in other countries is also jumping up with speed proving what late Irshad Haqqani said late 1980s that these schools today serve as gold mines. It is the same like Missionary Schools and Hospitals in this whole region have lost the missionary spirit and are today money generating institutions.
Indian Government as well as Indian nationals are known focusing prime and top priority to the education of their children. Kerala State of India is one of the most poor State but literacy rate is 99% - men women both, most hard working, can work untiringly up to 15-18 hours daily that is why preferred in Gulf. They also have community schools of different categories in the Gulf. Indians take deep interest in their children education, monitor their progress, periodically visit schools to know about their children, invariably attend to each parents-management meetings which in case of Pakistanis is almost a waste. Though the Indian community school too had lost community spirit turning towards increase account balance sheets, yet in order that every parent participated, parents run the affairs through a committee elected from amongst the parents.
