Karachi courts closed for a third day as lawyers protest police’s new ‘powers’

    Karachi civil courts were closed for a third day on Wednesday as lawyers continue to protest what they say is the top judge’s decision to increase the powers of the police to register FIRs.

    They said they were reacting to a “change” made on March 11 by the National Judicial (Policy Making) Committee that they interpret as restricting the powers of judicial officers who could previously order the police to register FIRs

    Many lawyers earn money by taking up such cases, explained a lawyer. “What will they do if even this is taking from them?”

    The lawyers sat on faded maroon sofas outside the Karachi Bar Association. The Sindh High Court had a slow day too as judges didn’t hear many cases.

    The strike, which started on March 16, is going to continue till Friday. The courts are expected to be closed on March 23 (Saturday) on account of Pakistan Day.

    “They may open on Monday,” a lawyer said. “We don’t know as yet,” she added.

    The courts opened on March 19. “So many cases will go into pending if the judges don’t hear them,” another lawyer remarked.

    What are they protesting?

    Court officers were empowered to register police cases under sections 22(A) and (B) of the Code of Criminal Procedure. They would do this if someone came to them with the complaint that the police were not registering an FIR. And so, the law had allowed district and sessions judges to act as “Justices of the Peace” and order the registration of an FIR if the police refused to file one.

    The secretary of the National Judicial (Policy Making) Committee clarified, however, that a piece of news about Section 22-A(6) has been misinterpreted by the media and some sections of the bar councils and associations. Dr Muhammad Raheem Awan said in a press statement that an office of SP (Complaints) has been created in every district as part of a “police redressal mechanism” to increase internal accountability. The new rule doesn’t take away the powers of the civil courts, the statement said.

    “An aggrieved person can still lawfully approach a Justice of the Peace or a high court in respect of a complaint against the police after the SP doesn’t register the complaint,” the statement added.

    Lawyers earn money by adjournments,if speedy trial is conducted,how they are suppose to earn money.Lawyers have hijacked judicial system of Pakistan.
    If you ever go to a court in Pakistan,you will see how they are sitting on land grabbed from government and using it as their offices.

    Unfortunate but necessary! Instead of making these short steps the authorities should straight out make it a police state. Disband judicial institutions and confer each and any power upon the DCs and secretaries, like the good ol days . All problems solved.

    Now the millions souls will have to wait for a single sp sahab to get their fir registered if the sho is not interested lodging any.

    Aik maheena zalalat or brh gy - - - - - - - usually the sp is only available when a complainant approaches him atleast through an MPA

    They compliment each other. To get rid of the lawyers you need to get rid of the cops

    then the other route is still valid...So back to my question...what is the strike about? Hijacking the juridical system?

    Looks convenient? he won't be able to approach the sp sahab and even if he does after a month or so what novel thing this new route offer when the complaint will eventually has to approach the additional sessions judge?

    I think the only novel thing is that there is more than 1 route to get to the same end...more routes is good, no?

    Yeh doodh b dayty hain to mayngny daal k,

    it's like asking an ordinary entrepreneur to contact the prime minister if the DC denies issuing any license and only after then approach the judicial forum when you get thoroughly exhausted not before that

    I think it is clear that the "before that" route still exists!

    1) OFFICE OF SP COMPLAINTS
    2) Previous powers of civil court still exists!

    Just an extra route added!

    I personally wont like to stand under the scorching sun waiting for the sp to summon me into his office. Screw the police and those snatching our civil liberties

    1) the SP OFFICE (for all we know there would/ should be people sitting there to help the public rather than the SP himself dealing with multitudes of such cases
    2) The old route is not closed/ dismissed...
    So, back to my question: what is the strike about? Is it about the fact that now lawyers would get less clients since there is an alternative route thus ending the lawyer mafia?

    My question is what was the need of adding shit to the honey?

    Some clerks will have the pockets warm and the police cadre will brag about their neo powers - - - - - - - - pre 1999's days are not coming back
