MUMBAI: An Indian official says a court has barred a Pakistani delegation from interviewing the man convicted of the 2008 terrorist attack in Mumbai and any of the witnesses in his trial.

The delegation came to India to gather evidence for use in the prosecution of seven militants on trial in Pakistan over the attack that killed 166 people.

A court official said an Indian judge told the delegation Friday it would not be allowed to talk to lone surviving gunman Ajmal Kasab or any other witnesses.

The court official spoke on condition of anonymity because he was not supposed to discuss the closed hearing. The group interviewed the magistrate who recorded Kasab’s confession and was to speak to the doctors who autopsied the nine slain attackers.

There is no way you can convict a Pakistani citizen for a crime conducted in India over the testimony of a Pakistani attacker in India who is not allowed to speak to the judicial team gone to collect evidence, where the testimony is not allowed directly, but given by an Indian who is passing it down from the Pakistani attacker.

How messed up is that? Which court of law would allow such a thing?

Not news. What do you think Pakistan has done to merit such a meeting, anyway? Who here thinks that Pakistani officials would be honest and complete in their accounts of such a meeting? Isn't it more likely that the meeting would be followed by unproveable (if not utterly false) claims from such officials to their own or Pakistan's political advantage? Or perhaps the Pakistanis would say or do something to make prosecution more difficult, like threatening or poisoning Kasab or the witnesses?

There is too much bad faith demonstrated by the Pakistani side to merit such meetings. Pakistan, you're just not worthy.

In the last moment if Pakistani counterpart asks him what info he has given to the investigators, and after meeting them he reverses his statement under some pressure of fear for his family, etc.. we will lose an upper hand in the trial.

hmmm now this is really interesting btw indian denied us to cross exam him or other witnesses ... and am sure indian official would have been present if such cross exam would have taken place.. so the question of passing info & putting pressure on him dies....

it is only then ruled out if Pakistani counterpart has not spoken to him directly. Even if they speak to him directly in the presence of Indian officials and he says he was forced to be guilty ( as may be he was taught to say that in the presence of Pakistani officials during the training) then? The Pakistani officials will report it the same minute to Islamabad.
