Model Court decides 11 cases in 10 days

MARDAN: The Model Criminal Trial Court has decided 11 cases since its establishment on April 1.

On the directive of Supreme Court of Pakistan, a Model Criminal Trial Court started functioning in Mardan district on April 1. According to a statement issued on Thursday, additional district and sessions judge Nadia Syed was appointed the first judge of the model court.

The court, while conducting trials speedily on day to day basis in line with the NJPMC policy, has so far decided eight oldest narcotics and three murder trials in a short span of 10 days, which were lingering for the past several years.

The statement stated that 14 people have been acquitted in these cases due to insufficient and doubtful prosecution evidence while two persons were convicted and sentenced to life imprisonment and a fine of Rs100,000 in the murder cases.

Lawyers go on strike against model courts

RAWALPINDI/LAHORE: Lawyers stayed away from Rawalpindi and Lahore courts Thursday as they observed strike on the call of Pakistan Bar Council (PBC) against formation of model courts across the country and non-restoration of 22-A and 22-B to its past position.

The lawyers did not appear in civil, criminal, special and sessions courts and the hearings of cases in these courts were adjourned without any proceeding. The people who came from far flung areas had to suffer severely due to lawyers’ strike. While expressing their concern and surprise on strike call on every Thursday, the clients said that on the one hand speedy and inexpensive provision of justice was pledged and on the other lawyers are holding strike which is beyond understanding.

On the other hand the leadership of lawyers said that their protest would continue till the restoration of 22-A and 22-B to its past position and removing of reservations of lawyers regarding formation of model courts.

Meanwhile, lawyers of the Lahore Bar Association on Thursday observed a partial strike against the National Judicial Policy Making Committee’s decision over the registration of cases under Sections 22-A and 22-B of the Criminal Procedure Code (Cr.P.C).

Most of the lawyers didn’t appear in courts due to which many case were adjourned without any development. The National Judicial Policy Making Committee had decided that the applications under the 22-A and 22-B of the Criminal Procedure Code might not be entertained by courts unless they were accompanied by a decision of the relevant district superintendent police.

If cases are resolved too quickly, then these lawyers would be deprived of their fees. Disgusting, abhorrent, repugnant profession......

This entire system from investigation to prosecution to defense to judges is corrupt and rotten to the core.

Who will remove this system. Is anybody in a nation of 220 million brave enough to challenge the mafia of judges and lawyers???

    Young Pak, my dear friend,

The blackcoat gangsters are nothing but street hustlers... instead a chamber being a source of legal excellence ... it has become den of criminals.... a kind of #EconomicTerrorists .

What is the root-casuse of all these acts?

Look at pharma... and how doctors push for drugs... and then get a cut from sales.

Look at media... how 'jounralists' push a particular narrative... and get paid... in flesh, liquid, houses and free travels.

Look at bureaucracy... how 'servant of state' have become servants of #CriminalEnterprise... even before Dollar-Rupee pricing is announced by the PSB... some from FinMinistery and PSB will inform dollar traders in Karachi and Lahore... getting their cuts...with their wives having foreign nationalities...

Look at IB, FIA, NAB, FBR, CDA, Courts, Police...on and on... The 'system' is fully compromised... a total Instiuitional Capture.

    #CriminalEnterprise thrives on human misery...

    Rootcause?

I do believe a 20/80 Rule will be necessary as first fix... Take out the 20% top corrupts in all aspects in the current system in all aspects... make them an example for the 80%.... you shall see a remarkable change.

Revolutions are bloody business. Most revolutions fail... one oppression is replaced by another.

What is needed is change in the sytem.

What was the purpose which made millions to migrate and loose life and property?

What is the purpose of current Pak State and Pak People? Is there any purpose?

Devil's Advisory Council spreads choas and sells illusions....in the name of freedom, justice and equality. Liberals are as dangerous as religious extremists...both are against nature.

The current system is collapsing. PMIK cann't bring change.. he has the entire system against him..including people around him.

He must press the Kill Switch!

Never loose Hope! Hope is the Agency of Life.

    Regards,

    Mangus

Completely agreed. This system can never be reformed. If anybody thinks that this corrupt system can be reformed, then he is a fool.
A new system is needed. Time is running out.

Sucking up of ministers and justices to their nephews and kids in police and administrative service of Pakistan. The new judicial reforms are centred around giving unchecked power to the executive and further depriving the underdog - - - - - -.

We need to go back to the Qazi system, where a judge sits down, listens to both sides, does the questioning and makes the judgement. The whole proceeds should be recorded and copies given to anyone who wants to file an appeal. Justice should not require a lawyer - the process should be straight forward enough so that normal people can easily get justice.

The whole point of "Lawyer Profession" is to lie and instead of talking on evidence, they talk on "Legal Complexity". The single most corrupt and disgusting profession ever created in the history of mankind.

    لَّعۡنَتَ اللّٰهِ عَلَى الۡكٰذِبِيۡنَ‏
"And so lay curse of Allah upon those who lie". (Surah al Imran; ayat 61)

Agreed. People keep on repeating the mantra of Corruption, Corruption, Corruption!!! But never every think to consider, that the root cause of corruption in Pakistan is this Judicial System.
If there is no justice in a society, then that society can never progress.

Model courts: Lawyers to go on countywide strike on 25th

KARACHI: The All Pakistan lawyer representatives’ conference on Saturday announced countrywide boycott of court proceedings on April 25 against ‘unjustified’ decisions of the National Judicial Policy Making Committee (NJPMC) about the sessions court powers and establishments of model courts.

Addressing all Pakistan lawyers representatives’ conference at the Karachi Bar Association, the lawyers’ leaders announced boycott of model court proceedings and warned cancelling the licenses of lawyers appearing in the model courts.

Supreme Court Bar Association President, Amanullah Kanrani said the Constitution was supreme and all decisions should be made strictly in accordance with the Constitution.

President Sindh High Court Bar Association (SCBA) Mohammad Aqil said the ‘unjustified’ decision of the NJPMC about withdrawal of Section 22-A,B of CrPC was not acceptable to them.

Former president of SCBA Justice (R) Rasheed A Razvi said lawyers always struggled for the rule of law and

    supremacy of the Constitution.

He said a conspiracy had been hatched against the Supreme Court Judge Justice Qazi Faez Essa and lawyers will have to unite to foil all such conspiracies.

Karachi Bar Association President Naeem Qureshi said model courts was negation of the judicial system and lawyers will not allow any proceedings against the spirit of natural justice.

He said lawyers from all over Pakistan will stage protest demonstrations at the Supreme Court for acceptance of their demands.

Pakistan Bar Council member Hafiz Mohammad Idrees said lawyers will hold protest demonstrations and a sit-in at the Supreme Court until withdrawal of ‘unjustified’ decisions of the NJPMC.

Representatives of the Punjab, Khyber Pakhtunkhwa, and Balochistan bar councils also demanded immediate withdrawal of the NJMPC decisions about sessions court powers under Section 22-A,B of CrPC and establishment of model courts.

Or better yet. We go back to old model which was here before the British arrived and use to give speedy, swift and free justice i.e. Qazi Courts. Remove the profession of lawyers altogether.
