ISI “biggest violators” of law

Islamabad: Pakistan's Supreme Court on Thursday rapped the ISI and Military Intelligence over the replies submitted by them about the detention of 11 men on terrorism charges, calling them the "biggest violators" of the law.

A three-judge bench headed by Chief Justice Iftikhar Chaudhry voiced its reservations while hearing the case of the 11 men who were detained by the intelligence agencies in May 2010 after being cleared by an anti-terrorism court.

The bench expressed its dissatisfaction with the written replies submitted by the intelligence agencies, in which they alleged the men were involved in several acts of terrorism, including attacks on the Army's General Headquarters in 2009 and an ISI facility in Rawalpindi in 2007.

During the hearing, the bench observed: "You need to take this out of your mind that you (ISI and Military Intelligence) are superior and others are inferior."



The Chief Justice asked Raja Irshad, the lawyer representing the ISI and Military Intelligence: "Under which law have you been detaining them?"

Irshad evaded the query and said the court's concerns were "being conveyed to the authorities concerned."

The Chief Justice further remarked that the intelligence agencies should act within the limits of law as they were not "above the law".

He referred to the intelligence agencies as the "biggest violators" of the law, saying they had become "insensitive" to issues.

Four of the 11 men detained by the intelligence agencies have died in mysterious circumstances over the past six months, while the others were in very poor health when they were produced in the apex court on February 11. The seven men were unable to walk or stand without help and some of them carried urine bags.

The Supreme Court took up the matter after Ruhaifa, the mother of three of the detained men, filed a petition.

One of Ruhaifa's sons died last year and she herself died a day after the seven detainees were produced in court.

The two intelligence agencies had contended in their replies that they could not close their eyes to "rebellious acts" by internal and external elements involved in terrorism.

But the bench said the replies did not state the law under which the civilians were picked up and kept in detention for over a year.

The Chief Justice remarked: "We have to see why four prisoners lost their lives."

Raja Irshad referred to sacrifices made by the intelligence agencies but the Chief Justice responded by saying that only the Constitution can be followed.

Irshad defended the intelligence agencies and said Parliament should pass more effective anti-terrorism laws to ensure that suspects are not acquitted on the basis on insufficient evidence.

At this point, the Chief Justice said evidence must be produced before any detainee can be found guilty.

"They may have attacked General Headquarters or (an ISI facility), but bring the evidence," he said.

The Chief Justice also questioned Irshad about alleged human rights abuses in Balochistan, where security agencies have been accused of killing and detaining hundreds of members of nationalist groups to put down an insurgency.

"Dead bodies are being found and Balochistan is on fire," he said.

Irshad said the intelligence services accepted the Constitutional authority of the judiciary and that the seven detainees were being provided medical care at a hospital on the court's orders.

However, the Chief Justice continued his criticism of the intelligence agencies.

"You are so insensitive to the human loss that the families of the missing persons have suffered because of you. This is a big allegation against you (ISI and Military Intelligence) - there is a hue and cry throughout the country that you abduct people and after some days, their abandoned bodies surface," he said.

The bench subsequently adjourned the case till March 16.

Those picked up by ISI cannot be onnocents...this much is sure.
 
ISI is the only ones protecting Pakistan. Too many enemies of Pakistan these days in Afghanistan infiltrating into our western provinces. ISI must do anything it can for saving Pakistan.

ISI is the only ones protecting Pakistan. Too many enemies of Pakistan these days in Afghanistan infiltrating into our western provinces. ISI must do anything it can for saving Pakistan.

If those picked by ISI are not innocents, then according to the law, ISI will have to prove it in the courts. It is as simple as that.

You cannot detain people for indefinite time just because you had a hunch that they were terrorists. It is time that we as a nation get our priorities right which in this case is letting the courts decide about the fate of those missing persons.
 
In this particular case I am with ISI and against the courts. Cases are thrown out on minor technical grounds such as that name of the accused was not mentioned in the original FIR or that FIR was registered too late! Pray tell me how can you name the person when you don’t know who has done it?

