    KARACHI: Three people were killed and two passenger buses were torched on late Thursday night as violence erupted in different areas of Karachi, DawnNews reported.

    Panic gripped the city when unidentified armed men resorted to aerial firing in Liyari, Clifotn, Maripur and adjacent areas.

    Miscreants set ablaze two mini buses and also hurled stones on the vehicles near the Boat Basin area.

    Sindh Home Minister Zulfiqar Mirza took notice of the violence and ordered the IG Police to take strict action against miscreants.

    KARACHI: The already tense relations between the ruling Pakistan Peoples Party and the Supreme Court took a nosedive on Thursday after the PPP called for a ‘peaceful general strike’ across Sindh on Friday against the apex court’s verdict invalidating the appointment of the chief of the National Accountability Bureau.
    The call for strike was given by PPP’s provincial secretary-general Taj Haider at a press conference. He was accompanied by Sharjeel Inam Memon, Agha Taimur Pathan and Imdad Ali Pitafi. Terming the day a ‘protest day’, Haider urged transporters, businessmen and shopkeepers to “abide by the strike call”.
    Meanwhile, PPP leaders in Islamabad seem to be contemplating whether or not they should try re-appointing the retired apex court judge, Deedar Hussain, as head of the NAB.
    Two of the PPP’s coalition partners, the Pakistan Muslim League-Functional (PML-F) and the Awami National Party (ANP), dissociated themselves from the strike, claiming that they were not consulted on the issue.
    The Muttahida Qaumi Movement has not yet commented on the development.
    Lawyers criticised the move and said that the strike was “uncalled for” and there were other ways to handle the situation. The Karachi Bar Association’s Haider Imam Rizvi and Muhammad Aqil said that courts would remain open on Friday.
    Aqil said that a protest would set a precedent and everyone would protest when a court rules against them.
    A three-judge bench of the Supreme Court, headed by Justice Javed Iqbal, said in a short order that the appointment of a retired judge, Justice Deedar Hussain Shah, as the chairman of the National Accountability Bureau (NAB) was illegal and a violation of the Constitution. Shah was “ordered to cease the office forthwith”
    The PPP leadership, however, seems to feel that the decision by the court was hasty. Attorney General Maulvi Anwarul Haq said that court’s short order on his removal does not mention the grounds on which the appointment was considered unconstitutional. It is partly due to this that the talk of a possible re-appointment even began.
    “We are waiting for the detailed verdict. The appointment can be made after the court releases detailed decision,” Attorney General Maulvi Anwarul Haq told The Express Tribune.
    Under the 18th Amendment to the constitution, the prime minister is required to consult with the parliamentary opposition leader, in this case Chaudhry Nisar Ali Khan of the Pakistan Muslim League Nawaz (PML-N) faction, before appointing the chairman of the NAB. Chaudhry Nisar rejected Deedar Hussain’s appointment when he was first nominated. When the PPP appointed him anyway, Nisar sued.
    The National Accountability Bureau was created under the administration of former President Musharraf. The position of its chairman has always been deemed controversial since the chairman can decide to ‘selectively’ pursue accountability cases against the opposition. Partly to remove the controversy, the 18th Amendment to the constitution required the prime minister to consult the opposition before making the appointment.
    Chaudhry Nisar claims that his background makes Deedar Hussain a biased partisan. He claimed that he was not consulted before the appointment was made.
    Deedar, 71, is from Larkana, a stronghold of the PPP and was considered one of the closest friends of the party’s founder Zulfiqar Ali Bhutto.     پاکستان پیپلز پارٹی کی جانب سے نیب کے چیئرمین ریٹائرڈ جسٹس دیدار حسین شاہ کی تقرری کو کالعدم قرار دیے جانے کے عدالتی فیصلے کے خلاف جمعہ کو سندھ بھر میں ہڑتال کے اعلان کے بعد کراچی میں حالات کشیدہ ہوگئے ہیں اور شہر میں فائرنگ کے واقعات میں ایک شخص ہلاک اور چار زخمی ہوگئے ہیں۔