This has been borne true by the number of people who are obviously guilty of terrorism go scot free. Case of Lal Masjid is a glaring example of partiality of the court towards the criminals. Didn’t everyone see that these people were fighting the State of Pakistan with gun? What other proof is needed?

However leader of the group Mulla Abdul aziz is free will soon be leading the prayers again. I would put the blame squarely on the courts for letting the know criminals to perpetrate the crime again. Blood of a lot of innocent Pakistanis is on the neck of our inept police and so called guardians of justice. To a casual observer it would appear that Pakistan Courts in general and Supreme Court in particular is partial to terrorists and ignores the plight of innocent victims.

We will never get rid of the sectarain and suicide bomber menace until such time the Courts stop releasing thousands of known terrorists on technicality.

^^ a thing called circumstantial evidence can overcome your objection, if provided.. you just cannot randomly pick up brothers of same family working in urdu bazar and kill them...

the fact of the matter is that ISI has failed miserably to protect Pakistan's security, they themselves admit that it has only been due to CIA collaboration that they met some success...otherwise all they do is "Tamak Toiyan"

CJ rightly said that ISI is biggest violator of law, as it can pick anyone without evidence, detain and kill and get away... and pasha and co dont really feel answerable to courts

I think by now atleast that col and other army culprits in Kharotabad incident and that ranger who killed the boy should have been put to death through shooting squad, but damn this judicial system, the murderers get away everytime... oh so uniform !!

Sure, Pakistan has a lot of enemies. How did these enemies came into being ? It was Pakistan's own doing, and the situation faced today is the sum of every conscious decision that Pakistanis have made.

Blind faith in ISI is maintained only because there are no alternatives to blind faith available. Perhaps some day wikileaks will shed more knowledge on how deserving the ISI really is of this kind of support from the people.
 
ISI is the protector of Pakistan and they must continue their job, the problems we are facing today are actually gifted by Jernails Zia created them and Mush launched war against them both jernails were good in likcing US boots and victims are Pakistani civilians.
 
the court in my opinion does have some merit . one has to judge that do you want a law abiding agency or a one above the law , protecting you.
the ISI is staffed by people , humans are prone to bouts of ego and megalomania , especially when they are accountable to no one.
we had that problem during the 60-70s with the cops in India. (as there were no human rights groups , they did what ever they wanted. )

by the way Pakistan in my opinion is not facing so much of an external threat as an internal one . your own people are responsible for causing a lot of Pakistan problems in the name of nationalism .
i may be wrong but please feel free to refute me .

Sure, Pakistan has a lot of enemies. How did these enemies came into being ? It was Pakistan's own doing, and the situation faced today is the sum of every conscious decision that Pakistanis have made.

Blind faith in ISI is maintained only because there are no alternatives to blind faith available. Perhaps some day wikileaks will shed more knowledge on how deserving the ISI really is of this kind of support from the people.

You are right our enemies came into existence due to our doings.....coz we did mistake to make separation of Maha Baharat in 1947...till that date India (Hindus) never accept Pakistan.
 
Its a shame our judiciary cant behave more like western judiciary. There is something known as national security and they would do well to remember how British judiciary reacted to the GCHQ case. Where Lords Fraser, Scarman and Diplock all believed that the issue of national security was outside the remit of the courts, Scarman writing that "It is par excellence a non-justiciable question. The judicial process is totally inept [sic] to deal with the sort of problems which it [national security] involves"

ISI are the guardians of our security and should be given praise and not so openly maligned.

But there's got to be something that everyone (both external and internal ) is blaming ISI for doing illegal acts and extra judicial killings.. And they have anyway not been able to deliver on keeping Pakistan secure anyway.. So then why allow that leeway when they are anyway failing in their prime responsibility

The mere fact that Americans Israelis and Indians like you dont like our ISI tells me that ISI must be doing the right thing and must be supported and appreciated as it is by Pakistanis.
 
its happen when you tackle national security give me name of angels please .CIA RAW MOSSAD MI-5 MI-6 all work under law?