    پاکستان کے صدر آصف علی زرداری نے اکتوبر دو ہزار دس میں سپریم کورٹ کے ریٹائرڈ جج سید دیدار حسین شاہ کو نیب کا نیا چیئرمین مقرر کیا تھا۔

    تاہم جمعرات کو ان کی تقرری کے خلاف دو الگ الگ درخواستوں کی سماعت مکمل ہونے پر سپریم کورٹ کے تین رکنی بینچ نے اپنے مختصر فیصلے میں اس تقرری کو غیر قانونی اور غیر آئینی قرار دیا ہے۔

    نامہ نگار ریاض سہیل کے مطابق عدالتِ عظمٰی کے اس فیصلے کے بعد کراچی میں پریس کانفرنس کرتے ہوئے پیپلز پارٹی کے میڈیا سیل کے انچارج اور رکن صوبائی اسمبلی شرجیل انعام میمن نے جمعہ کو ہڑتال کرنے اور احتجاجی جلوس نکالنے کا اعلان کیا۔

    جامعہ کراچی نے جمعہ کو مجوزہ امتحانات ملتوی کرنے کا اعلان کیا ہے جبکہ پاکستانی ذرائع ابلاغ کے مطابق شہر کے سرکاری و نجی تعلیمی ادارے بھی جمعہ کو بند رہیں گے۔
    انہوں نے جسٹس (ر) دیدار شاہ کی تعیناتی مسترد کرنے کو ناانصافی قرار دیا۔ شرجیل میمن نے کہا کہ عدالت نے ہمیشہ دوہرا معیار رکھا ہے۔ انہوں نے تاجروں سے اپیل کی کہ وہ جمعہ کو کاروبار بند رکھ کر اپنا احتجاج ریکارڈ کرائیں۔ ان کا یہ بھی کہنا تھا کہ پیپلز پارٹی کے ارکان صوبائی اسمبلی جمعہ کو اجلاس میں سیاہ پٹیاں باندھ کر شریک ہوں گے۔

    ادھر ہڑتال کے اعلان کے بعد جمعرات کی رات شہر کے مختلف علاقوں میں فائرنگ کا سلسلہ شروع ہوگیا جس میں پولیس ذرائع کے مطابق ایک شخص ہلاک اور کم از کم چار لوگ زخمی ہوگئے ہیں۔

    اسی دوران کراچی میں صدر آصف علی زرداری کی رہائش گاہ بلاول ہاؤس کے قریب دو مسافر بسوں کو بھی نذر آتش کیا گیا ہے۔ عینی شاہدین کا کہنا ہے کہ موٹر سائیکلوں پر سوار نوجوان دکانداروں کو کاروبار بند رکھنے کے لیے کہہ رہے ہیں، جس دوران پولیس کی مزاحمت یا مداخلت کہیں نظر نہیں آرہی۔

    کشیدگی کے دوران ملیر، صدر، برنس روڈ، ناظم آباد اور ٹاور کے علاقوں میں فائرنگ کی گئی ہے۔ فائرنگ کے واقعات کے بعد برنس روڈ اور بوٹ بیسن کے علاقے بند ہوگئے ہیں جہاں رات کو لوگوں کی چہل پہل ہوتی ہے۔

    کراچی، اورنگی ٹاﺅن کے مختلف علاقوں میں ایک بار پھر مورچے بن گئے، قصبہ کالونی، علی گڑھ کالونی اور آفریدی کالونی میں موٹرسائیکل سواروں کی فائرنگ کا سلسلہ جاری رہا، جبکہ پہاڑوں سے بھی آبادی پر فائرنگ کی گئی، 24 گھنٹے میں 7 افراد کی ہلاکت کے بعد علاقے کا کنٹرول رینجرز کے حوالے کردیا گیا، علاقے میں تمام دن کاروبار بند رہا، جمعرات کی صبح بھی مختلف علاقوں میں سخت کشیدگی تھی جبکہ مومن آباد، فقیر کالونی میں فائرنگ سے جماعت اسلامی کے کارکن عبدالغفار کی ہلاکت پر شباب ملی کے کارکنوں اور علاقہ مکینوں نے مومن آباد تھانے کا گھیراﺅ کرکے رینجرز کے خلاف نعرے بازی کی۔ مظاہرین عبدالغفار کی ہلاکت کا مقدمہ رینجرز اہلکاروں کے خلاف درج کرانے کا مطالبہ کررہے تھے

    کراچی، پاکستان پیپلز پارٹی سندھ نے چیئرمین نیب کے حوالے سے سپریم کورٹ کے فیصلے کے خلاف کل (جمعہ) کو ہڑتال کا اعلان کیا ہے۔ اس بات کا اعلان پیپلز پارٹی سندھ کے رہنماءتاج حیدر نے کیا۔ انہوں نے کہا کہ ہم عدلیہ کا احترام کرتے ہیں لیکن چیئر میں نیب کے حوالے سے سپریم کورٹ کے فیصلے کے خلاف کل سندھ بھر یوم احتجاج منایاجائے گا اور ہڑتال کی جائیگی۔ اس موقع پر انھوں نے عوام ،تاجر برادری اور ٹرانسپورٹر سے اپیل کی کے وہ ہڑتال میں شریک ہوں اور اپنا کاروبار بند رکھیں۔انھوں نے کہا کہ پیپلز پارٹی عدلیہ کا احترام کرتی ہے اور جمہوری انداز میں اپنا احتجاج ریکارڈ کرائے گی۔

    ان کا کہنا تھا کہ سپریم کورٹ کے فیصلے کے خلاف کل پیپلز پارٹی سندھ بھر میں یوم احتجاج منائے گی اور اس موقع پر ٹرانسپورٹ اور کاروبار کی بندش کیساتھ ساتھ عدالتی کاروائی کا بھی بائیکاٹ کیا جائے گا۔جبکہ پاکستان پیپلز پارٹی کے رہنماءاور رکن سندھ اسمبلی شرجیل میمن کا کہنا تھا کہ سپریم کورٹ کے فیصلے کے خلاف آج سندھ بھر میں یوم احتجاج منایا جائیگا، جبکہ سندھ اسمبلی میں اس فیصلے کے خلاف مذمتی قرار داد بھی پیش کی جائیگی۔ انھوں نے کہا کہ ایک صوبے کے ساتھ ناروا سلوک کیا جارہا ہے اور عدالتوں پر حملے کرنے والوں کو کچھ بھی نہیں کہا جارہا ہے، انھوں نے کہا کہ ملک میں دہرے معیار نہیں چلے گئے ،حکومت ہم نے چلانی ہے عدالتوں نے نہیں۔

    واضح رہے کہ جمعرات کو سپریم کورٹ کے جسٹس جاوید اقبال کی سربراہی میں جسٹس راجہ فیاض احمد اور جسٹس آصف سعید خان کھوسہ پر مشتمل تین رکنی بینچ نے چیئرمین نیب دیدارحسین شاہ کا تقرر کالعدم قرار دیتے ہوئے انہیں عہدہ چھوڑنے کی ہدایت کی تھی جس کے بعد ذرائع کا کہنا ہے کہ انھوں نے اپنا عہدہ چھوڑ دیا ہے ۔ چیئرمین نیب کے تقرر کے خلاف قائد حزب اختلاف چوہدری نثار علی خان اور شاہد اورکزئی نے الگ الگ درخواستیں دائر کی تھیں۔ درخواست گذاروں کا موقف تھا چیئرمین نیب کا تقرر کرتے وقت چیف جسٹس، اپوزیشن لیڈر اور وزیر اعظم سے مشاورت نہیں کی گئی اس لئے یہ تقرر غیر قانونی ہے۔ جسٹس دیدار حسین شاہ ریٹائرڈ کو 8 اکتوبر 2010ءکو چیئرمین نیب تعینات کیا گیا تھا۔ سپریم کورٹ کی جانب سے چیئرمین نیب دیدار حسین شاہ کو ہٹانے کے فیصلے کے خلاف پیپلز پارٹی سندھ نے کل صوبے بھر میں یوم احتجاج کا اعلان کرتے ہوئے ٹرانسپورٹرز اور تاجروں سے کاروبار بند رکھنے کی اپیل کی ہے۔

    ISLAMABAD: As night fell, speculation about a new round of confrontation between the judiciary and the executive picked up pace as the government decided to challenge the Supreme Court decision to remove National Accountability Bureau (NAB) Chairman Justice (retd) Syed Deedar Hussain Shah.

    The removal of the chairman, who has served only for five months, seemed to be a fait accompli on Thursday afternoon as Mr
    Shah quietly relinquished charge.

    When the order came at around 3:30pm, the NAB chairman was in the office. He was provided the information by a NAB official present in the court. Within half an hour, the chairman had left the office and his actions gave the impression the
    government had decided to accept the decision of the court.

    However, by the evening the situation appeared different. “The government is consulting its legal team on the issue,” Information Minister Dr Firdous Ashiq Awan told Dawn. She did not provide any details.

    That the government was in the mood to challenge the court’s order was also obvious from the reaction of the PPP, Sindh. Taj Haider, who is secretary general of the party in Sindh, called a strike in the province on Friday to protest the court’s decision.

    He asked that shops be closed and lawyers boycott the lower and high courts.

    But as the PPP is now in the habit of doing, the leadership in the centre refused to explain whether or not the call given by Mr Haider was backed by the entire party. Ms Awan refused to comment on the call, saying the decision might have been taken at the party level.

    When contacted, PPP Secretary Information Qamar Zaman Kaira said the call was given by Mr Haidar in his capacity as the provincial secretary general of the party. However, he was reluctant to clarify whether or not the call would be backed by the entire party. “I can’t say that it is the party line,” he said.

    Sources in the party said the top PPP leadership believed that the removal of Deedar Hussain Shah was contrary to the NAB Ordinance.

    The government believes that it acted according to the National Accountability Ordinance (NAO 1999) and that the court order did not follow the prescribed procedure for the removal of NAB chairman.

    This is because under the NAB Ordinance, the bureau’s head can be removed through a procedure similar to the one followed for the removal of a judge of the Supreme Court. In other words, the case pertaining to the removal of the prosecutor general and also the chairman is sent to the Supreme Judicial Council (SJC) along with the reasons for asking for such a decision. Once the council has taken a decision, the case is sent to the president for the final nod.

    The appointment of NAB chairman on October 8, 2010 became a bone of contention between the government and the PML-N, the main opposition party, because of the two’s varying interpretations of the law.

    Under the NAB Ordinance, the government has to consult with the leader of the opposition in the National Assembly for the appointment of the chairman.

    The PML-N claimed that the consent of the leader of opposition in the National Assembly, Chaudhry Nisar Ali Khan, had not been sought in a ‘meaningful’ way as laid down in the ordinance.

    The government was of the view that it only had to consult the opposition but not get its agreement in the matter.

    Justice (retd) Shah was the first chairman of the NAB to belong to the judiciary. He had served as a judge of Supreme Court and Chief Justice Sindh High Court.

    The government is also considering replacing the NAB with the National Accountability Commission by May this year.

    Zardari holds meeting

    After the Supreme Court’s verdict ordering immediate removal of Justice Shah as NAB chairman, President Zardari presided over a meeting at the presidency and decided to fill the vacant post soon. Law Minister Babar Awan attended the meeting.

    Some private TV channels reported that the government had decided to reappoint Justice Shah as NAB chief.

    However, presidential spokesman Farhatullah Babar neither confirmed nor denied the report.

    KARACHI: As Karachi braced itself for a strike called by the Pakistan People`s Party in protest against the Supreme Court verdict annulling the appointment of Justice (Retd) Deedar Shah as NAB chairman, tension gripped various parts of the city on Thursday night when armed men on motorbikes roamed the streets in different commercial areas, scattered incidents of arson were reported and gunfire claimed the life of a political worker and left several people injured.

    Armed men intercepted two buses near Bilawal Chowrangi, at a stone`s throw from the Bilawal House, the camp office of President Asif Ali Zardari. They asked the passengers to get off and set the vehicles on fire.

    “Two fire-tenders took nearly half an hour to put out the fire,” an official at the DHA fire station said. The Clifton police kept quiet about the identity of the perpetrators and reasons behind the incident that took place in the heavily-guarded locality and spread panic leading to a complete shutdown.

    Within a couple of hours, four more vehicles were torched in different areas.

    A bus was set ablaze in Ranchore Line area and another two buses met the same fate near Kakri Ground and Juna Masjid in Lyari. A truck was intercepted and set on fire on the ICI Bridge.

    A local leader of the PPP was gunned down in Garden area. Tariq Lashkari, 52, was reportedly attacked when he was going home in Hasan Lashkari village.

    Reports of gunfire were received from old city areas, including Lyari, Kharadar and Ranchore Line.

    An official at the medico-legal section of the Civil Hospital said the emergency unit had received five people with bullet wounds from the areas.

    A policeman and a 13-year-old boy were among them. Traders in commercial areas of Burns Road, old city, some blocks of Gulshan-e-Iqbal, Malir and Gulistan-e-Jauhar pulled the shutter down because of the movement of armed men on motor-bikes.

    The sense of fear among the people deepened when the University of Karachi came up with a late-night announcement postponing all examinations scheduled for Friday.

    The university administration gave no reason for the decision.

    The Sindh education ministry later announced that all educational institutions of Karachi would remain closed because of `unrest in the city and for the safety of the students`.

    Earlier in the day the PPP appealed to transporters, traders and the business community to observe a peaceful protest on Friday to register anger against the Supreme Court`s decision.

    Talking to a TV channel, Sindh Government`s Media Coordinator and Sindh PPP general secretary Taj Haider made a passionate appeal to traders and transporters to observe a peaceful protest.

    Earlier, addressing a crowded press conference at the PPP Media Centre in Clifton, Sindh Assembly members Sherjeel Memon, Javed Shah, Imran Leghari and Imdad Pitafi announced that protest rallies would be held across the province.

    They also appealed to transporters to observe a strike and traders to keep their businesses closed.

    They said MPAs would wear black armbands, adopt a resolution against the verdict and hold a march from the Sindh Assembly building to the Sindh High Court.

    The MPAs alleged that those who had attacked the Supreme Court in the past were getting decisions of their choice. They said Thursday`s court decision had hurt the feelings of the people of Sindh and they would not accept such decisions.

    However, the business community disassociated itself from the strike.

    The chief of the Karachi Chamber of Commerce and Industry, M. Saeed Shafiq, said: “We cannot support the strike or protest which is bound to cause a production and revenue loss of Rs4-5 billion a day.”

    He said many traders had complained that some armed men had warned them to keep the shops and markets closed on Friday.

    The chairman of the Alliance of Market Associations, Atiq Mir, said the strike call was tantamount to contempt of court and that all markets and shops would remain open.

    In case of violence as a result of a strike call, the persons/gfroup/party responsible for calling/arranging/participating in strikes should be held accountable and charged with the crimes as though they were actually carried out by the persons who called the strike.

    Strike across Sindh on PPP’s call; two killed in Karachi

    KARACHI: At least two people were killed in incidents of gunfire in Karachi and several were wounded as a strike called by the Pakistan People’s Party was being observed across the Sindh province on Friday, DawnNews reported.

    Over nine vehicles were also set ablaze by unknown assailants.

    Friday’s strike was called to protest against the Supreme Court verdict annulling the appointment of Justice (Retd) Deedar Shah as NAB chairman.

    Moreover, all educational institutions of Karachi remained closed after an announcement by the Sindh education ministry.

    W are paying the price for being in Sindh. I wish we were our own province. Karachi should have maximum autonomy. I honestly don't want Islamabad or some guy from Larkana or Umerkot making decisions for my city.
